HomeMy WebLinkAbout3818 1 ORDINANCE N0. 3 8 1 8 2 3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, AMENDING AND REPEALING CERTAIN SECTIONS OF CHAPTERS 2.7_1, 2.72 AND 3.04 OF THE AUBURN CITY CODE 4 RELATING TO THE AUBURN MUNICIPAL CEMETERY. 5 THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS: 6 7 Section 1. Certain sections of Auburn Codified City Ordinance Chapter 8 2.21 relating to Parks and Recreation Department are hereby amended to read as 9 follows: 10 °2,21.010 Created. 11 For the purpose of providing for the proper maintenance and opera- 12 tion of public parks, playgrounds, ((�-�`�)) recreational facilities, 13 and cemeteries belonging to the city, there is created and established a 14 department of the city to be known as the parks and recreation 15 department." 16 17 "2.21.�20 Powers and duties. 18 The parks and recreation department shall have all the powers to per- 19 form all the duties provided by the laws of the state relating to park and 20 recreational departments in cities of the third class. The parks and 21 recreation department ((, 22 _.:_F;__ ___ - ..--� �� shall have the management of the park, ((ar�6)) . � 2 3 playground system, ,cemeteries and the administration of the rules and 24 regulations provided by the �ea� Mayor and City Council for the manage- 25 ment of the municipal parks, ((�)) recreation areas, and cemeteries." 26 "2.21.030 Director - Appointment - Duties. 27 The mayor, with the consent of the city council, shall appoint a 28 director of parks and recreation who is the best trained and qualified 29 person available therefor, and he shall be the head of the parks and 30 recreation department. The director shall have charge of the management 31 of the park and playground system and cemeteries of the city and of the 32 appointment and supervision of qualified employees for the effective ----------------------------- Ordinance No. 3818 Page One of Five 10/14/82 1 operation of the public park and recreation system and cemeteries of the 2 city. The director shall have such other powers and duties as may from 3 time to time be imposed and conferred upon him by law or ordinance." 4 Section 2. Auburn Codified City Ordinance 2.72.040 relating to Cemetery 5 Board of Commissioners is herewith repealed in its entirety. 6 Section 3. There is herewith created a new Auburn Codified City Ordinance 7 ' 2.72.040 relating to Cemetery Board of Commissioners which shall read as 8 follows, to-wit: 9 "2.72.040 Board of cormnissioners. 10 There is created a board of five Cemetery cortvnissioners in and for the 11 City, and such Cemetery commissioners shall be appointed by the Mayor of 12 the City, and such appointments shall be subject to confirmation by the 13 14 � Gity Council , and terms of the commissioners to be five years, but the 15 first appointment shall be for uneven terms. 16 The Board shall have all the powers and perform all of the duties 17 Provided by the laws of the State of Washington relating to Boards of 18 Cemetery Cortunissioners. The Board shall advise the Mayor and City Council 19 on policy matters relating to long-range planning, capital improvements, 20 fee structure, cemetery expansion, rules and regulations, and budget of 21 all cemeteries belonging to the City. The Board shall not have authority 22 to enter into any contract, incur any indebtedness, or take any personnel 2 3 action unless specifically authorized by the Mayor and City Council . The 24 Board shall have the right to assign certain portions of the City's ceme- 25 teries for the burial of infants, persons of a particular religion, if 26 necessary, certain areas where no monuments shall project above the sur- 27 face of the ground, and the interment of cremated remains. The Board may 28 also solicit or receive on behalf of the City Council any gifts or 29 bequests of money for Cemetery purposes; however, gifts of real or per- 30 sonal property will not be accepted without prior approval of the City 31 Council . 32 A meeting of the Board shall tie held at least four times a year." ------------------------------ Ordinance No. 3818 Page Two of Five 10/14/82 1 Section 4. Certain sections of Auburn Codified City Ordinance Chapter 2 2.72 relating to Cemetery are hereby amended to read as follows: 3 "2.72.050 Lots subject to rules and regulations. 