HomeMy WebLinkAbout3200 a . �C . -r ~ ORDINANCE NO 3 2 0 0 � -� AN ORDINANCE OF THE CITY OF AUBURN, WASHINGTON, RELATING TO AND PROVIDING - FOR THE VACATION OF ALLEY RIGHT-OF-WAY, SITUATED SOUTH OF MAIN = STREET BETWEEN "A" AND "B" STREETS SOUTHEAST, SITUATE WITHIN THE —� CORPORATE LIMITS OF THE CITY OF AUBURN, WASHINGTON - WHEREAS, the City Council of the City of Auburn, have passed and adopted "' Resolution No 809, resolving that a public .hearing shall be had for the purpose z � of determining whether or not the hereinafter described alley right-of-way located south of Main Street between "A" and "B" Streets Southeast, within the corporate - limits of the City of Auburn, shall be vacated, said portion to be vacated being _, hereinafter legally described in Section 1 of this Ordinance; and WHEREAS, notice of public hearing to vacate the portion of a certain alley right-of-way located south of Main Street between "A" and "B" Streets Southeast, lying within the corporate limits of the City of Auburn, in the time and manner provided by law, giving notice that the hearing on said Resolution No 809 was held on the 15th day of Au9ust, 1977 , at 8 00 P M in the temporary Council Chambers at the Auburn School District Administration Building in the City of Auburn, Washington, no objections thereto were filed with the City Clerk or presented to the City Council at said hearing, and WHEREAS, the City Council , having deemed that the petition for vacation was proper and that no vested rights would be af#ected by the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS Section 1 That the following described portion of a certain alley right-of- way located south of Main Street between "A" and "B" Streets Southeast, within the corporate limits of the City of Auburn , Washington, and more particularly described as follows A tract of land in Lots 3, 9 and. 10 in River View Addition to Auburn,' as recorded in Volume 9 of Plats , page 90, re- cords of King County, Washington, particularly bounded as follows ------------------ Ordinance No 3200 Page One • ' s-so-��� Fdo�� i0 i2 2s �'"°" '" _ RECU�O[u RC F,Er.a��c;, Beginning at a point 116 feet south of the south line of First Street measured parallel to Main Street and 130 feet east of the east line of Main Street measured parallel to First Str.eet, said point being also on the south line of an alley; thence south 0°10'15" W parallel to Main Street a distance of 98 50 feet to the south line of Lot 10 in said River View Addition, thence south 88°24' W along the south line of said Lot 10 a distance of 14 feet, thence north 0°55" E parallel to said Main Street a distance of 98 10 feet; thence north 86°49' 10" E a distance of 14 O� feet to the place of beginning, as recorded in Volume 1100 � of Deeds, page 37 , records of King County, Washington !� be and the same is hereby vacated, and the property lying in said portion of � r•. a certain alley right-of-way described hereinabove, shall be returned and belong � �` to the abutting property owners , of said portion of a certain alley right-of-way located south of Main Street between "A" and "B" Streets Southeast, lying within the corporate limits of the City of Auburn Section 2 That the request for vacation of alley right-of-way be granted subject to a public utility easement over, across, upon and underneath the entire vacated alley for ingress and egress for the purpose of installing and maintaining all public utilit7es Section 3 Upon the passage, approval and publication of this Ordinance, the City Clerk shall cause a certified copy of this Ordinance to be recorded in the office of the King County Auditor Section 4 That this Ordinance shall take effect and be in force five (5) daysfrom and after its passage, approval and publication, as provided by law INTRODUCED SEPTEMBER 19, 1977 PASSED SEPTE�dBER 19, 1977 APPROVED SEPTEMBER 19, 1977 � !
