3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR A CONDITIONAL
USE PERMIT ON PROPERTY ZONED M-1 FOR RETAIL SALES OF VIDEO EQUIPMENT,
4 LOCATED AT 501 "C" STREET S.W., WITHIN THE CITY OF AUBURN, WASHINGTON.

WHEREAS, petition dated September 14, 1982, together with plot plans and
6
exterior elevations therefor, has been submitted to the Council of the City of
7
Auburn, Washington, by FARWEST ELECTRIC, INC., requesting a Conditional Use
8
Permit on property zoned M-1 (Light Industrial ), for retail sales of video
9
equipment, located at 501 °C" Street S.W., within the City of Auburn,
10
Washington, hereinafter described in Section 1 of this Ordinance, which pro-
11 '
perty presently carries a M-1 (Light Industrial ) classification; and
12
WHEREAS, said request above referred to, was referred to the Planning
13
Commission by the Auburn City Council for study and public hearing thereon;
14
and
15 '
WHEREAS, the Planning Correnission based upon staff review, held a public
16
hearing to consider said petition in the Council Chambers of the Auburn City
17 I
Ha.11, on October 5, 1982, .at 7:30 P.M., at the conclusion of which the
18
Planning Cormnission recormnended approval of the issuance of a Conditional Use
19
Permit on property zoned M-1 (Light Industrial), based upon the following
20
findings of the Department of Planning and Cormnunity Development, to-wit:

1. A large commercial use separates this site from the manufac-
z2 turing area to the south.
2 3 2. Ovmership is broken up in the area, limiting its use for
industry.

25 3. The C.U.P. is sought to supplement and maintain the economic
viability of a permitted use.
26 4. Economic failure of permitted use would lead to blighted con-
27 ditions.
28 5. The use would not represent an intrusion into a manufacturing
area.
29 5. The use would produce less adverse impact than most permitted
30 uses would.
31 �• A permitted use would continue to dominate this site.

1 8. While this use is not listed as a Conditional Use in the M-1
zone, it does meet the standard of 18.70.040 as "similar, not
2 more detrimental and equally essential ."
3 9. While not expressly in compliance with the Comprehensive Plan,
the use does assist in fulfilling the purpose of the
4 Comprehensive Plan in maintaining the economic viability of a
permitted use in the M-1 zone.

10. Storm drainage is inadequate and improvements are required.

11. 4th Street S.W. is inadequate to support existing and planned
7 uses it serves.

WHEREAS, the City Council of the City of Auburn, held a public hearing
9
in the Council Chambers of the Auburn City Hall, at 8:00 P.M, on November
10
1, 1982, at which time the City Council concurred with the findings of the
11
D.epartment of Planning and Community Development and the Planning
12
Commission as hereinabove stated.

14 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO
15 ORDAIN AS FOLIOWS:
16 Section 1. That a Conditional Use Permit on property zoned M-1 (Light
17 Industrial) be 9ranted for the purpose of retail sales of video equipment, in
18 accordance with the plot plans and exterior elevations for said development
19 submitted with the request for a Conditional Use Permit on property zoned M-1
20 (Light Industrial ), a copy of which is attached hereto, designated as Exhibit
21 "A" and by this reference made a part hereof as though set forth in full
22 herein, located at 501 "C" Street S.W., situate in the City of Auburn, County
23 of King, State of Washington, and legally described as follows, to-wit:

R 4 EWM, desc as foll :
25 Beg at a pt on the W ln of the R/W of the Northern Pacific Railway
26 Co. distant 417.45 ft Sly from the N ln of sd SE; of the SEo, sd pt
being 104,35 ft Sly from the SE cor of the tract of land conveyed to
27 A.S. McDaniel by deed recorded in Vol 805 of Deeds on pg 390, under
Auditors File No. �93595; th Sly alg sd W ln 104.35 ft; th W pllw the
28 S ln of sd McDaniel tract 208.7 ft; th N 104.35 ft tap on a ln pllw
and distant 104.35 ft S of the S ln of sd McDaniel tract; th E alg sd
29 pll ln 208.7 ft to the POB; EXCEPT roads; AND EXCEPT the E 5 ft
deeded to the City of Auburn, situated in the County of King, State

Section 2. That the Conditional Use Permit be limited to the existing

structure and not exceed 35% of the total area of the building; with the
3
remainder of the building to continue to be devoted to a permitted use.

Section 3. That the information on the site plan be incorporated as
5
conditions of approval .

Section 4. That on-site storm water be detained pursuant to City Code.
7
Section 5. That 4th St. S.W. be improved to City standards or that a
8
Delay Agreement be secured for such improvement from the Street Cortunittee
9
of the Council .

Section 6. That the site plan become part of the permit.
11
Section 7, That the Conditional Use Permit shall expire if after one year
12
the use has not yet been established pursuant to this ordinance.

Section 8. That the City Clerk for the City of Auburn, Washington,
14
is hereby authorized and directed to file a certified copy of this Ordinance
15
16 W�th the King County Auditor.
17 Section 9. The Mayor is hereby authorized to implement such
18 administrative procedures as may be necessary to carry out the directions of
19 this legislation.
20 Section 10. This Ordinance shall take effect and be in force five (5)
21 days from and after its passage, approval and publication, as provided by
22 1 aw.
