HomeMy WebLinkAboutMOU with COA and Auburn Police Guild MEMORANDUM OF UNDERSTANDING By and Between CITY OF AUBURN And THE AUBURN POLICE GUILD The City of Auburn (City) and the Auburn Police Guild (Guild) are parties to the 2016-2018 collective bargaining agreement(CBA). Due to the rapid response needed by the Collision Investigation Officer (Officer) assignment, both parties agree that the Officer is allowed to take home a vehicle outside the employee's regular scheduled hours. This agreement shall be on a temporary trial basis, effective August 1, 2018, through December 31, 2018. If the Chief, or designee, does not object, the permission to take home the vehicle may continue without the need for a new Memorandum of Understanding (MOU). Furthermore, the City is not required to backfill an assigned Collision Investigation vehicle in the event that the vehicle is out of service due to maintenance or repairs. The Officer shall maintain the assigned vehicle in accordance to the standards and policies set forth by the City regarding the use of City-owned vehicles. The Police Chief, or designee, reserves the right to discontinue the permission to take the assigned Collision Investigation vehicle home at any time. The Guild shall not file a grievance if the Police Chief, or designee, discontinues the take home permission for a Collision Investigation Officer. The Police Chief, or designee, may change the Officer's permission to take home the assigned Collision Investigation Vehicle with seven (7)days notice. If the Officer is scheduled to be out of work for longer than one workweek, he/she may be required to bring back the take-home vehicle for the duration of the Officer's time away from work. For an Officer given a take-home vehicle, the maximum allowable commuting distance is 25 miles. This driving distance will be calculated from the Officer's primary residential residence to the City limits of Auburn. An Officer commuting in a City-owned vehicle must notify the Chiefs office, via the chain of command, when changing residences. This notification will include an updated mileage calculation. Vehicles shall only be used for work-related purposes and shall not be used for personal errands or transports, unless special circumstances exist and the Chief, or designee, gives authorization. A non- employee of the City shall not ride as a passenger in the take-home vehicle without prior approval from the Chief, or designee. If there is a questionable use of the vehicle, the Officer shall discuss this usage with their immediate supervisor. The Officer should be prepared to justify all vehicle usage. Further, the Officer shall not leave weapons and/or specialized equipment in the vehicle overnight. This MOU shall be non-precedent setting. Except as expressly amended herein, all other provisions of the January 1, 2016, through December 31, 2018, collective bargaining agreement between the City of Auburn and the Auburn Police Guild remain in full force and effect.
