Background Summary: Resolution No. 2016-01 authorizes the Transportation Benefit District to impose a $20.00 vehicle license fee pursuant to RCW 82.80.140. The Board previously approved Resolution 2016-01 on December 13, 2016 and on February 22, 2017 the Board took further action to postpone Resolution 2016-01 for 120 days. The 120 day time period expires on June 22, 2017. The purpose of this item is for the Board to determine the next steps for Resolution 2016-01 as follows: Option 1: Continue to postpone the resolution for an additional duration as determined by the Board. This would require that the Board convene an additional meeting prior to the expiration, similar to this special meeting. Option 2: Postpone the resolution indefinitely. Option 3: Take action on the resolution. The Auburn City Council has convened an Ad Hoc Committee to review the $20.00 Car Tabs, this action by the Board would not affect the Ad Hoc Committee. AUBURN TRANSPORTATION BENEFIT DISTRICT APPROVING A $20.00 VEHICLE LICENSE FEE PURSUANT TO RCW 36.73.065 WHEREAS, the City of Auburn established a transportation benefit district pursuant to adoption of Ordinance No. 6377 on September 19, 2011 as authorized by RCW 35.21.225 and subject to the provisions of RCW 36.73; and WHEREAS, RCW 36.73.065 authorizes a transportation benefit district to impose by majority vote of the district's governing board, up to a $20.00 vehicle license fee authorized in RCW 82.80.140; and, WHEREAS, in accordance with RCW 82.80.140, the new vehicle license fee may not be collected until six (6) months after approval of this action by the governing board; and, WHEREAS, the Board of the Auburn Transportation Benefit District finds it to be in the best interest of the District to establish an annual vehicle license fee in the amount of $20.00 for the purpose of preserving, maintaining, operating, constructing or reconstructing the transportation infrastructure of the City of Auburn and funding transportation improvements that are consistent with existing state, regional or local transportation plans necessitated by existing or reasonably foreseeable congestion levels. NOW, THEREFORE, THE BOARD OF THE AUBURN TRANSPORTATION BENEFIT DISTRICT DOES HEREBY RESOLVE AS FOLLOWS: Section 1. An annual vehicle license fee in the amount of $20.00 is hereby established consistent with RCW 36.73.065(4)(a)(i) to be collected by the Washington State Department of Licensing on qualifying vehicles as set forth in RCW 82.80.140 and Chapters 36.73 and 46.16 RCW. Section 2. The annual vehicle license fee shall take effect for notices mailed in 2017 for vehicle license renewals due as soon thereafter as the Washington State Department of Licensing is reasonably able to incorporate collection of the $20.00 fee. Vehicle license fees shall not be collected sooner than six (6) months after approval as provided in RCW 82.80.140(4). Resolution No. 2016-01 December 13, 2016 Page 1RES.B Page 4 of 13 Section 3. The revenues received from the $20.00 vehicle license fee shall only be expended on transportation projects approved by the Board for the District. The transportation projects to be funded with the revenues from the vehicle license fee shall be established by separate resolution of the Board of District. Section 4. The Board of the District may by separate Resolution terminate the collection of the $20.00 vehicle license fee if an alternate funding source authorized by Washington State statute is approved by the Board or by the City Council of the City of Auburn. Section 5. This Resolution shall be in full force and effect upon passage and signatures hereon. CALL TO ORDER A. Roll Call Board Chairperson Nancy Backus called the special meeting to order at 2:14 p.m. Board Members present: Bob Baggett, Claude DaCorsi, John Holman, Bill Peloza, Yolanda Trout-Manuel, and Largo Wales. Board Member Rich Wagner was excused. City of Auburn department directors and staff members present: Finance Director Shelley Coleman, City Attorney Daniel B. Heid, Community Development and Public Works Director Kevin Snyder, Assistant Director of Engineering Services/City Engineer Ingrid Gaub, Transportation Manager Pablo Para, Assistant Director of Public Works Randy Bailey, Traffic Engineer James W ebb, Human Services Program Coordinator Emily Pearson, and City Clerk Danielle Daskam. II. CONSENT AGENDA A. Minutes of the December 13, 2016 Meeting Board Member DaCorsi moved and Board Member Holman seconded to approve the December 13, 2016 minutes. MOTION CARRIED UNANIMOUSLY. 6-0 III. AGENDA MODIFICATIONS An additional item was added to the agenda and published more than twenty-fours prior to the meeting. NEW BUSINESS A. Other Items Related to Auburn Transportation Benefit District Board Resolution No. 2016-01 Board Member Peloza moved to reconsider Resolution No. 2016- 01 approved at the last meeting of the Transportation Benefit District Board meeting, and which approved a $20.00 vehicle license fee pursuant to RCW 36.73.065. Motion was seconded by Board Member Trout-Manuel. Board Member Peloza stated his motion for reconsideration was prompted by the increase in taxation to Auburn residents from Sound Transit 3 (ST3). Board Member Wales expressed support for reconsideration of Resolution No. 2016-01 in light of the impact of ST3 on license tabs. Board Member Wales also noted the recently approved school levies that will represent a significant tax burden on residents. Board Chairperson Backus stated the current City position on construction sales tax is to dedicate the funds to local neighborhood roads only. The $20.00 license tab fees can only go towards arterial streets and in some cases collector roads. Board Member Holman spoke regarding the number of calls and contacts he has received regarding the condition of the arterials and their need for repair. Board Member Holman also stated that many proposed grant-funded projects rely on matching funds that would come from the car tab fees. MOTION PASSED. 