A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, FIXING A TIME FOR A PUBLIC HEARING ON THE PETITION
FOR VACATION OF D STREET NE LOCATED NORTH OF 23RD 6TREET NE,

WITHIN THE CITY OF AUBURN, WASHINGTON.
WHEREAS, a memorand.um from the City's Planning Director requesting
to initiate Street Vacation No. V-05-01 asking for the vacation of D Street NE,
north of 23`� Street NE, has been signed and filed with the City, and the City's
Municipal Airport is the owner of more than twq-thi�ds of the property abutting
upon fhat portion of right-of-way sought to be vacated; and
WHEREAS, RCW 35.79.010 requires the City Council to schedule a
public hearing on a petition requesting the vacation of atreet right-of-way when
the request has been filed with the City and signed by the owners of more than
two-thirds of the property abutting the proposed vacation;
NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AS FOLLOWS:
Section 1. Pursuant to RCW 35.79.010, the Ciry Council acknowledges
receipt of a request to vacate D Street NE north of 23ro Street NE; which is
attached hereto, designated Exhibit "A", and incorpora[ed by reference herein.
Section 2. The legal description of the right-of-way sought to be vacated
is describeil on attached Exhibit "B", and incorporated by reference herein.

Section 3. Pursuant to RCW 37.70.010, the C'ity Council hereby
schedules a public hearing on said petition to be held on the 1 S' day of April,
2002, at 7:30 p.m. in the Council Chambers of the Auburn City Hall before the
City Council, All persons interested in said petition may attend that hearing.
Section 4. Pursuant to RCW 35.79.020, upon passage of this
Resolution, the City Clerk shall give twenty (20) days notice of the pendency of
the petition by posting written notice in the manner required by the statute and
as required by City Ordinance.
Section 5. The Mayor is hereby authorized to implement such
administrative procedures as may be necessary to carry out the directives of
this legislation.

RE: Request to iniJiate the vaption of a public sVeet ' t ' •
It has come to my attentio,n that a strip of public right-of-way("D"SUeet NE)exists adjacent to the Aubum
Muniapal i4irport with no connection point to other public rights-of-way and is surrounded by parcels
owned by tFie Cily of Aubum, Municipal Airport, I have attached a copy of the Ass.essor's Map that
identifies the subject right-ot-way and adjaeent parcel, as well as a copy of City Resolution 1730(with
attachment),which vacated the northem portion of the same rightoi way in 1$87.
Justification for granting the vaption of t�subject right-of-way is as follows:

. The sub�ect,rigM-of-way daes not currently'have connectnnty to the existing public street network .
• The subjeot right-of-way can not exterid to ttie south witFitiut impact and reloaation of the AiipoiPs

• The future extension of the subjecc right-of-way to the north does not appear to be feasible wfthout '
acquisition of private property,and a portfon of the right-of-way has been previousty vacated,
• The prozi to 2he ai�eld and more speafically the runway make the subject right-0f-way
essenLall�able because of the potential for safety hazards and conflicts wifh Airport operations.
The continued grovvth and expansion of the airport has resulted in the.need to consolidate the adjacent
tax parcels(parcel numbers 514320-0060,0070, 0075, 0150)with the Main parcel of the Airfield(parcel,
number 00080-0009). In order to achieve the most efficient configuration,the vecation of this isolated
right-of-way is necessary.
