A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN,
WASHINGTON, REPEALING RESOLUTION NO. 3395, FIXING A TIME FOR A
I'UBLIC HEARING ON THE PETITION FOR VACATION OF 120"' AVENUE SE

WASHINGTON, AND FIXING A TIME FOR A PUBUC HEARING ON THE
PETITION FOR VACATION OF NORMAN AVENUE SE (120T" AVENUE SE),
LOCATED NORTH OF 53RD STREET SE, WITHIN THE CITY OF AUBURN, '
WASHINGTON.
WHEREAS, Petition No. V-03-01 requesting the vacation of 12ptn
Avenue SE, north of 53�tl Avenue SE, was signed and filed with the City by the I
owners of more than two-thirds of the property abutting upon that portion of
right-of-way so:ught to be vacated; and
WHEREAS, RCW 35.79.010 requires the City Couneil to sehedule a
public hearing on a petition requesting the vaeation of street right-of-way when
the petition has been filed with the City and signed by the owners of more than
two=thirds of the property abutting the proposed vacation; and
WHEREAS, Resolution No. 3395 fixed a hearing on said vacation
request for December 3, 2001; and
WHEREAS, after adoption of Resolution No� 3395 on November 5, 2001
it was discovered the addresses were stated incorrectly; and
WHEREAS, the petitioners have filed corrected documents; and
� WHEREAS, the public hearing must be rescheduled.:

NOW, THEREFORE, IT IS HEREBY RESOLVED BY THE- CITY
COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AS FOLLOWS:
Section 1. Resolution No. 3395 is hereby repealed.
Section 2. Pursuant to RCW 35.79.010, the City Council acknowledges
receipt of a revised petition No. V-03-01 to vaeate Norman Avenue SE (12ptn
Avenue SE), located north of 53`d Street SE, which is attached hereto,
designated Attachment "A'', and incorporated by reference herein.
Section 3. The legal description of the right-of-way soughfi to be vacated
is described on attaehed Exhibit "A", and incorporated by reference herein.
Section 4. Pursuant to RCW 37.70.010, the City Couneil hereby
schedules a public hearing on said petition to be held on the 7th day of Janua.ry,
2002, at 7:30 p.m. in the Council Chambers of the Auburn City Half before the
City Council. All persons interested in said petition may attend that hearing.
Section.5. Pursuant to RCW 35.79.020, upon passage of this
Resolution, the City Clerk shall give twenty (20) days notice of the pendency of
the pefition by posting written notice in the manner required by the statute and
as required by City Ordinance.
Section 6. The Mayor is hereby authorized to.implement such
administrative procedures as may be necessary to carry out the directives of
this legislation:

RE: Street Vacation Request—Norman Avenue SE (120�'Ave. SE)
Dear Ms. Wingate and Mr. Dowdy:
On behalf of the adjacent property owners, I am writing to request that the City of
Auburn vacate the street Norman Avenue SE(120�'Avenue SE), located north of
53'� Street SE between the properties at 3695 53� Street SE and 3595 53'� Street SE.
Attached please find a ma�and legal description for the street, as well as a photo
of the intersection of 120 and 53�.
There aze two groperty owners owning the land adjacent to the right-of-way, and I i�ave
included the signed petition and checks totaling $250.U0.
We understand that this is an old County road right-of-way, and it has never been used or
maintained to our knowledge. We see no need for it in the future as well. The current
right-of-way(see photo) is overgrown with vegetation, and a street.vacation would a11ow
us to fenee, clean up and maintain the property with the adjacent properties. We are
requesting that the street be vacated and the land returned to our adjacent pazcels.
