WHEREAS, Petition No. V-03-01 requesting the vacation of 12ptn Avenue SE, north of b3�d Avenue SE, has been signed and filed with the City by the owners of more than two-thirds of the property abutting upon that portion of right-of-way sought to be vacated; and 1NHEREA$, RCW 35.79.010 requires the City Council to schedule a public hearing on a petition requesting the vacation of street right-of-way when the petition has been filed with the City and signed by the owners of more than two-thirds of the property abutting the proposed vacation; � NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, A$ FOLLOWS: � Section 1. Pursuant to RCV1l 35.79.010, the City Counc'il acknowledges receipt of a petition to vacate 120th Avenue SE north of 53`d Avenue SE, which i is attached hereto, designated Exhibit "A", and 'incorporated by reference herein. Section 2. The legal description of the right-of-way sought to be vacated is described on attached Exhibit "B", and incorporated by reference herein. Pursuant to RCW 37.70,010, the City Council hereby schedule� a public hearing on said petition to be held on the 3�d day of December, 2001, at 7:30 p.m. in the Council Ghambers of the Aubum City Hall before the City Council. All persons interested in said petition may attend that hearing. Section 4. Pursuant to RCW 35.79.020, upon passage of this Resolution, the City Glerk shall give twenty (20) days notice of the pendency of the petition by posting written nofice in the manner required by the statute and as required by City Ordinance. Section 5. Attached please find a map and legal description for the street, as well as a photo of the intersection of 12Uth and 53`�. There are two property owners owning the land adjacent to the right-of-way, and I have included the signed petition and checks totaling $250.00. We understand that this is an old County road right-of-way, and it has never been used or maintained to our knowledge. We see no need for it in the future as well. T'he current right-of-way(see photo)is overgrown with vegetation, and a street vacation would allow us to fence, clean up and maintain the property with the adjacent properties.
