PARK CARETAKER RESIDENCE
LEASE AGREEMENT '
TIIIS LEASG is made and entered into on the day hereinafter indicated by and
between Uie C[TY OF AUBURN, a Municipal Corporation of the State of Washington,
whose address 25 West Main Street, AuUurn, Washington 98001, hereinafter referred to as
"CITY," and STUART SEAN MAT1'HIS, whose address is 612 West Waterman Street, I�
B-102, Kent, Washington 98032, hereinatter referred to as "LESSEE."
IN CONSIDERATION FOR THE MUTUAL COVENANTS AND CONDITIONS
CO�TAINED HERE[N, THE PARTIES AGREE AS FOLLOWS.

Tl�e CITY does hereby lease and let and allow the LESSEE to maintain a
mobile home on real estate located at 28728 Green River Road SE, Kent
Washington, which is described as the caretaker home site, located at the
Mary Olson Farm.
2. TERM.
The term of this lease shall be month to month commencing on the 12'�' day
of April, 2016, and may be terminated by either party hereto only by
providing the other party wilh�iael�—({�days written notice prior to the

In lieu of the payment of rent and utilities, LESSEE will pe�j•torm the
following duties: See Atlached Volunteer Agreement
4 HOLD HARMLESS AGREEMENT
For and in consideration of the mutual conditions in this Ageement, the
LESSEE agrees to indemnify and hold hazmless and defend the CITY, its
elected officials, officers, employees, agents, and representatives from and
against any and all losses, damages, costs, chazges, expenses, jud�nents
and liabilities incurred by virtue of lhe LESSEE'S utilization of the above-
described maI property pursuant to the terms of this Lease Agreement.

5 USE OF YREMISES
It is further covenanted and agreed by and between the parties hereto that
LESSEE sliall utilize the leased premises as a residence and for no other
purpose whatever
G. INSYECTION BY THE CITY
The CITY or a representadve of the CITY may inspect said premises at any
reasonable times to ensure if the terms and conditions of this Lease
Agreement are being strictly complied with. CITY shall provide LESSEE
with 48 hours' notice prior to entering the premise unless an emergency
exiscs or is perceived, whereby the City may enter without notice.
7 NSURANCr.
LESSEE agrees to obtain and maintain, during thc tcnancy of the lease
described herein, homeowner's insurance in ihe minimum amount of
$500,000, which shall include ]iability coverage for injury to any person or
property arising from LESSEE'S occupancy of the premises. The CITY
shall be namcd as additionally insured on this policy Thc LESSEE agees
to furnish a Certificate of Insurance to the CITY and the CITY shall bc
notified a minimum of twenry (20) days prior to any cnncellation or
modificalion ofthe policy
8 DEFAULT AND RE-ENTRY
Failure of the LESSEE to fulfill and comply with lhe terms of ihis Lease
Agreement as herein specified, or upon the LESSEE'S violation of any of
the terms and conditions of the Lease Agreement, shall constitute grounds
for termination by the CITY upon giving LESSEE diirty (30) days written
notice. Upon termination of this Lease Agreement, LESSEE shall
peacef'ully remove personal properiy and surrender possession of said
premises. In the event the CITY is required to undertake any legal action of
any type whatsoever to enforce the provisions of this Lease Agreement,
then, in such event, LESSEE covenants and agrees to pay the CITY for its
reasonable attorneys' fees a�d costs sustained cherein.
9 UTILITIES AT�TD SCRVTCES:
a. LESSEE shall furnish, and pay �vhen due, all utilities for the leased
premises, �vhich shall include, but not be limited to, cable, intcmet
or phone services unless otherwise expressly provided for in this
Agreement.
b. LESSGE shall be responsible for removal of all garbage from the
leasehold premises on A weekly or bi-weekly basis.

]0. MAINTENANCE.
CITY shall be responsible for maintaining both the noratal weaz and tear of
the interior and exterior of the premise. LESSEE shall be responsible for the
interior and exterior of the premise beyond normal weaz and tear, and for all
consumable items including: Light bulbs, Furnishings, Supplies, etc.
1] ASSIGNMENT OR SUBLEASE.
LESSEE shal] not assign, transfer, or encumber this lease, and shall not
sublease the premises, or any other part thereof, or allow any other person
[o be in possession thereof, wilhout the prior written consent of the CITY
12. ENTiRE AGREEMENT
'1'his Agreement contains the entire Agrecment between the parties, and no
modification of this Lease Agrccment shall be binding upon the parties
unless evidenced by a written agreement executed by the CITY and the
LESSrE,
13. 'CAXES.
LESSEE agrees to pay any and all taxes, which may be owed to the State,
County, or City as a result of this Lease Agreement, including, but not
limited to, leasehold excise taxes pursuant to RCW Chapter 82.29A.
IN WITNESS WHEREOF, the parties hcreto have cxecutcd this Lease Agrecmcnt
on the 17'h day of March, 2016.
