3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, APPROVING AND CONFIRMING THE
ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT N0. 322,
4 WHICH DISIRICT HAS BEEN CREATED AND ESTABLISHED PROVIDING FOR THE
CONSTRUCTION AND INSTALLATION OF WATER MAIN AND FIRE HYDRANTS, SANITARY
5 SEWER AND APPURTENANCES, 24-FOOT STREET, PAVING, CURB AND GUTTER,
SIDEWALK, STORM DRAINAGE AND STREET LIGHTS ON "B" STREET N.W. BETWEEN 37TH
g STREET N.W. AND NORTH CITY LIMITS, INSIDE THE CORPORATE LIMITS OF THE CITY
OF AUBURN AS PROVIDED BY ORDINANCE N0. 3663, OF THE CITY OF AUBURN, AND
ry LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS, TRACTS,
PARCELS OF LAND AND OTHER PROPERTY UPON SAID ROLL.

g WHEREAS, the assessment roll levying the special assessment against the
10 properties located in the Local Improvement District No. 322 of the City of
11 Auburn, Washington, created under Ordinance No. 3663, has been filed with the
12 City Clerk of the City of Auburn, as provided by law; and
13 WHEREAS, notice of the time and place of hearing thereof and making objec-
14 tions and protests to said roll was duly published at and for the time and in
15 the manner provided by law, fixing the time and place of hearing thereon for
16 the lst day of November, 1982, at the hour of 8:0� P.M. in the Council
17 Chambers of the Auburn City Hall, Auburn, Washington, and further notice
18 thereof was duly mailed by the City Clerk to each property owner shown on said
7-9 roll; and
20 WHEREAS, at the time and place fixed and designated in said notice of
21 hearing was duly held, no protests were duly filed at safd hearing; and
22 WHEREAS, after the hearing was held the assessment roll was accepted as
23 presented and ordered confirmed.
24 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
25 ORDAIN AS FOLLOWS:
26 Section 1. That there is hereby in all respects approved and confirmed
27 the assessments and assessment roll in Local Improvement District No. 322,
28 providing for the construction and installation of water main and fire
29 hydrants, sanitary sewer and appurtenances, 24-foot street, paving, curb and
30 yutter, sidewalk, storm drainage and street lights on "B° Street N.W, between
31 37th Street N.W. and north city limits, inside the corporate limits of the

1 City of Auburn, according to plans prepared and on file in the Office of the
2 City Engineer of the City of Auburn, for the benefit of the following
3 described property:
4 Lots 1 and 2 City of Auburn Short Plat No. 27-78 as recorded under
5 King County Auditors File No. 7810190517,
6 Lots 16, 17, 18, and 19 White River Home tracts as recorded in
Volume 13 of Plats, page 17, records of King County, WA.

g Section 2. That each of the lots and other property upon said assessment
g roll is hereby declared to be especially benefited by said improvements in at
10 least the amount charged against the same, and that the assessment appearing
11 against each of the same is in proportion to the several assessments appearing
12 on said roll . That all of the property shall be assessed according to the
13 lineal frontage of the property abutting said property to be improved and
14 shall be assessed according to their proportionate share of the several
15 assessments appearing upon the said assessment roll and there is hereby levied
16 and assessed against such lots and other property appearing upon said roll,
17 the amount finally charged therein against the same; said amount, or any por-
18 tion the�eof, may be paid at any time within thirty (30) days from the date of
19 the first publication of the Notice of Collection of said assessments without
20 penalty, interest 'or cost; thereafter the sum remaining unpaid, if any, may be
27- paid in ten (10) equal annual installments, with interest on the whole unpaid
22 sum at the rate of one-half (2) of one percent (1%) in excess of the net
2 3 effective rate of the Local Improvement District Bonds with the interest in no
24 case being greater than thirteen percent (13%) .
25 Cortmiencing with the first year after the last day, such assessments, or
26 any portion thereof, may be paid without penalty, interest or cost (30 days
27 from the date of the first publication of the Treasurer's Notice of Collection
28 of Assessments) and each year thereafter, one of said installments, together
29 with the interest due, shall be collected as provided by law and the Ordinance �I
30 of the City of Auburn, assessments or installments of assessments not paid
31 When due shall be delinquent and there shall be added to the same a penalty of �

1 twelve percent (12%) of the amount of the overdue installment and interest,
2 and such penalty shall become a part of the lien upon the property assessed.
3 Section 3. All monies collected by the City Treasurer upon any of the
4 assessments levied, as authorized herein, shall be paid into "Local
5 Improvement District No. 322 Fund" created by Ordinance No. 3663, and shall be
6 used onl for the
y purpose of redeeming warrants and/or bonds drawn upon or
7 issued against said fund.
8 Section 4. The Mayor is hereby authorized to implement such administra-
9 tive procedures as may be necessary to carry out the direction"s of this
10
legislation.

Section 5. This Ordinance shall take effect and be in force five (5) days
12
from and after its passage, approval and publication, as provided by law.
