ARTICLE I - RECOGNITION SECTION 1: The City recognizes the Union as the sole and exclusive bargaining agent for the purpose of establishing wages, hours and other conditions of employment for all of its full-time department members employed in the fol,lowin.g work classifications: Fire Fighter, Lieutenant, Assistant Fire Marshal , Battalion Chief and Fire Marshal . SECTION 2: The probationary period for a new employee shall be in accor- dance with Civil Service Rules and Regulations. ARTICLE II - UNION SELURITY AND DEDUGTION OF DUES SECTION-1: Each member covered by this agreement who is a member of the. Union on or after the effeetive date of this agreement, shall as a con- dition of continued employment, remain a member of the Union during the term of this agreement. Each member hired after the effective date of the agreement shall , within a period of thirty-one days commencing from the first date of employment, as a condition of employment, make application to and become a member of the Union; or, in the case of employees with a bona fide religious objection to joining the Union contribute an amount equal to the periodic dues and initiation fees uniformly required as a condition of acquiring or retaining membership to a mutually agreed upon charitable organization as provided for iq R.C.W. Chapter 41.56. SECTION-2: The City agrees to deduct each month Union dues equal to one and one-quarter percent (lf%) of a Firefighter First Class's base wage and assessments from the member' s wages in the manner prescribed hy law. The amount so deducted shall be sent each payday to the Union. - 1 - 1986 CONTRACT FIRE FIGHTERS LOCAL �1352 ARTICLE III ARTICLE III - UNION ACTIVITY The City agrees not to discriminate against any member for lawful activity in behalf of or membership in the Union. The Union also agrees not to discriminate against an e�ployee of the City for their failure to join the Union. ARTICLE IV - HOURS OF WORK AND OVERTIME SECTION 1. WORKWEEK, SHIFTS: For members having twenty-four (24) hour uty�shi�ts, shifts shall begin at 7:00 a,m. and expire the following day at 7:00 a.m., providing that shifts occurring on Sundays and holidays established by City Ordinance shall commence at 8:00 a.m. This normal workweek shall not exceed an a4erage of forty-eight point three (48.3) hours or 2511.60 annually exclusive of the additional one hour incurred relative to the special Sunday and holiday shifts. This shall be � accomplished by the use of credit shifts (24 hours) to be scheduled evenly throughout the year by the Fire Chief or his/her designee. SECTION 2. WORKWEEK, DAYS: The normal workweek for day shift members shall not exceed forty (40) hours per workweek. As mutually agreed, the member may work five (5) eight (8) hour days (Monday through F�iday) or four (4) ten (10) hour days (Monday through' Thursday) or (Tuesday through friday) . SECTION 3. OFFSHIFT WORK, MINIMUM CALLBACK: Effective June 1, 1986, all off--shi� members wi11 be paid at their overtime rate when called back to duty when off shift. Members held over on their normal shift because of an emergency call occurring at shift change shall be paid for one hour or for the actual time worked, rounded off to the next higher hour. Nlembers called back to duty for less than one and one-half (1#) hours shall be. guaranteed a minimum of two hours at their overtime rate and members called back to duty for more then one and one-half (1#) hours shall be guaranteed a minimum of four hours at their overtime rate. All members called back to duty for an emergency situation shall be released as, soon as the emergency is over and the equipment that was used is put back in service. SECTION 4. OVERTIME RATE: Effective June 1, 1986, a member shall be paid o�ime at the rate of time and one-half based upon the current rate of pay for his/her individual classification. The overtime rate of pay shall be determined by multiplying the individual 's current rate of pay (stated in Appendix "A") by twelve (12) and dividing that amount by the individual ' s annual scheduled hours of work (2080 or 2511..6) and multiply- ing the result by 1.5. - 2 - 1986 GONTRACT FIRE FIGHTERS LOCAL #1352 ARTICLE IV (CONT' D) SECTION 5. ADDITIONAL MANPOWER: With the exception of the use of mutual or automatic aid and whenever possible, any additional manpower require- ments of the Fire Department shall be met by first affording the oppor- tunity to work to full-time paid members of the Fire Department. SECTION 6. CREDIT SHIFTS: Credit shifts may be t�aded between members, or moved with the approval of bhe Fire Chief or his/her designee as long as there remains the minimum number of inembers on duty. SECTION 7. PAYMENT FOR NON-EMERGENCY OR NON-MANNING OVERTIME: Overtime pay or compensatory time shall be earned at the rate of one and one-half (1}) hours for each overtime hour worked. This shall be the member' s choice provided that choice is made clear to the supervisor prior to the overtime e.