WHEREAS, Application No. CUP0003-99 dated April 22, 1999, has been submitted to the City of Auburn, Washington, by Valley Cities Counseling & Consultation for a Conditional Use Permit to allow for a professional office in the R-4, (Multi-Family), located at 2704 "I" Street NE, within the City of Auburn, Washington, hereinafter described below and as identified on Exhi_bi# `'A" attached hereto and incorporated in this Ordinanee by fhis reference; and � WHEREAS, said request above referenced was referred to the Heari.ng Examiner for study and public hearing thereon; and WHEREAS, the Hearing Examiner, based upon staff review, held a public hearing to consider said petifion in the Council Chambers of the Auburn City Hall, on August 17, 1999, at the conclusion of which the Hearing Examiner recommended the approval of the issuance of a Conditional Use Permit to allow a professional office on property zoned R-4 (Multi-Family) located at 2704 "I" St�eet NE, within the City of Auburn, Washington; and Ordinance 5285 September9, 1999 � Page 1 1'�991015001 tr93 � PAGE 002 OF 010 10i15i1999 13:53 KIHG COUNTti', WA PACIFIC NW TIT MISC 17.00 WHEREAS, the City Council, on September 9, 1999, considered said request and affirmed the Hearing E.xaminer's decision for the issuance of a Conditional Use Permit to allow a professional office on property zoned R-4 (Multi Family) located at 2704 "I" Street NE, within the City of Aubum, Washington, based upon the following Findings of Fact and Conclusions of Law and Decision, to-wit° FINDINGS QF FACT 1. The applicant; Valley Ci#ies Counseling and Consultation, have requested a conditional use pecmit that would allow them to construct an administrative office building to be located at 2704 `"I'' Street NE. The property is zoned R-4, multi-family. The R-4 zone at Seetion 18.18.030(H) of the Zoning Code does allow for professional offices if a conditional use permit is issued. 2. Valley Cities has been operating at this location for a number of years. They have recently purchased a portion of#he adjoining property to the south. It is Valley Cities intent to remove the existing 5,715 square foot building on the site and replace it with a finro-story 24,912 square foot facility. The existing lot size is 47,595 square feet and the additional lot is 15,616 square: 3. Valley Cities provides counseling and consultation to the general public. The proposed facility will also provide administrative offices and meeting rooms. 4. The new facility would allow Valley Cities to consolidate their services'in one facility. They currently provide some of their services in a building that is on the west side of"I" Street NE, which is directly across the street from the proposal. The proposal abuts "I'' Street Northeast, which is a designated arterial.� The property to the west is zoned C-3, Heavy Commercial, to the north, south and east is property zoned R=4. 6. The site plan submitted with the application is generally consistent with the requirements of the Zoning Code with two possible exceptions. The site plan indicates the "ridge height" of.the building is to be 38.5 feet. The maximum height in the R-4 zone is 30 feet. The site plan also illustrates a storm drainage facility to be located within the front yard setback of the property. A 6-foot fence is illustrated to surround the storm drainage area. The Zoning Code does not allow a six foot high fence within the front yard setback. 7. The contents of the case file, CUP0003-99, and the environmental file, SEP0016-99, of this project are hereby incorporated by reference and � made part of#he record ofi this hearing. CONCLUSIONS QF LAW The conditional use permit may be approved in that it is consistent with the following criteria necessary to grant the permit as outlined in Section 18.64.040 of the Zoning Ordinance. 1. The use wi.11 have no more adverse effect on.the health, safety or comfort of persons living or working in the area, and will be no more injurious, economically or otherwise, to property or improv_ements in the surrounding area, than would any use generally permitted in the district. Valley Cities has been operating at this location for a number of years without causing any apparent adverse effects upon the surrounding area. The construction of a new building and the consolidation of services into one faeility should not eause any new adverse effects upon the neighborhood. 2. The proposal is in accordance witfi the goals, policies and objectives of the Comprehensive Plan, Ordinance 5285 September 9, 1999 Page 3 199'�1015001�?93 PAGE 004 �F 010 18i15i1999 13:53 PACIFIC NW TIT MISC 17.00 KIhG COUIVTti', WA The Comprehensive Plan map illustrates the area as high=density residential. On page 14-6 of the Comprehensive Plan it states that professional offices are a permissible use in the multi-family areas if a conditional use permit is issued. 3. The proposal complies with all requirements of the Zoning Ord:inance: The proposal seems to comply with the requirements of the Zoning Code with a couple of exceptions. There might be an issue with the height of the . buildi_ng and with the location of a fence. 4. The proposal can be constructed and maintained so as to be harrimonious and appropriate in design, charaeter, and appearance with the existing or intended character of the general vicinity. The application indicates the proposed building will take into consideration the adjoining uses. A condition of the environmental review also requires the Planning Director approve the design of the building in o�der#o ensure that it will be consistent with the adjoining residential uses. 5. The proposal will not adversely affect the public infrastructure. There is no indication the public infrastructure will be affected. DECISION For each of the above reasons, fhe recommendation of the Hearing Examiner to the Aubucn City Council on this conditional use permit application is approval, subject to the following conditions: ; 1. The height of the building is to be no highe�than 30 feet as determined by the definition of building height as found in Section 18.04:200 of the Zoning Code. 2. The storm drainage facility shall be designed to preclude the need for fencing. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN AS FOLLOWS Section 1.. Purpose. The above cited Hearing Examiner's Findings of Fa.ct and Conclusions of Law and Decision, are herewith incorporated in. this Ordinance: Section 2. A Conditional Use Permit is hereby approved to allow for a professional office on property zoned R-4 (Multi-Family) located at 2704 "I'' Street NE and identified on Exhibit "A" attached hereto and incorporated in this Ordinance by this reference in the City of Auburn, County of King, State of Washington. Section 3. Severabilitv. The provisions of this ordinance are decla�ed to be separate and severable. Section 4.
