Main Auburn, WA 98001 1 w;. 2 RESOLUTION NO. 2 6 0 5 G \ 3 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AUBURN, STATE 4 OF WASHINGTON, DECLARING THE AUTHORIZATION TO TRADE A CITY OWNED PARCEL OF LAND, TAX PARCEL NO.. 173580-0135 AS LEGALLY 5• DESCRIBED (SEE EXHIBIT "A" ATTACHED HERETO AND INCORPORATED HEREIN) , FOR A LIKE PRIVATELY OWNED PARCEL OF LAND, TAX PARCEL 6 NO. 173580-0065 AS LEGALLY DESCRIBED (SEE EXHIBIT "A" ATTACHED HERETO AND INCORPORATED HEREIN) PLUS A PAYMENT IN THE AMOUNT cc) OF $22, 010. 00 AGREED PER THE PURCHASE AND SALE AGREEMENT 7 BETWEEN THE CITY OF AUBURN AND JAMES L. CARPENTER AND IRIS L. CARPENTER DATED DECEMBER 13, 1994 FOR RESOLUTION OF A 8 9 CONDEMNATION MATTER IN KING COUNTY SUPERIOR COURT. WHEREAS, the City Council of the City of Auburn approved 10 Project No. 505 (TIB No. 8-1-105 (24) ) , Street Improvement 11 Project along Auburn Way North from 4th Street NE to 15th 12 Street NE; and 13 WHEREAS, it has been determined that in order to rcy 14 construct the designed improvements it will be necessary to 15 acquire tax parcel no. 173580-0065 through a negotiated trade 16 settlement agreement; and Ul i7 WHEREAS, the current owner of tax parcel No. 173580=0065 i8 Carpenter rejected the initial offer to convey that certain 19 portion of their property to the City of Auburn required for 20 construction; and 21 WHEREAS, a condemnation action was filed under King 22 County Cause No. 94-2-263137 , for a portion of Tax Parcel No. 23 173580-0065; and 24 25 26 Resolution No.2605 January 19, 1995r:; -°?i POT.- -OS= Page 1 �. , ._ ] _ ti ,;:,,:,s-:1 „ ... .,_ .. • • • 1 2 WHEREAS, the parties negotiated a trade for a like parcel 3 of land owned by the City of Auburn, tax parcel No. 173580- 4 0135 and payment in the amount Of $22, 010. 00; and 5 WHEREAS, the current owner of Tax Parcel No. 173580-0065, 6 Carpenter, has the first right of refusal for subsequent 7 offers, on the remainder of Tax Parcel No. 173580-0065; and 8 WHEREAS, the City may retain the remainder of tax parcel 9 No. 173580-0065 as surplus property with options to sell 10 remainder of Tax Parcel No. 173580-0065 in which case 11 Carpenter has right of first refusal; and 12 WHEREAS, the City previously acquired the trade property cd� 13 tax parcel No. 173580-0135 with Deed Recording. No. 9303031617 14 dated February 12, 1993 , for future roadway widening purposes 0 15 along Auburn Way North, which property is in excess of City 16 needs; and 17 WHEREAS, the City will retain a certain portion of the 18 city owned trade property to Carpenter, tax parcel No. 173.580- 19 0135, necessary for future roadway widening improvements along 20 Auburn Way North. That certain portion to be retained is 21 described within the legal description for the trade property 22 to Carpenter, tax parcel No. 173580-0135 (See Exhibit "A" 23 attached hereto and incorporated herein) ; and 24 25 26 Resolution No.2605 January 19, 1995 Page 2 1 2 WHEREAS, the City Engineer has, approved in concept, a 3 parking lot layout for the trade property Tax Parcel No. 4 173580-0135. (See EXHIBIT "B" attached hereto and incorporated 5 herein) . This layout is part of the negotiated trade 6 settlement agreement with Carpenter; and 7 WHEREAS, Exhibit "C" attached hereto and incorporated 8 herein depicts that portion of the City owned property to be 9 conveyed to Carpenter (Tax Parcel No. 173580-0135) and the 10 Carpenter property to be conveyed to City (Tax Parcel No. 11 173580-0065) . NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, 12 CV 13 WASHINGTON, DO HEREBY RESOLVES AS FOLLOWS: "n 14 SECTION 1. A trade of Auburn real estate, Tax Parcel No. 15 173580-0135 is authorized in exchange for the conveyance to 16 Auburn of real estate Tax Parcel No. 173580-0065 from James L. 17 Carpenter and Iris L. Carpenter free and clear of all 18 encumbrances, plus Auburn to pay to Carpenter $22,010. 00 in 19 exchange for settlement of condemnation. 20 , SECTION 2.
