HomeMy WebLinkAboutMark Jensen crry OF . - • AGREEMENT FOR VOLUNTEER SERVICES AUBURN Human Resources and Risk Management Department WASHINGTON The Agreement is made, by and between the City of Auburn, a political subdivision of the State of Washington hereinafter referred to as the "City" and Mark Jensen hereinafter referred to as the "Volunteer." PURPOSE: The purpose of this Agreement is to outline the responsibilities of the City in providing volunteer opportunities, and to create an understanding between the City and the Volunteer. This Agreement applies to persons voluntarily performing non-compensated services for the City, including but not limited to, non-compensated practical work experience, recreational programs, senior center programs, camp ground host, police resources centers, academic internships, and any other type of volunteer activities. VOLUNTEER AGREEMENT: The Volunteer agrees to abide by the information contained in the Volunteer Handbook and all relevant City policies and procedures. The Volunteer agrees to perform the volunteer services in a safe, responsible manner in accordance with the description of work. It is further understood that this Agreement shall not in any way constitute nor create an employer/employee relationship between the City and the Volunteer. The City shall not be responsible for, nor liable for, nor shall the applicant be eligible to receive, any wages. The Volunteer shall be eligible for a three hundred dollar ($300.00) monthly stipend as a result of this Agreement. The Volunteer will remit each month to the City of Auburn Parks and Recreation Department an invoice for the nominal stipend along with a detailed hourly report listing the time spent volunteering for the City. The hours worked will be utilized by the City for tracking and providing the Volunteer with workers' compensation medical aid coverage. In consideration of the City giving the Volunteer permission to perform these services with the benefits des ribed above, the Volunteer understands that: (Please initial the following) I am not to appear for volunteer service under the influence of any illegal drug or alcohol. All pets must receive prior written approval from the City, and may require the Volunteer to provide evidence of liability coverage to the City. I give permission to have my photo taken and used for publicity purposes by the City. Volunteer will be held solely liable, and assumes all risk of liability, for any guest's actions and agrees to hold the City harmless from any and all claims against the City; except for any injuries and damages caused by the sole negligence of the City. EXPECTED DUTIES: The Camp Ground Host volunteer duties should include a minimum of the following: 1. Greet campers in assigning available camp sites. 2. Check to see that drop in campers have registered. 3. Communicate with Parks staff regarding reserved camp sites and day camp. 4. Mediate any conflicts with campers and camp sites. 5. Place "Campsite Reserved" signs in advance of campers. 6. Open and close front gate and campground gate at assigned times. 7. Provide oversight and supervisory assignments of those entering and exiting the campground. 8. Provide minor maintenance and repair work as needed. 9. Report to parks staff any maintenance and repair issues as they arise. 10. Be knowledgeable and enforce all park rules and be observant of activities within the campground. 11. Be on-site during weekday check out and check in times and evenings. 12. Be on-site the majority of the weekends. 13. Complete walk thru of campground for trash collection and fire pit checks. Additionally, the volunteer is expected to perform some or all of the following: speak appropriately and respectfully to individuals of different ages and backgrounds, physically able to walk or hike on uneven outdoor surfaces, carry up to 50 pounds for short distances, bend and twist at the waist, use hands to perform and complete the above tasks in a timely manner' meet the time commitments required to successfully complete all tasks, and show initiative in job responsibilities. The Volunteer will not conduct any type of vehicle maintenance repairs on site, use any City equipment for their personal benefit, consume any type of alcohol, tobacco, or drug use while on duty, or engage in any offensive conduct or use of profanity, will not display any signs, decals, bumper stickers, posters, or any expression of speech toward any political or religious view point while volunteering for the City. FIREWOOD: Due to the demand and interest by registered campers, there is a need for the selling of firewood. The selling of firewood is not part of the Volunteer's duties under this Agreement, however; with approval from the Director of Parks, Arts& Recreation or his/her designee, the Volunteer may sell firewood to registered campers at a competitively priced rate. The Volunteer will incur all expenses and derive all profits from the sale of firewood. Firewood may be stored prepared and bundled on the site immediately adjacent to the Campground Host site. The area is to be kept clean and orderly. During the time the Volunteer is preparing and/or selling firewood, they will not be acting as a Volunteer for the City, and therefore will not be covered for any medical only workers' compensation coverage or WCIA liability coverage. Recreational Vehicle (RV) pad site located at the entrance to Game Farm Wilderness Campground. 2. Utilities to include electrical, septic, water, and garbage services of the campground. The Volunteer is responsible for any and all other utilities and services not specifically provided for by the City such as, but not limited to, internet, phone and cable services. The Parties agree that occupancy of the RV site is specifically conditioned on the Volunteer's performance of duties under this Agreement. As provided for in RCW 59.18.040(8), the City is not defined as a "landlord" and Volunteer is not defined as a "tenant" under the residential Landlord-Tenant Act(Chapter 59.18 RCW). TERMINATION: I understand that this agreement may be terminated by either party upon written or verbal notice by either party, and that I am volunteering my services at will and may be asked to discontinue such without prior notice or reason. Such termination shall be effective immediately unless otherwise stipulated by the parties. Upon notice of termination all benefits described above including the monthly stipend and workers' compensation medical only coverage shall cease. WAIVER AND HOLD HARMLESS: I am fully aware that the camp ground hosting duties associated with being a City Volunteer involves certain risks of physical injury or even death. Being fully informed as to these risks and in consideration of my being allowed to participate in the City's Volunteer Program, I hereby assume all risk of injury, damage and harm to myself arising from such activities or use of City facilities. I also hereby individually and on behalf of my heirs, executors and assignees, indemnify and hold harmless the City, its officials, employees and agents and release and waive any right of recover that I might have to bring a claim or a lawsuit against them for any personal injury, death, or other consequences occurring to me arising out of my volunteer activities. LIABILITY COVERAGE: I understand that the City is self-insured for liability coverage through the Washington Cities Insurance Authority (WCIA). Volunteers performing within the scope of their assigned duties as authorized by the City are afforded the same coverage as City employees under the City's liability coverage with WCIA. I am fully aware that a volunteer's intentional misconduct is not protected or covered by the City or WCIA. The City does not provide any personal property or fire insurance coverage for the Volunteer's personal property.