�ng incurred. No member may accumulate more than ninety six (96) hours of compensatory time. All compensatory time accumulated by a member as of the first of June each year, may be paid at the member's current rate of pay by separate check on or before the first of July. . No member may carry more than forty-eight (48) hours of compensatory time past the first of July. Compensatory time off must be used in corresponding work/duty shift increments of 24, 10 or 8 hours. Regular periods of vacation shall have priority over compensatory time off when scheduling with thirty (30) or more days' notice. ARTICLE V - WAGES SECTION 1. COMPENSATION: Members covered by this Agreement shall , com- mencing January 1, 1986, be compensated in accordance with the wage sche- dule attached to this Agreement and marked Appendiz "A. " Additionally, this wage schedule shall be increased by 80% of the July-July, 1986 CPI-W on January 1, 1987. The 80% CPI increase shall have a maximum increase of 3.0%, and a minimum increase of 1,5%. SECTION 2. PROFICIENCY PAY: Proficiency pay in the amount of two percent 2 ) of a Firefighter First Class base salary rega�dless of rank as set forth in Appendix "A" shall be applied to the base salary for the depart- ment mechanic. For purposes of clarification, effective May 1, 1985, the EMT premium pay described in the 1984/85 contract became part of the base monthly wage, in accordance with the M.O.U. as amended dated November 17, 1985 (see attach- ment N1) . SECTION 3. EDUCATIONAL INCENTIVE: Effective June 1, 1986, members in the arg�ining unit that have completed courses applicable to a fire science degree shall be paid an educational incentive based on the following per- centages of a Fire Fighter First Class base salary regardless of rank as set fo�th in Appendix "A" for credits completed:. - 3 - 1986 CONTRACT FIRE FI6HTERS LOCAL #1352 ARTICLE V (CONT'D) PERCENTAGE OF FIREFIGHTER CREDITS 15T CLASS SALARY 1. ) 30 college credits 2% of base salary 2. ) 60 college credits 4% of base sala"ry 3. ) AA Degree (90 credits in 6X of base salary fire science) SECTION 4: LONGEVITY: Longevity pay shall be paid regardless of rank to members upon completion of years of service in accordance with the following schedule: MONTHS OF SERVICE AMOUNT 1. ) Upon completion of 54 months $ 50.00 per month 2. ) Upon completion of 66 months 5100.00 per month 3. ) Upon completion of 78 months 8150.00 per month SECTION 5. TEMPORARY ASSI6NMENT: Effective June 1, 1986, any member tem; porarily assigned �by the Chief of the Department to work in a higher classification shall be paid at the established rate of pay for such classification while performing such duties with payment to be made com- mencing with the first shift. SECTION 6. COURT TESTIMONY: An member required to appear in court during off-duty hours as a witness on behalf of the employer relative to a duty- related incident shall be compensated for a minimum of two (2) hours at time and one-half for actual attendance at the court hearing per calendar day. SECTION 7. BASE HOURLY RATE CALCULATION: The base hourly rate of pay, exce�r calculating overtime pay actually worked, sha}1 be egual to the (monthly base X twelve) divided by (regular workweek X fifty-two). SECTION 8. CURRENT PAY RATE CALCULATION : The members' current rate of pay s�TT tie equal to the (monthly base rate of pay plus incentives, including longevity X 12) divided by (the workweek X fifty-two). SECTION 9. PAY DATES: Paydays shall be on or before the fifth and twen- tiet—` h of each month. 5hould a special circumstance or problem occur regarding the distribution of checks on t.hese dates, the Finance Department will notify the Union President of the alternate pay date. SECTION 10. PAY DIFFERENTIAL: Effective 1-1=86, the following pay dif'- ere�is hereby established: A) Between Fire Fighter Firsb Class and Li.eutenant, 110% of FF1G base wage; B) Between Fire Fighter First class and Battalion Chief, 120X FFIC base wage. _ q _ 1986 CONTRACT FIRE fIGHTERS LOCAL �1352 ARTICLE V (CONT'D) SECTION 11. TUITION REIMBURSEMENT: The City agrees to reimburse members or e ucational expenses including tuition and books for courses applicable to a Fire Science degree or for other courses with prior approval of the Fire Chief or his/her designee. City paid books will become the property of the Fire Department and be placed in the department library. The amount of tuition reimbursement shall be limited to the current rate schedule at the University