3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR A CONDITIONAL
USE PERMIT ON PROPERTY ZONED C-3 (HEAVY COMMERCIAL) FOR A FAMILY AMUSEMENT
4 CENTER LOCATED AT 4337 AUBURN WAY NORTH, WITHIN THE
CITY OF AUBURN, WASHINGTON.

6 WHEREAS, petition dated August 23, 1982, together with plot plans and
7 exterior elevations therefor, has been submitted to the Council of the City of
8 Auburn, Washington, by WILEY BROOKS, JAMES MC GUIRK, and WILLIAM SUMMERS,
9 requesting a Conditional Use Permit on property zoned C-3 (Heavy Commercial),
10 for a family amusement center, located at 4337 Auburn Way North, within the
11 City of Auburn, Washington, hereinafter described in Section 1 of this
12 Ordinance which
, property presently carries a C-3 (Heavy Commercial)
13 ��assification; and
14 WHEREAS, said request above referred to, was referred to the Planning
15 Commission by the Auburn City Council for study and public hearing thereon;
16 and
17 WHEREAS, the Planning Cortunission based upon staff review, held a public
18 hearing to consider said petition in the Council Chambers of the Auburn City
19
Hall, on October 5, 1982, at 7:30 P.M., at the conclusion of which the
20
Planning Commission recommended approval of the issuance of a Conditional Use
21
Permit on property zoned C-3 (Heavy Coimnercial), based upon the following
22
findings of the Department of Planning and Community Development, to-wit:

1. Consistent with zoning ordinance.

2. No Comprehensive planning issue involved.
25
3. Other permitted uses may involve more intensity of use than the pro-
26 posed conditional use.
2q 4. The proposed Conditional Use complements the existing permitted use.
28 WHEREAS, the City Council of the City of Auburn, held a public hearing in
2g the Council Chambers of the Auburn City Hall, at 8:00 P.M. on November 1,
30 1982, at which time the City Council' concurred with the findings of the
31 Department of Planning and Community Development and the Planning Commission
32 as hereinabove stated.

1 NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGI'ON, DO
2 ORDAIN AS FOLLOWS:

Section 1. That a Conditional Use Permit on property zoned C-3 (Heavy
4 Commercial) be granted for the purpose of a family amusement center, in
5 accordance with the plot plans and exterior elevations for said development
6 submitted with the re uest for a Conditional Use Permit on
q property zoned C-3

(Heavy Cormnercial), a copy of which is attached hereto, designated as Exhibit
8
"A" and by this reference made a part hereof as though set forth in full
9
herein, located at 4337 Auburn Way North, situate in the City of Auburn,
10
County of King, State of Washington, and legally described as follows, to-wit:

12 County, WA. desc as follows.
13 Beg at the SW cor of sd DLC; Th N 4574.46 ft; th E 1487.34 ft m/1 to the W
ln of G. Fraeger Rd; th S alg the sd W ln of the G. Fraeger Rd 40.0 ft to
14 the POB; th S 160 ft; th W 260 ft; th N 160 ft; th E 260 ft to the TPOB.
15 EXCEPTING therefrom all that por of sd tract of land lyg and being NEIy of
a ln drawn parallel with and distant 40 ft SWIy when measured at right
16 angles and radially with the c/1 of survey of Primary Highway #5 (Renton
to Auburn curve revision. )

Section 2. That additonal landscaping needs to be installed pursuant to
18 .
Sections 18.56.040 (A)(B) and 18.58.040(G) of the zoning ordinance.

Section 3. That no further license for an amusement device be issued
20 •
until the landscape plan has been approved by the Planning Director.
21
Section 4. That the revised site plan become part of the permit.

Section 5. That the plan for the parking lot be revised according to the
23
recormnendations of the Auburn Police Department.

Section 6. That the Conditional Use Permit shall expire if after one year
25
the use has not yet been established pursuant to this ordinance.

Section 7. That the City Clerk for the City of Auburn, Washington, is
27
hereby authorized and directed to file a certified copy of this Ordinance with
28
the King County Auditor.

Section 8. The Mayor is hereby authorized to implement such administra-

tive procedures as may be necessary to carry out the directions of this
3
legislation.

Section 9. This Ordinance shall take effect and be in force fiVe (5) days
5
from and after its passage, approval and publication, as provided by law.
