RESOLUTION NO. 3 3 5 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBllRN, WASHINGTON, APPROVING THE PRELIMINARY PLAT OF A 103 SINGLE FAMfLY LOTS AND ONE COMMERCIAL LOT LOCATED NORTH OF LAKE TAPPS PARKWAY AND EAST OF LAKELAND HILLS WAY WITHIN THE Cll"1' OF AUBURN, WASHINGTON. WHEREAS, Application No. PLT00-0014, dated December 22, 2000, � has been submitted to the City of Auburn, Washington, by EVERGREEN TUGCI, requesting approval of a Preliminary Pl.at far one hundred three lots for single-family homes and the remaining lot a commereial lot north of Lake Tapps Parkway and East of Lakeland Hills Way within the Cify of Auburn; and WHEREAS, said request above refe:rred to was referred to the Hearing Examiner for study and public hearing thereon; and WHEREAS, pursuant to staff review, the Hearing Examiner conducted a public hearing to consider said pefiition in the Council Chambers of the Auburn City Hall on April 17, 2001, at the conclusion of which the Hearing Examiner recommended approval of the Preliminary Plat; and WHEREAS, the City Council, on May 7, 2001 considered said request and affirmed the Hearing Examiner's recommendation for rezone based upon the following Findings of Fact and Conclusions, to=wit: FINDJNGS OF FACT Evergreen Tucci, the owners of the Lakeland South Planned Unit Development (PUD) in Pierce County, have requested preliminary plat approval for a 104 lot subdivision. One hundred three (103) of the lots are for single family homes and the remaining lot is a commercial lot. The ---------------- Resolution 3354 May 21, 2001 Page 1 I property is located within the recently annexed area of Pierce County and more specifically located on the east side of Lakeland Hills Way and north of the Lake Tapps Parkway. 2� The plat is located in fhe Lakeland South Planned Unit Development (PUD). Chapter 18.76 of the Auburn Zoning Code governs the land uses allowed within the PUD: Section 18.76.060 allows for fhe single family plat and will be governed by the "SFD-4" regulations: The "SFD-4" regulations require a minimum lot size ofi 3,375 square, a minimum lot width of 45 feet and a lot depfh of 65 feet. The plat illustrates that the minimum lot size will be 4,500 square and that the minimum lot width and depth requirements have been met as welL 3: A final development plan (map)was also adopted as part of the approved PUD. The plan illustrates the area of the p�eliminary plat�to be appropriate for residential uses, including the area proposed for the commercial lot. An amendment to the plan is being processed concurrently, and it is proposed to move a planned commercial area from the northwest portion ofthe PUD to the area proposed for the commercial lot, which is at the interseetion of Lakeland Hills Way and the Lake Tapps Parkway. 4: The Lake Tapps Parkway is a major multi-lane arterial that is currently under construction. It will eventually connect the Lake Tapps area to Highway 167. That portion of the Parkway that is befween Lakeland Hills Way and the East Valley Highway is proposed to be open for traffic sometime in 2001. 5: As part of a preannexation agreement between the City of Auburn and the owners of the Lakeland South PUD, it has been agreed that the City will issue building permits up to a point that development within the Lakeland South PUD generates 800 PM vehicle trips. To date, there have been permits issued for 258 multi-family units and 306 single family homes. This equates to approximately 469 PM vehicle trips. In order to exceed 800 PM vehicle trips, fhe annexafion agreement requires fhat the ParKway must be open between Lakeland Hills Way and the East Valley Highway. � 6. Park land is also required to be provided and dedicated to the City; A park termed "P-4'' and portions of the linear park along Lakeland Hills Way have been dedicated. Pursuant to the provisions of the annexation agreement, this allows the City to issue building permits for up to 800 residential units. Additional park land will then need to be dedicated in order to permit the 801St residential unit. Resolution 3354 MaY 21, 2001 Page 2 7. The City of Auburn will provide police protection, fire protection, sanitary sewer and storm drainage services. The City of Bonney Lake, pursuant to a previously executed agreement between the City of Auburn and the City of Bonney Lake, will provide water. The plat is within the Auburn School District and the City collects impact fees for the school district. 