of Washington for the same number of credits earned. In order to be eligible for reimbursement, the member must receive a grade of "C" or better, or "Pass" in a pass/fail system. SEGTION 12. STANDBY TIME-DUTY CHIEF: Effective June 1, 1986, the City and the Union agree that the use of stand-by time shall be consistent with sound fire fighting practices and with the maintenance of public safety. Battalion Chiefs formally placed on stand-by status shall remain within fifteen (15) minutes of the fire department response area and shall receive six (6) hours of compensatory time for each twenty-four (24) hour period, or pro-rated for portions thereof. If a Battalion Chief is actually called back to duty while on stand-by status, then normal overtime provi- sions shall apply and shall be in addition to stand-by compensation. ARTICLE VI - HOLIDAVS SECTION 1. For the purposes of this Agreement holidays shall start at the beginning of a members' normal shift of the day itself and continue for the next twenty-four hours. SECTION 2. Ail shift members shall be allowed five shifts leave annually rega�r Tess of shift assignment in lieu of holidays. Holidays may be sched- uled any time with the approval of the Shift Officer as long as there remains the required minimum number of inembers on duty. Holidays may be taken with the approval of the S.hift Officer in half-day shift increments (12 hours) commencing at 7:00 a.m. or 7:00 p.m. Holidays shall not be con- secutively granted to any member of the Fire Department unless the Fire Chief finds that there are special circumstances justifying the same and that the extended absence of such member shall not impair the efficiency of the Department. SECTION 3. At the discretion of the employee, upon written request to the Fir—e Chief no later than November 30, the City agrees to pay at the member' s current rate of pay a maximum of two unused shifts of holiday leave. Payment shall be made by separate check on' or before December 20th of each year. SECTION 4. Members called back to work on scheduled shifts off t.hat fall on th�llowing holidays established by City Ordinance shall be paid two times their tiourly rate of pay in accordance with the overtime formula in addition to normal compensation. 1. ) December 25 (Christmas Day) 2. ) Fourth Thursday in November (Thanksgiving Day) 3.) Holidays taken in any amount shall be subject to being bumped by regular periods of vacation with 30 or more days notice. SECTION 6. Effective June 1, 1986, members scheduled to work on shifts that fall on the following holidays shall receive time and one-half for hours worked between 0800 and 2000 hours: A. New Year' s Day &. The Fourth of July C. Tfianksgiving Day D. Christmas Day ARTICLE VII - VACATION SECTION 1. Each member of the bargaining unit shall be granted a vaca- tionin each calendar year without loss of pay. Such vacations shall be computed in accordance with Section 4 and 5 of this Article and under the direction and supervision of the Chief of the Fire Department o� his/her designee. SEGTION 2. Vacation shall be chosen by individual member per Department Ru e� s and Regulations as stated below: Vacation may be taken 'in one shift increments by twenty-four hour shift members but will be subject to being bumped tiy a vacation period of two (2) or more shifts with thirty (30) days notice during the months of January, February, March, April , May, September, October, November and December. During the months of June, July, and August, vacation must be taken in the amount of three (3) or more consecutive shifts to hold vacation privileges. If less than three (3) shifts of vacation are taken during this period, they shall have the same rights as a holiday and be Sub- ject to being bumped by regular vacation periods of three (3) or more shifts. No more than two (2) periods of three (3) or more shifts with 30 or more days' notice shall be scheduled by any member during June, July or August prior to March 1. Seniority shall determine tha vaca- tion scheduling prior to March 1. - 6 - 1986 CONTRACT FIRE FIGHTERS LOCAL #1352 ARTICLE VII (CONT'D) SEGTION 3. At the member's discretion, upon written request to the Fire Chie—f no later than November 30, all remaining vacation over six shifts which have been earned that year but not taken in accordance with the • existing policy, shall be paid by separate check on or before December 20 of each year at the member' s current rate of pay. SEGTION 4. Each full-time member of the Auburn Fire Department shall be enti—'t e to accrue annual vacation leave for each monEh of continuous ser- vice conunencing from the date of thei� initial employment in the Auburn Fire Department. Fire Department members working shift work