4 , All, lots in the Auburn cemetery are coveyed to the purchaser by 5 warranty deed when paid for, but the rights of the purchaser therein are 6 subject to such rules and regulations as are to be made from time to time � by the City Council (( ))," 8 9 "2.72.150 Funerals and interments. 10 Funerals while within the grounds will be under the control of the 11 <<"�'��"- �- `-�) supervisor or one of his assistants. All graves 12 shall be opened and closed by employees of the cemetery. Charges for 13 interments shall be ((�-`-`�;�:,�)) recormnended by the board of cemetery 14 cormnissioners and approved by the city council , exclusive of special ser- 15 vices requested by the family or necessary because of s ep cial circumstan- 16 ces. All interments shall be either metallic or concrete receptacles." � 17 "2.72.220 Location of grave: 18 When an interment is to be made, the pe�son requesting it must .show 19 or designate the exact position of the grave and give the order in person 20 or in writing. 21 Interments will not be made in lots which have not been paid for 22 except by speci.al permission of the city council , (( 23 ,)) and in all cases the city shall have the 24 right, at the time of default of payment by the purchaser, to remove the 25 remains to a single grave or to a smaller lot bearing a price not 26 exceeding, including expense of removal, the amount paid ((�)) for the 27 original lot." 28 29 30 31 32 ----------------------------- Ordinance No. 3818 Page Three of Five 10/14/82 - - i � "2.72.270 Trimming and pruning trees and shrubs. 2 3 � No person except authorized city personnel shall trim or prune or 4 remove any part of the trees or shrubs in the cemetery, whether on his lot 5 or not. On request, �the ((._�_°'-`__-'_-`_)) supervisor will do any pruning 6 needed without charge. if any tree or shrub situated on any lot by means � of its roots, branches, or otherwise becomes detrimental, dangerous or 8 objectionable to the adjacent lots, walks or avenues, the city shall have 9 the right (( )) to enter upon the lot and remove 10 the trees or shrubs, or any trees or parts thereof as it may see fit." 11 "2.72.280 Monuments. 12 Posts of concrete or stone at the corner of lots are all that will be 13 14 allowed as boundaries or enclosures. These must not project above the SUrfdCe of the ground. Lot owners must keep in good repair the __�_. . .__..__.._ 2 3 all stone or monumental work upon their lots. Payments for foundations 24 built by the city must 6e made in advance." 25 "2.72.290 Funerals - Days allowed. � 26 � A. Except in cases of emergency, funerals are not allowed on Sunday. 27 B. The ((�ear�) ) city council, upon recommendation by the Cemetery 28 Board, may at its discretion make an additional charge for 29 Saturday or legal holiday funerals." 30 31 32 ----------------------------- Ordinance No. 3818 Page Four of Five 10/14/82 . . . . . i � "2.72.300 Price of lots. 2 The price of all lots in the Auburn cemetery shall he ((--`-`�-�;,�)) 3 recommended by the board of cemetery commissioners and approved by the 4 city council and shall remain in effect until a new schedule is filed with 5 and approved by the city council ; provided that the ((�ear�)) council may 6 make such price adjustments necessary to comply with state regulations on 7 welfare burials." 8 9 Section 5: Auburn Codified City Ordinance 3.04.110 relating to Cemetery 10 Endowment Care Fund is hereby amended to read as follows: 11 "3.04.110 Cemetery endowment care fund - Keeping - Money payments. 12 All money received or obtained in the manner provided in Section 13 3.04.090 shall be deposited with the finance director and shall be kept 14 separate and apart in the fund known as the cemetery endowment care fund 15 and shall be paid out by the finance director only upon vouchers drawn by 16 the order of the ((;�--.----==-;• `=�-�')) Auburn city council and endorsed by 17 the mayor and attested by the city clerk." 18 19 Section 6. The Mayor is hereby authorized to implement such administra- 20 tive procedures as may be necessary to carry out the directions of this 21 legislation. 22 Section 7.
