3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE
ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT N0. 317,
4 WHICH DISTRICT HAS BEEN CREATED AND ESTABLISHED PROVIDING FOR THE
CONSTRUCTION AND INSTALLATION OF STREET IMPROVEMENTS ON THE WEST VALLEY
5 HIGHWAY FROM A POINT 860 FEET SOUTH OF 15TH STREET N.W. TO A POINT 3,000
FEET NORTH OF 15TH STREET N.W., INSIDE THE CORPORATE LIMITS OF THE CITY OF
6 AUBURN AS PROVIDED BY ORDINANCE N0. 3553, OF THE CITY OF AUBURN, AND
LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS, TRACTS,
7 PARCELS OF LAND AND OTHER PROPERTY UPON SAID ROLL.

WHEREAS, the assessment roll levying the special assessment against the
9
properties located in the Local Improvement District No. 317 of the City of
10
11 Auburn, Washington, created under Ordinance No. 3553, has been filed with the
12 City Clerk of the City of Auburn, as provided by law; and
13 WHEREAS, notice of the time and place of hearing thereof and making objec-
14 tions and protests to said roll was duly published at and for the time and in
15 the manner provided by law, fixing the time and place of hearing thereon for
16 the lst day of November, 1982, at the hour of 8:00 P.M, in the Council
lry Chambers of the Auburn City Hall , Auburn, Washington, and further notice
18 thereof was duly mailed by the City Clerk to each property owner shown on said
19 roll ; and
20 WHEREAS, at the time and place fixed and designated in said notice of
21 hearing was duly held, no protests were duly filed at said hearing; and
2 2 WHEREAS, after the hearing was held the assessment roll was accepted as
2 3 presented and ordered confirmed.
24 NOW, THEREFORE, THE CITY .COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
25 ORDAIN AS FOLLOWS:
26 Section 1. That there is hereby in all respects approved and confirmed
2q the assessments and assessment roll in Local Improvement District No. 317,
28 providing for the construction and installation of street improvements on the
29 West Valley Highway from a point 860 feet south of 15th Street N.W. to a point
30 3,000 feet north of 15th Street N.W. , inside the corporate limits of the City
31 of Auburn, according to plans prepared and on file in the Office of the City

20 Section 2. That each of the lots and other property upon said assessment
z1 roll is hereby declared to be especially benefited by said improvements in at
22 least the amount charged against the same, and that the assessment appearing
23
against each of" the same is in proportion to the several assessments appearing
24 on said roll. That all of the property shall be assessed according to the
25 lineal frontage of the property abutting said property to be improved and
26 shall be assessed according to their proportionate share of the several
27 assessments appearing upon the said assessment roll and there is hereby levied
28 and assessed against such lots and other property appearing upon said roll ,
29 the amount finally charged therein against the same; said amount, or any por-
30 tion thereaf, may be paid at any time within thirty (30) days from the date of
31 the first publication of the Notice of Collection of said assessments without
32 penalty, interest or cost; thereafter the sum remaining unpaid, if any, may be

paid in ten (10) equal annual installments, with interest on the whole unpaid

sum at the rate of one-half (�) of one percent (1%) in excess of the net
3
effective rate of the Local Improvement District Bonds with the interest in no
4
case being greater than thirteen percent (13%).

Commencing with the first year after the last day, such assessments, or
6
7 any portion thereof, may be paid without penalty, interest or cost (30 days
from the date of the first publication of the Treasurer's Notice of Collection
8
of Assessments) and each year thereafter, one of said installments, together
9
with the interest due, shall be collected as provided by law and the Ordinance
10
11 of the City of Auburn, assessments or installments of assessments not paid
12 when due shall be delinquent and there shall be added to the same a penalty of
13 eight and one-half percent (8.5%) of the amount of the overdue installment and
14 interest, and such penalty shall become a part of the lien upon the property
15 assessed.
16 Section 3. All monies collected by the Gity Treasurer upon any of the
17 assessments levied, as authorized herein, shall be paid into "Locai
18 Improvement District No. 317 Fund" created by Ordinance No. 3553, and shall be
19 used only for the purpose of redeeming warrants and/or bonds drawn upon or
20 issued against said fund.
21 Section 4. The Mayor is hereby authorized to implement such administra-
22 tive procedures as may be necessary to carry out the directions of this
2.3 legislation.
