5. Residential uses are to the west and south. To the north across the ailey is
a. commercial use that is zoned C-1 Light Commercial. To the east is a
vacant office/commercial building.
6. At the time of the public hearing, a number of concerned citizens
expressed concern regarding the proposed conditional use permit.
Specifically, one citizen felt as though neighborhoods are generally "under
attack" in the City of Auburn and indicated the subject neighborhood is one
of the last few single fami.l.y residential low income neighborhoods in the
City. In fact, the neighbor indicated a recent "bidding war" over a home in
the subject neighborhood because it was priced under$101,000. The
applicant indicated the services wfiich he provides, counseling for drug and
alcohol addiction, is in fact a community service: The residents requested
limitations on the hours of operation. Limitations on the hours of operation
of the use was appro�ed. The staff report, with its recommendation of
conditional approval, is incorporated herein by refe�ence as though set
forth in full.

incorporated by reference and made part of the record of this hearing. �
GONCLUSIONS OF LAW
The conditional use permit may be approved in that it is consistent with the
following criteria necessary to grant the permit as outlined in Section 18.64..040
of the Zoning Ordinance.
1. The use will have no more adverse effect on the health, safety or comfort of
persons living or working in the area, and will be no more injurious,
economically or otherwise, to p�operty or improvements in the surrounding.

The proposed office is relatively small as well as it will retain its single-family
appearance. Since the lot is 9,000 square feet in area, the R-4 zone could
allow for up to 3 apartment units if all other requirements are met.

Therefore, it is not apparent that any adverse effects will occur to the
neighborhood if the permit is properly conditioned.
2. The proposal is in accordance with the goals, policies and objectives of the
Comprehensive Plan.
The Comprehensive Plan map illustrates the area as high-density
residential: On page 14-6 of the Comprehensive Plan it states that
professional offices are a permissible use in the multi-family areas if a
conditional use permit is issued.
3. The proposal complies with all requirements of the Zoning Ordinance.
The application indicates that the proposal either meets or is capable of
meeting all the requirements of the Zoning Ordinance.
4. The proposal can be constructed and maintained so as to be harmonious
and appropriate in design, character, and appearance with the existing or
intended character of the general vicinity.
The exterior appearance of the single family home will be largely retained so
it will be consistent with the adjoining residential uses as well as be
compatible with the adjoining commercial use.
5. The proposal will not adversely affect the public infrastructure.
There is no indication that the public infrastructure will be impacted.
DECISIQN.
For each of the above reasons, the recommendafion of the Hearing Examiner
to the Au_burn City Council on this conditional use permit application is
approval, subject to the following conditions:
1. There shall be a total of 5 parking spaces provided in the rear yard of the
propeity. The applicant shall provide a revised site plan that illustrates the 5
packing spaces. The plan shall be approved by the Planning Director prior

to the issuance of any building permits for the project:: Parking directional
signs sha.11 also be provided that direct clients to the parking in the rear of
the property. The type, size and location of the directional signs to be
approved by the Planning Director.
2. Any parking area or driveway that abuts other residential zoned property
shall have a five-foot width of Type I landscaping between the parking
area/driveway and the adjoining residential property. If the adjoining
property owners desire a fence, it shall be a 6-foot high wooden fence that
meets applicable setback requirements of the zone.
3. Due to the limitation of parking, there shall be no on site counseling with
groups that are larger than three.
4. Hours of operation shall be from 9:00 a.m. to 8:00 p.m.
5. The applicant shall not provide counseling services to any person convicted
of a felony involving a dangerous weapon and/or counseling services for
registered sex offenders. Counseling services for this clientele shall not be
provided at this location.
For each of the above referenced reasons, the recommendation of the
Hearing Examiner to the Auburn City Council on this Conditional Use Permit to
allow for a professional office on property zoned R-4 (Multi-Family) located at
17 ``E'',Street SW, within fhe City of Auburn, Washington, is approved.

WASHINGTON, DO ORDAIN AS FOLLOWS

Section 1. Purpose. The above cited Hearing Examiner's Findings of
Fact and Conclusions of Law and Decision, are herewith incorporated in this
Ordinance:
Section 2. A Conditional Use permit is hereby approved to allow for a
professional office in the R-4, (Multi-Family) property located at 17 "E" Street
SW, within the City of Auburn, Washington, and identified on Exhibit "A"
attached hereto and incorporated in this Ordinance by this reference.
Section 3. Severabilitv. The provisions of this ordinanCe are
declared to be separate and severable. The invalidity of,any clause, sentence,
paragraph, subdivision, section or portion of this ordinance, or the invalidity of
the application thereof to any person or circumstance shall not affect the validity
of the remainder of this ordinance, or the valid.ity of its applicafion to other
persons or circumstances.
Section 4. Upon the passage, approval and publication of this
Ordinance as provided by law, the City Clerk of the City of Aubucn shall cause
this Ordinance to be recorded in the office of the King County Auditor, Diyision
of Records and Elections.

Section 5. lmplementation. The Mayor is hereby autho�ized to
implement such administrative procedures as may be necessary to carry out
the directions of this legislation.
Section 6. Effective Date. This Ordinance shall take effect and be in
force five (5) days from and after its passage, approval and publication as
provided by law.
