2 AN ORDINANCE ,OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE CONSTRUCTION
3 AND INSTALLATION OF SIDE4lALK, CURB AND GUTTER, WATER MAINS, SANITARY
SEWER, STORM DRAINAGE, AND STREET LIGHTS ON 42ND STREET N.W. FROM "B"
4 STREET N.W. TO 969' EAST, DESCRIBED IN SECTION 2 OF THIS ORDINANCE;
CREATING AND ESTABLISHING AN ENLARGED LOCAL IMPROVEMENT DISTRICT N0. 331;
5 PROVIDING THE METHOD OF ASSESSMENT IN SAID DISTRICT AND THE MODE OF
PAYMENT THEREOF, AND CREATING A LOCAL IMPROVEMENT FUND THEREFOR.

WHEREAS, a petition has been filed with the City Council of the City of
8
Auburn, signed by the owners of the property aggregating a majority (1) of the
9
lineal frontage upon the improvement and (2) of the area within the proposed
10
district, setting forth the nature and territorial extent of the proposed
11
improvement, the mode of payment and what proportion of the area within the
12
proposed district is owned by the petitioners as shown by the records in the
13
Office of the County Auditor for King County, Washington, petitioning for the
14
construction and installation of sidewalk,, curb and gutter, water mains, sani-
15
tary sewer, storm drainage, and streeL lights on 42nd Street N.W. from "B"
16
Street N.W. to 969' east, legally described in Section 2 of this Ordinance,
17
inside the corporate limits of the City of Auburn; and
18
WHEREAS, the City Engineer has caused an estimate to be made on the cost
19
and expense of the proposed improvement and has certified said estimates to
20
the City Council, together with all papers and information in his possession
21
touching the proposed improvements, a description of the boundaries of the
22
district, a statement of what portion of the costs and expense of the improve-
23
ments should be borne by the property within tfie proposed district, a state-
24
ment in detail of any local improvement assessments outstanding and unpaid
25
26 against the property in the proposed district, and a statement of the aggre-
27 gate actual valuation of the real estate and the actual valuation of the
28 improvements in the proposed district according to the valuation last placed
29 upon it for the purpose of general taxation; and
30 WHEREAS, said estimates are accompanied by a diagram of the proposed
31 �mprovements showing thereon the lots, tracts and parcels of land and other

property which wi�ll be especially benefited by the proposed improvements and

the estimated amount of the cost and expense thereof to be borne by each lot,

tract and parcel of land or other property.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON DO
5
ORDAIN AS FOLLOWS:

Section 1. That the property legally described in Section 2 of this
7
Ordinance, situate inside the corporate limits of the City of Auburn, be
8
improved by the construction and installation of sidewalk, curb and gutter,
9
water mains, sanitary sewer, storm drainage, and street lights on 42nd Street
10
N.W. from "B" Street N.W, to 969' east, all in accordance with plans and spe-
11
cifications prepared by the City Engineer and filed with the City Clerk.

Section 2. That there is hereby created and established a Local
13
Improvement District to be designated Local Improvement District No. 331,
14
which said district is legally described as follows, to-wit:

16 Lots 2, 3, 5, 6, 7, 8, 9, 10, 11, 12 of the Preliminary Plat of
Valley Business Park II (Valley Business Park Addition) situated in
17 Section 36, Township 22, Range 4 East, W.M. and Section 1, Township
21, Range 4 East, W.M., located within the City of Auburn, King
18 County, Washington.
19 Section 3. That the estimated cost in carrying out the foregoing improve-
20 ment is hereby declared to be as near as may be, the sum of $288,247.00.
21 Section 4. Applicable costs and expenses of all engineering, legal,
22 inspection, advertising, publication and notices, and all other expenses inci-
23 dent thereto, shall be levied and assessed against all of the property legally
24 and properly assessable therefor, as provided by the laws of the State of
25 Washington and the Ordinances of the City of Auburn.
26 Section 5. That said improvements shall be made by the City of Auburn
27 under the supervision of the City Council thereof or such coimnittee or person
28 as the City Council may designate.
29 Section 6. Assessments or any portion "thereof, may be paid at any time
30 W�thin thirty (30) days from the date of the first publication of the Notice
31 of Collection of such assessments without penalty, interest, or cost, and

1 thereafter the sum remaining unpaid, if any, may be paid in ten (10) equal
2 annual installments, with interest on the whole unpaid sum at the rate of one
3 half (1/2) of one percent (1%) in excess of the net effective rate of the
4 Local Improvement District bonds.
5 Cormnencin with the first
g year after the last day, such assessments, or
6
any portion thereof, may be paid without penalty, interest or cost (thirty
7
(30) days from the date of the first publication of the Treasurer's Notice of
8 Collection of Assessments) and each year thereafter one of said installments,
9
together with the interest due, shall be collected as provided by law and the
10
Ordinances of the Gity of Auburn; assessments or installments of assessments
11
not paid when due shall be delinquent and there shalt be added to the same a
12 ,
penalty of twelve percent- (12%) of the amount of the overdue i.nstallments and
13
interest, and such;penalty. shall become a part of the lien upon the property

assessed.

Section 7. That there is hereby created in the Office of the Finance
16
Director for the City of Auburn, a fund of the City to be known as "Local
17
Improvement District No. 331 Fund.° Warrants shall be drawn on said fund
18
based on estimates made by the City Engineer and approved by the City Council
19
in payment of the cost of construction and installation of said improvements.
20
Section 8. The Mayor is hereby authorized to implement such administra-
21
tive procedures as may be necessary to carry out the directions of this
22
legislation.

Section 9. This Ordinance shall take effect and be in force five (5) days

from and after its passage, approval and publication,� as provided by law.