shall be entitled vacation in accordance with the followin,g schedule: 1 through 5 years service Accrue 7 shifts 6 through 10 years service Accrue 9 shifts 11 through 15 years service Accrue 10 shifts 16 through 20 years service Acc�ue 11 shifts 21 or more years service Accrue 12 shifts SECTION 5. Fire Department members working day shift shall be granted vacation in accordance with the fo_llowing schedule: 1 thru 5 years se�vice Accrue 14 days 6 thru 10 years service Accrue 18 days 11 thru 15 years service Accrue 20 days 16 thru 20 years service Accrue 22 days 21 or more years service Accrue P4 days SECTION 6. Members may have no more than 23 months times their monthly accumu�on of vacation hours on the books unless they have carry over approved by the Chief. ARTICLE VIII - SICK LEAVE SECTION 1. Al1 full-time members shall be entitled to utilize sick leave when they are incapacitated for the performance of their duties by reason of sickness or injury or when through family illness their presence is required. The presence of a full-time member shall be deemed as required for medically documentable illness or injury indolving the employee' s irmne- diate family who are residing with the employee or for other family members with prior aPproval of the Fire Chief or his/her designee. Effective January 1, 1986, sick leave (for shift members) shall accrue on the basis of one shift (24 hours) per calendar month to a maximum of 1,300 hours at which time the accrual and usage rate shall change to ten (10) hours per month until the sick leave accrued drops below 1300 hou�s at which time the accrual and usage rate will return to twenty-four (24) hours per month _ � _ 1986 CONTRAGT FIRE FIGHTERS LOCAL �1352 ARTICLE VIII (CONT' D) until accruals again exceed 1300 hours. Sick leave accruals for day shift members shall accrue on the basis of eight hours (8) per calendar month to a maximum of 960 Hours. When sick leave is taken by a day shift member, it shall be deducted on the basis of one hour of sick leave accrual for each one hour of sick leave used. Gonversion of accrued sick leave shall be accomplished for shift members scheduled to days and day members scheduled to shift by using the ratio of 1300 to 960 by multiplying day to shift accrued hours by 135.4% and shift to day accrued hours by 73.9%. SECTION 2. Sickness shall be report,ed at the beginning of any period of illness to the Fire Chief or his/her designee, and, within three days after returning . to work, the member shall give a written statement including a doctor's certificate when requested, explaining the nature of his/her illness and shall submit a formal request for approval of leave so taken. Such request, when approved by the Fire Chief shall be filed in the depart- ment sick leave file. SECTION 3. Upon certification of disability reti�ement by the Department o�ement Systems, retirement, death or termination in good standing (not termination for cause) the member shall be reimbursed at current rate. of pay for unused accrued sick leave up to a maximum of 1300 hours in aecordance with the following schedule based on continuous years of ser- vice: � U on Com letion of Percent of Accrued Unused ears o ervice ic Leave 0 though 4 years 0% -- unless in the event of death occurring in the line of duty, 25% of such member accrued unused sick. leave would be paid to the mem- ber' S beneficiary. 5 through 14 years 25% 15 through 24 years 50% 25 years and over 100% SECTION 4. When a LEOFF II member sustains an on-the-job injury or ill- ness as covered by Washington State Workers' Compensation, he/she shall receive his/her current rate of pay for a period not to exceed siz months, provid,ed he/she signs all Workers' Compensation checks over to the City. (The 350 hour disability pool wi11 no longer exist. ) The member will continue to receive all employer fully funded benefits afforded actiVe members. - $ - 1986 CONTRACT FIRE FIGHTERS LOCAL #1352 ARTICLE VIII (CONT'D) SECT.ION 5. Effective January 1, 1986, when a shift member has accumulated 300 hours of sick leade, or when a day member has accumulated 960 hours of sick leave, his/her sick leave shall continue to accumulate at the appropriate rate per month, as defined in Section 1 above, until the end of the year, at, which time all sick leave accumulated in excess of the maximum shall be paid at twenty-five percent (25%) of the member' s current rate of pay by separate check on or before the fifth of January each year. ARTICLE IX - BEREAVEMENT LEAVE Members shall be allowed up to three calendar days off for day members or one 24-hour shift off for shift members without loss •of pay for death in his/her immediate family requiring his/her presence, upon approval of the Fire