4-2 Board Members Baggett and Holman voted no. Board Member Holman questioned from where the matching funds for the $3.5 million project to reconstruct B Street NW will come without the $20.00 license tab fee. Board Member Peloza recommended the Auburn City Council create an ad hoc committee of three to review the priorities of public works capital projects to see if there is room for movement, or the Auburn City Council create another ad hoc committee of RES.B Page 8 of 13 Auburn Transportation Benefit District Board Meeting February 22, 2017 Page 3 three to review the human services programs that are not Community Development Block Grant (CDBG) for possible revenue sources. Board Member Holman expressed concern with Board Member Peloza's proposals. He stated road condition grading and prioritization should be done by the professionals and staff. Board Member Holman expressed concern with the City potentially using human services funding for roads. Board Member Holman also expressed concern with the proposal that the City conduct the review of projects and funding in an ad hoc committee of three format where the public is not invited to attend. Board Member Wales stated the projected $800,000.00 generated from car tabs might be a high estimate. Board Member Wales stated she understands the funds will be used for patching pot holes and provide matching funds for state and federal grants. She spoke in favor of postponing the resolution and of a City Council ad hoc committee to work with the City’s Finance Director to review available options. Board Member Peloza spoke in favor of a City Council ad hoc committee and stated the number of pot holes in Auburn is overstated. Board Member DaCorsi spoke regarding the impact of the cost of the ST3 and the need to find a source of revenue for arterial streets. Board Member DaCorsi spoke in support of recommending a Council ad hoc committee to review funding options and postponing the current resolution. Board Member Wales spoke in favor of postponing the resolution and recommending the City Council create an ad hoc committee to study the issue including how much is needed for matching funds and pot hole repairs. Board Member Holman moved to postpone Resolution No. 2016- 01 for 120 days and schedule a special Board meeting at that time. Board Member DaCorsi seconded. Board Member DaCorsi spoke in favor of the motion. Board Chairperson Backus asked how the postponement of Resolution No. 2016-1 affects scheduled projects. RES.B Page 9 of 13 Auburn Transportation Benefit District Board Meeting February 22, 2017 Page 4 City of Auburn Community Development and Public Works Director Snyder stated the funding for City of Auburn Project No. CP1520 B Street NW (49th Street NW to South 277th Street) Reconstruction will likely be impacted. A budget assumption was made that funding would be available by action of the Transportation Benefit District. MOTION PASSED. 6-0 V. ORDINANCES A. Ordinance No. 2017-01 An Ordinance of the Auburn Transportation Benefit District adopting a budget for the year 2017 This item was postponed due to the postponement of Resolution No. 2016-01 (above). VI. RESOLUTIONS A. Resolution No. 2017-01 A Resolution of the Auburn Transportation Benefit District approving an Interlocal Agreement between the Auburn Transportation Benefit District and the State of Washington Department of Licensing This item was postponed due to the postponement of Resolution No. 2016-01 (above). B. Resolution No. 2017-02 A Resolution of the Auburn Transportation Benefit District approving certain Transportation Projects to be funded This item was postponed due to the postponement of Resolution No. 2016-01 (above). C. Resolution No. 2017-03 A Resolution of the Auburn Transportation Benefit District, Auburn, Washington, approving a Material Change Policy This item was postponed due to the postponement of Resolution No. 2016-01 (above). Resolution No. 2017-04 A Resolution of the Auburn Transportation Benefit District adopting the 2016 Annual Report Director Snyder advised the Board is statutorily required to adopt an annual report indicating the status of transportation improvement costs, transportation improvement expenditures, revenues and construction schedules. Board Member Wales moved and Board Member Baggett seconded to adopt Resolution No. 2017-04. MOTION CARRIED UNANIMOUSLY. 6-0 E. Resolution No. 2017-05 A Resolution of the Auburn Transportation Benefit District approving a Memorandum of Understanding with the City of Auburn regarding a 0.2 Percent Sales and Use Tax Director Snyder stated the Transportation Benefit District Board previously discussed the potential for engaging in a substantive public education effort with the City of Auburn to provide voters within the District factual and relevant information for a public vote on a 0.2 percent sales and use tax to fund significant transportation improvements projects within the District. Board Member DaCorsi moved and Board Member Trout-Manuel seconded to adopt Resolution No. 2017-05. MOTION CARRIED UNANIMOUSLY. 6-0 VII.
