AND ONE MULTI-FAMILY LOT LOCATED AT TWE WEST � SIDE OF L-AKELAND HILLS WAY AND NORTH OF 69TH STREET SE WITHIN THE CITY OF AUBURN, WASHINGTON. f WHEREAS, Application No. PLT01-00001, dated December March 16, 2001 has been submitted to the City of Auburn, Washington, by EVERGREEN TUCCI PARTNERS, requesting approval of a Preliminary Plat for seventy-six lots for single-family homes and the remaining lot a multi-family lot on the west side of Lakeland Hills Way and north of 69th Street SE within the City of Auburn; and WH€REAS, said request above referred to was referred to the Hearing Examiner for study and public hearing thereon; and r WHEREAS, pursuant to staff review, the Hearing Examiner conducted a , public hearing to consider said petition in the Council Ghambers of the Auburn City Hall on July 17, 2001, at the conclusion of which the Hearing Examiner recommended approval of the Preliminary Plat; and WHEREAS, the City Council, on August 6, 2001 considered said request ' and affirmed the Hearing Examiner's recommendation for preliminary plat based upon the following Findings of Facfi and Conclusions, to-wit: FINDINGS OF FACT 1. Evergreen Tucci, the owners of the Lakeland South Flanned Unit Development (PUD) in Pierce County, have requested preliminary plat Resolution 3382 � August 16, 2001 Page 1 approval for a 77 lot subdivision. Seventy=six (76) of the lots are for single family homes and the remaining lot is a multi-family lot. The property is - located within the recently annexed area of Pierce County and more specifically located on the west side of Lakeland Hills Way and north of 69th Street SE. 2, The plat is located in the Lakeland South Planned Unit Development (PUD). Chapter 18.76 of the Auburn Zoning Gode governs the land uses allowed within the PUD. Section 18.76.060 allows for the single family plat and will be governed by the "9FD-5" regulations. The "SFD-5" regulations require a minimum lot size of 2,730 square and a minimum lot width of 40 feet. The plat illustrates that the minimum lot size will be 6,000 square and that the minimum lot width requirements have been met as well. 3. A fir�al development plan (map) was also adopted as part of the approved PUD. The plan illustrates the area of the preliminary plat to be appropriate for residential uses at a density of two to fourteen units per acre. 4. The p'roposed plat is located north of the Lake Tapps Parkway, which is a � major multi-lane arterial that is currently under construction. It will eventually con.nect the Lake Tapps area fo Highway 167. That portion of the Parkway that is befinreen Lakeland Hills Way and the Easfi Valley Highway is proposed to be open for traffic sometime in 2001. 5; As part of a preannexation agreement between the City of Auburn and the owners of the Lakeland South FUD, it has been agreed that fhe City will issue building permi#s up to a point that development within fhe Lakeland South PUD generates 800 PM vehicle trips. To date, there have been permits issued for 258 multi-family units and 334 single family homes. This equates to approximately 500 PM vehicle trips. In order to exceed 800 PM vehicle trips, the annexation agreement requires that the ParKway must be open between Lakeland Hills Way and the East Valley Highway. 6. Park land is also required to be provided and dedicated to the City. A. park termed "P-4" and portions of the linear park along Lakeland Hills Way have been dedicated. Pursuant to the provisions of the annexation agreement, this allows the City to issue building permits for up to 800 residential units. Additional park land will then need to be dedicated in order to permit the 801St residential unit. ' 7. The City of Auburn will provide police protection, fi�e protection, sanitary sewer and storm drainage services. The City of Bonney Lake, pursuant to a previously executed agreement between the City of Auburn and the City Resolution 3382 August 16,2001 Page 2 of Bonney Lake, will provide water. The plat is within the Auburn School District and the City collects impact fees for the school district. 8; The plat illustrates a number of"tracts". Most of the tracts are for landscaping and signage that,will be owned and maintained by the homeowners association. While not labeled, there is also a tract on the east side of the plat which is the linear park that will run along the length of Lakeland Hills Way. 9. The contents of the case file, PLT01-0001, of this project are hereby incorporated by reference and made part of the record of this hearing. ` CONCLUSIONS OF LAW The undersigned has concluded that the preliminary plat may be appcoved in that it is consistent with the following criteria necessary to approve a preliminary plat as outlined in Section 17.06.070 of the Land Division Ordinance. 