Chief. Irmnediate family shall include under this caption only grandparents, father, mbther, father-in-law, mbther-in-law, spouse, brother, sister or children of the member. ARTICLE X - JURY PAY SECTION 1. A member serving on a jury will be excused from work with pay prov— id that the City salary paid to the member for the period of jury service shall be reduced by the amount of money he/she receives for that service. SECTION 2. Appearances before a court, legislative comnittee, or quasi- judicial body as a witness in response to a subpoena or other directive, shall be approved as authorized leayes with pay. However, the city salary shall be reduced by the amount paid for such an appearance. ARTICLE XI - HEALTH INSURANCE SECTION 1. Effective January 1 , 1986 he_alth care, dental care and life insurance program shall be granted to eli.gible members and their depen- dents, the cost to be paid by the City. The plan includes:. 1. ) Association of Washington Cities' Medical Plan, as reyised April 1, 1986 2. ) Washington De.ntal Service Dental Plan "A" 3. ) Great West Prescript,ions 4. ) Western Vision Eye Care 5. ) Association of Washington Gities' Life Insurance 6. ) LEOFF II Disability Insurance of $18.00 per month ARTICLE XII - UNIFORM ALLOWANCE SECTION 1. Uniforms and protective devices shall be furnished by the Gity. SELTION 2. Any changes in uniforms shall be made through mutual consent of the Chief of the Department and the Union Uniform Committee. _ 9 _ 1986 CONTRACT FIRE FIGHTERS LOCAL #1352 ARTICLE XIII ARTICLE XIII - GRIEVANCE CONCILIATION AND ARBITRATION PROCEDURE For purposes of this Ayreement, the term grievance means any dispute bet- ween the Employer and the Union concerning alleged breach or Violation of this Agreement. Any alleged grievance shall be taken up by the member with his/her super4isor within ten shift days of the occurrence. The above parties agree to make every effort to settle the grievance promptly at this stage. If no satisfactory settlement is reached, the following procedure shall apply: SteP 1: The grievance shall be reduced to written form by the aggrieved member stating the section of the A9reemenE violated and explaining the grievance in detail . The Union representative shall present the written grievance to the Assistant Fire Chief within five (5) days after the alleged grievance is taken up with his/her supervisor. The Assistant Chief shall commence a meeting within five (5) working days after receipt of the written grievance between tlie member, supervisor and the Union representative. Five (5) days after such meeting, the Assistant Chief shall transmit a copy of his/her decision to the aggrieved memher and the Chief of the depa�tment. �Ste �2. Should the grievance remain unresolved after the. written ecd ision is delivered in Step 1 to the Chief of the Department, a meeting shall be held by Chief of the Department with the member, Union representative and the Assistant Chief within ten (10) working da,ys from receipt of the written decision relative to Step 1. The Chief of the Department shall m8ke a decision on the matter in writing within ten (10) working days from such meeting. Copies of the Chief' s decision will be furnished the aggrieved and the Union representative: SteP 3• Any grievance remaining unresolved after the decision has been rendered in Step 2 shall be transmitted to the Mayor in writing whereupon the Mayor shall conduct an investigatory hearing within five (5) working days of receipt of the written grievance.. The Mayor shall renqer a decision in writing within three (3) wbrking days of such hearing. SteP 4• If the grievance is not settled in Step 3, the grievance may be submitted to an arbitrator as hereinafter provided. The p.arti,es shall select within ten (10) days, a disinterested party to serve as arbitrator. In the •event the Employer and the Union are unable to agree upon an arbitrator, the arbitrator shall be. selected by the process of elimination from a panel of eleven arbitrators furnished by the American Arbitration Association. The. arbitrator shall render a decision as promptly as possible. The Arbitrator shall have jurisdiction and authority only to interpret, apply or determine compliance with the specific terms of the = 10 - 1986 CONTRACT FIRE FIGHTERS LOCAL N1352 ARTICLE XIII (CONT'D) Agreement and shall not have jurisdiction to add to, detract from or alter in any way the provision of this Agreement. Any decision within fhe jurisdiction of the Arbitrator shall be final and binding upon the parties. The expenses and fees incumbent to the se�vices of the arbitraor shall be equally shared by the Employer and the Union. Any, time limits stipul.ated in the grievance procedure may be eztended for