I. RECITALS
• Police officers with the Auburn Police Department(APD)use the City's firearms range to
comply with APD firearms qualifications and certification policies;
• The U.S. Department of Homeland Security Federal Protective Service(FPS)uses a separate
firearms range similar purposes,but the range it normally uses is closed due to COVID-19
concerns;
• The FPS has offered assistance to the APD in the past,and the APD wishes to reciprocate;
• The FPS needs to access a firearms range on May 19,May 27,June 9,and June 24,2020;
• To facilitate the APD's work as an Essential Business Service in paragraph (1)(b)of the
Governor's Proclamation 20-25 and corresponding Appendix,the City's firearms range is
available for official law enforcement use during those proposed dates;
II.HOLD HARMLESS AGREEMENT
Based on the above recitals,APD and FPS agree as follows:
In using the APD firearms range as referenced above,the FPS and its participating officers agree to
defend, indemnify and hold APD,the City of Auburn and their agents and employees harmless from any and
all claims,actions,suits, liability,loss,costs,expenses,and damages of any nature whatsoever,by any
reason of or arising out of any negligent act or omission by any APD officers,agents,employees,or any of
them relating to or arising out of the performance of this agreement. If a final judgment is rendered against
APD or the City of Auburn, its officers,agents,employees,and/or any of them,or jointly against the City of
Auburn and PPD and their respective officers,agents,and employees,or any of them, FPS shall satisfy the
same.
This hold harmless provision shall specifically extend to(but shall not be limited to)any claims of
injury by FPS officers,and reimbursement or subrogation claims by the Washington State Department of
Labor and Industries,the U.S. Department of Labor(Division of Federal Employees' Compensation),or any
equivalent industrial insurance provider,and any claims by any third parties against the FPS arising out of
any act or omission related to its use of the APD firearms range.
