HomeMy WebLinkAbout3831 . , r ' I 1 ORDINANCE N0. 3 8 3 1 2 3 AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, PROVIDING FOR THE REZONING OF PROPERTY LOCATED ON THE EAST SIDE OF AUBURN WAY NORTH IN THE 4600 BLOCK 4 AKA 4610 AUBURN WAY NORTH, WITHIN THE CITY OF AUBURN, WASHINGTON, CHANGING THE ZONING CLASSIFICATION THEREOF FROM 5 UNCLASSIFIED TO C-3 (HEAVY COMMERCIAL). 6 WHEREAS, a petition has been submitted to the Council of the City of 7 Auburn, Washington, by CARL S. JOHANSEN, requesting the rezoning of the real 8 9 property hereinafter described in Section 1 of this Ordinance, which petit9on was dated September 20, 1982; and 10 11 WHEREAS, said request above referred to, was referred to the Planning 12 Commission by the Auburn City Council for study and public hearing thereon; 13 and , 14 WHEREAS, the Planning Cortunission based upon staff review, held a public 15 hearing to consider said petition in the Council Chambers of the Auburn City 16 Hall , on November 2, 1982, at 7:30 P.M. , at the conclusion of which the 17 Planning Commission recommended the approval of the rezoning of the said pro- 18 Perty based upon the following findings of the Department of Planning and 19 Coimnunity Development, to-wit: 20 1. Consistent with the Comprehensive Plan. 21 2. Consistent with the zoning in the area. 22 3. Consistent with the proposed land uses in the area. 23 4. Auburn Way North is a heavily traveled 5 lane arterial . 24 5. Present zoning is not consistent with existing zoning. 25 WHEREAS, the City Council of the City of Auburn, held a public hearing in 26 the Council Chambers of the Auburn City Hall, at 8:00 P.M. on December 6, 27 1982, at which time the City Council concurred with the findings of the 28 Department of Planning and Community Development and Planning Cortunission as 29 hereinabove stated; and 30 NOW, THEREfORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO 31 ORDAIN AS FOLLOWS: 32 ---------------------------- Ordinance No. 3831 Paqe One of Two 12/7/82 � • , , , . � Section 1. That the following legally described property located on the 2 east side of Auburn Way North in the 4600 block AKA 4610 Auburn Way North, 3 situate in the City of Auburn, County of King, State of Washington, be and the 4 same is hereby rezoned from Unclassified to C-3 (Heavy Cortunercial ) to-wit: 5 Beg at a pt 650.28 ft N of the SE cor of the W.A. Cox DC in Sec 31, 6 Twp 22 N, R 5 EWM in King Co., WA; th rnng W 1,056.97 ft m/1 to the E ln of the Co. Rd. ; th NWIy alg the E ln of the Co. Rd. 124.54 ft; th 7 E 1,135.25 ft, m/1, to the E ln of sd DC; th S 98.47 ft to the place of beginning; EXCEPT the E 600 ft thof. TOGETHERWITH AND SUBJECT TO 8 an easement for ingress, egress and utilities over under and across the N 5 ft of the E 700 ft thof. LESS the E 150.00 ft thof. That the amendment to the Comprehensive Zoning Map of the City 12 of Auburn, Washington, encompassing this Zoning use classification change, be 13 and the same is hereby approved. 14 Section 3. That the City Clerk for the City of Auburn, Washington, is hereby 15 authorized and directed to file a certified copy of this Ordinance with the 16 King County Auditor. 17 Section 4. The Mayor is hereby authorized to implement such administra- 18 tive procedures as may be necessary to carry out the directions of this 19 legislation. , 20 Section 5.