stated periods of time by the appropriate parties by mutual agreement in writing. Pending final decision of any grievance by any of the above procedure, work shall continue without interruption and under conditions prevailing prior to the time the dispute started. ARTICLE XIV - MANAGEMENT'S RIGNTS The Union recognizes the prerogative of the City to operate and manage its affairs in all respects in accordance with its responsibilities, and the powers or authority which the City possesses. These include, but are not limited to, the following: a) The Union recognizes the exclusive right of the City to establish reasonable work rules. b) The City has the right to schedule overtime work as requir2d and consisfent with the requirements of municipal employment and the public interest. c) It is understood by the parties that every incidental duty con- nected with operations enumerated in job descriptions is not always specifical,ly described. Nevertheless, it is intended that all such duties shall be performed by members. d) The City reserves the right to discipline members or discharge members for cause. The City reserves the right to lay off members for lack of work or funds, or for the occurrence of canditions beyond the con[rol of the City or wfiere such con- tinuation of work would be wasteful or unproductive. The City shall have the right to determine required schedules of work and to establish the methods and processes by which such work is to be performed. e) The City ag�ees to maintain a standard of work scheduling con- sistent with other cities in the area whose members work a similar tour of duty: - 11 - 1986 CONTRACT FIREFIGHTERS LOCAL N1352 ARTICLE XU ARTICLE XV - BULLETIN BOARD A bulletin board shall be provided by the City in each fire station and located in a mutually satisfactory place for posting by the Union of ' notices of ineetings; union elections and results of union elections. ARTICLE XVI - NO STRIKE The Union agrees that there shall be no strikes, slowdowns, stoppages of work, or any interference with the efficient management of the Fire Department during the term of this Agreement. ARTICLE XVII - UNION REPRESENTATIVE SEC710N 1. The business representative or other duly authorized Union representative shall be permitted to visit the department during operating hours for purposes consistent with. the Agreement, proJiding he/she does not interfere with working members. SECTION 2. The Union agrees not to conduct Union business on the City' s time and agrees that no Union meetings will be held during regular established operating hours on City premises. To enable full represen- tation at meetings by members of the bargaining unit, the established operating hours for this purpose shall be deemed to be between 7:00 a.m. and 5:00 p.m. Monthly meetings may be held on a regular basis in Fire. Station 31' s Training Room. Additional meetings requiring the use of the Training Room will require prior approvpl of the Fire Chief or his/her designee. SECTION 3. The pa�ties haJing a labor Agreement hereby agree that such members of the Union (three) as may be designated by the Union with prior notification for the purposes of direct participation as members of the Union negotiating team in labor negotiations with the City of Auburn, shall be granted leave from duty without loss of pay for such negotiations. ARTICLE XVIII - NONDISCRIMINATION The Union and the City agree to promote and afford equal employment oppor- tunities to all persons regardless of race, creed, color, ethnicity, national origin, sex, age or marital status or the presence of any non-job- related physical , sensory or mental handicap. ARTICLE XIX - RETENTION OF BENEFITS All wages, hours and working conditions held by members at the present time and those in accordance with City Ordinances as well as those specifi- cally mentioned in this Agreement . shall remain in full force, unless changed by mutual agreement durin.9 the term of this agreement. Should any Article, Section or porti,on thereof of this Agreement be held unlawful and unenforceable by any Court of competent jurisdiction, such decision of the Court shall apply only to the specific Arti.cle, Section or portion thereof, directly specified in the decision. , ARTICLE XXI - FOOD ALLOWANCE The City shall pay a19 bargaining unit members working 24=hour shifts an allowance of one dollar ($1.00) per .shift actually worked in lieu of sub- sistence. This amount shall be computed annually and paid by separafe check on or before December 20 of each yea"r. ARTICLE XXII - DURATION SECTION 1. Except as indicated in individual articles, this Agreement shall be effective January 1, 1986, and shall remain in full force and effect through December 31, 1987.