8. To the east of the proposed plat is a vacant parcel of property that is outside the boundary of the Lakeland South PUD. In order to facilitate adequate traffic circulation for the entire neighborhood, the proposed plat will be providing a "stub`'. street to the property to the east. When the property to the east develops, it will be allowed to use the stu6 street for one access as well as provide another public street access to the east of its property. 9. The plat illustrates a number of "tracts`'� Most of the tracts are for landscaping and signage that will be owned and maintained by the homeowners association. The linear park tracts on the west side of Lakeland Hills Way will be dedicated to the City to extend the linear parkto fihe Lake Tapps Parkway. The plat also illustrates landscaping islands within the cul-de-sacs of the plat. The City Engineer must approve these as well as the homeowner's association will need to maintain them. 10. The contents of fhe case file PLT00-0014 of this project are hereby , incorporated by reference and made part of the reeord of this hearing. . CONCLUSIONS OF LAW The undersigned has concluded that the preliminary plat may be approved in that it is consistent with the following criteria necessary to approye a prelimina.ry plat as outlined in Section 17.06.070 of the Land Division Ordinance. 1. Adequate provisions are made for the public health, safety and general welfare and for open spaces, drainage ways, streets, alleys, other public ways, water supplies, sanitary wastes, parks, playgrounds and sites for schools and school grounds. The PUD ordinance, the preannexation agreement, and compliance with the City's regulations have ensured that adequate provisions have been made regarding the above items. 2. Conformance of the proposed subdivision to the general purposes of the Comprehens:ive Plan. Resolution 3354 MaY 21,2001 Page 3 The density of the plat is less than 5 dwelling units per acre which is consistent with the moderate densify residential designation on Comprehensive Plan Map which allows for over 10 units per acre. The Commercial lot is consistent with the Plan Map which illustrates the lot as . commercial. 3. Conformance of the proposed subdivision to the general purposes of any other applicable policies or plans which have been adopted by the Cify Council. The plat is consistent with the Lakeland PUD Ordinance, the preannexation agreement, and the specific utility studies that have been done for the Lakeland project. 4. Conformance of the proposed subdivision to the general purposes of the Land Division Ordinance as enumerated in Section 17.02.030. The plat is consistent with the purpose of the Land Division Ordinance in that it promotes the effective use of land, facilitates the provision of public utilities, parks, and open space, provides for proper ingress and egress, and implements the Comprehensive Plan. 5. Conformance of the proposed subdivision to the Auburn Zoning Ordinance and any other applicable planning or engineering standards and specifications as adopted by the City. The plat has been designed in accordance with all applicable engineering requirements including the City's Design and Construction manual. 6. The potential environmental impacts of the proposed subdivision are mitigated such that the preliminary plat will not have an unacceptable a.dverse effect upon the quality of the environment. An Environmental Impact Sta.tement (EIS) was prepared for the PUD in 1992. The plat is consistent with the EIS. DECISION For each of the above reasons, the recommendation of the Hearing Examiner to the Auburn City Council on this preliminary plat application is approval. -------------- I Resolution 3354 MaY 21, 2001 Page 4 , NOW, THEREFORE, THE CITY COUNCIL QF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES TMAT: Section 1. The above cited Hearing Examiner's, Conclusions and Decision are herewith approved and incorporated in this Resolution. Section 2. The Preliminary Plat for a 104 lot subdivision, 103 of the lots are single-family lot home and the remaining lot is a commercial lot located within the annexed are of Pierce County on the east side of Lakeland Hills Way and north of the Lake Tapps Parkway, within the City of Auburn, legally described in Exhibit "A" attached hereto and incorporated herein by this reference, is hereby approved. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessa.ry to carry out the directives of this legislation. � � DATED and SIGNED this�day of May, 2001.
