THIS AGREEMENT is entered into this2i--day of -3-V -1 , 2018, by and between the City of
Auburn, its agents, employees and assigns (hereinafter referred to as the "City") and Robert Lee, his heirs and
assigns.
The Sig Sauer P226 Serial #U430948, having been removed from service, may be purchased by, Robert
Lee, for the sum of 300 hundred dollars and no/100 ($300.00). Robert Lee seeks to purchase the said Sig Sauer
under the terms of this Agreement and the City seeks to relieve itself of ownership of Sig Sauer and any potential
exposure to additional costs and/or other issues that may arise in the future.
Robert Lee acknowledges and agrees that the City has no basis upon which to render any warranty or
guarantee regarding function or capacity of the said Sig Sauer and accordingly the city offers no warrant or
guarantee and disclaims any warranty in law or equity that might otherwise accompany a sale. Robert Lee
voluntarily accepts these conditions and disclaimers.
For sufficient consideration, including Robert Lee's payment under the terms of this Agreement and the
City's agreement to sell the Sig Sauer in lieu of other means of disposal and for other consideration as set forth in
this agreement, Robert Lee agrees to release, acquit and forever discharge the City of and from any and all
actions, claims, demands, claims for attorney's fees or other claims of any variety on account of or in any way
arising out of Robert Lee's ownership of the Sig Sauer. Robert Lee specifically acknowledges that the sale of the
said Sig Sauer is "as is" that the City has not agreed to provide any further care, parts or repair for the said Sig
Sauer as a condition of sale, and agrees that he will not make any claim against the City after the sale for
anything associated with the said Sig Sauer or other needs or conditions, whether those needs and conditions
occurred prior to or after this sale.
Robert Lee agrees that the said Sig Sauer is solely his property and that he bears full responsibility for
the Sig Sauer's care, safety and actions from the time of purchase forward.
By signing this Agreement, Robert Lee acknowledges that he has executed this Agreement of his own
free will and is a voluntary act.

NOTICE OF CONSENT ''
Issued Pursuant to RCW Chapter 10.93
Washington Mutual Aid Peace Officers Powers Act
The Washington Mutual Aid Peace Officers Powers Act was enacted in 1985. RCW 10.93.070
empowers general authority law enforcement officers with appropriate training certificates (or
exception there from) to enforce criminal or traffic laws any place in the state "upon the prior
written consent of the sheriff or chief of police in whose primary territorial jurisdiction the exercise
of the posers occurs."
In accordance with RCW 10.93.070 (1), I hereby consent to the full exercise of peace powers,
within the City of Auburn, Washington, by any and all properly certified or exempted police
officers of the agencies designated in this agency's current "List of Agencies Authorized to
Exercise Peace Officer Powers." The current list of Authorized Agencies may be modified from
time to time to add or delete agencies. This agency shall maintain a current list of Authorized
Agencies on file with this Notice of Consent. Any liability or claim of liability that arises out of
the exercise or alleged exercise of authority by any officer of the authorized agency under Chapter
89 Laws of the 1985 and RCW Chapter 10.93 and pursuant to this Notice of Consent is the
responsibility of that agency unless the liability is otherwise allocated under a written agreement
between the authorized agency and another agency.
This consent is valid during my tenure as Chief of the Auburn Police Department and thereafter
until revoked. This consent is not intended to reallocate, under RCW 10.93.040, the
responsibilities of the listed agencies for the acts or omissions of its officers. The authorized
agencies are subject to any reasonable reporting requirements,now in effect(RCW 10.93.030) or
hereafter imposed by this agency.