1. Adequate provisions are made for the public health, safety and general welfare and for open spaces, drainage ways, streets, alleys, other public ways, water supplies, sanita_ry wastes, parks, playgrounds and sites for schools and school grounds. � The PUD ordinance, the preannexation agreement, and compliance with the City's regulations have ensuced that adequate provisions have been made �regarding the above items. 2. Conformance of the proposed subdivision to the general purposes of the , Comprehensive Plan. , The density of the plat will be less than 14 dwelling units per acre which is ' consistent with the moderate density residential designation on the Comprehensive Plan Map. 3. Conformance of the proposed subdivision to the general purposes of any ; other applicable policies or plans which have been adopted by the City � Council. The plat is consistent with the Lakeland PUD Ordinanee, the preannexation agreement, and the specific utility studies that have been done for the Lakeland project. �� � Resolution 3382 August 16, 2001 Page 3 4. Conformance of the proposed subdivision to the general purposes of the Land Division Ordinance as enumerated in Section 17.02.030. The plat is eonsistent with the purpose of the Land Division Ordinance in that it promotes the effective use of land, facilitates the provision of public utilities, parks, and open space, provides for proper ingress and egress, and implements the Comprehensive Plan. 5. Conformance of the proposed subdivision to the�Auburn Zoning Ordinance and any other applicable pl.anning or enginee�ing standards and specifications as adopted by the City. The plat has been designed in accordanee with all applicable engineering requirements including the City's Design and Construction marival. 6. The potenfial environmental impacts of the proposed subdivision are mifigated sueh that the preliminary plat will not have an unacceptable adverse effect upon #he qualifiy of the environment. An Environmental Impact Statement (EIS) was prepared for the PUD in 1992. The plat is consistent with the EIS.. DECISION , For each of the above reasons, the recommendation of the Hearing Examiner to the Aubum City Counc'il on this preliminary plat application is approval, subject to the following conditions: 1. In order to provide two access points to the plat, 69th Street and that portion ' � of L'akeland Hills Loop that abuts the plat will need to be constructed. The, Gity Engineer shall determine the extent of fhe improvements needed for these finro streets as it relates to how this plat is developed. 2. A southbound to eastbound left turn pocket shall be created at the intersection of the Lakeland Hills Loop Road and the unnamed east/west street. A north bound to westbound IefC furn pocket shall be created at the � intersection of Lakeland Hills Way and the unnamed east/west street; 3. The driveways to lots 1, 31 and 32 shall aecess to the abutting north/south , street and not to the abutting east/west street, -------------- Resolution 3382 August 16, 2001 Page 4 m 4. Minor changes need to be made to provide for the proper curb radius as � well as provide assurances that the requirements for sight distance triangles have been met at the intersections. 5. The tract on the east side of the plat, that is set aside for the linear park, shall be dedicated to the City as part of the final plat approval if the tract has not previously been dedicated to the City. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, IN A REGULAR MEETING DULY ASSEMBLED, HEREWITH RESOLVES THAT: - . Section 1. The above cited Hea.ring Examiner's, Conclusions and Deeision are herewith approved and incorporated in this Resolution. Section 2. The Preliminary Plat for a 77 lot subdivision, 76 of the lots a.re single-family lot home and the remaining lot is a multi-family lot located within the annexed are of Pierce County on the west side of Lakeland Hills Way and north of 69th Street SE, within the City of Auburn 'is here6y approved. Section 3. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directives of this legislation.
