Agreement for Services
is agreement is made by and between the King County District Court Auburn, hereinafter referred as "City" and
ion Security Service, Inc, hereinafter referred as "Contractor".
consideration of the terms and conditions contained herein the parties covenant and agree as follows:
Work to be performed The Contractor shall setup the Court ordered participant on the equipment as
ordered by the Court of Jurisdiction. All services provided will be performed in conformance with
applicable City and State standards, regulations and laws.
The equipment is listed below:
SCRAM - Continuous Alcohol Monitoring,
SCRAMx - Continuous Alcohol Monitoring with an RF House Arrest Component.
SCRAM and SCRAMx have wireless systems available for an additional fee.
Remote Breath — point in time testing with facial recognition.
EHM/GPS Monitoring — point in time tracking of individuals.
EHM/GPS with Exclusion Zones - point in time tracking of the individual and zones set up for a "Victim"
or area that the individual has been restricted from entering. If the individual wearing the bracelet breaches
the zone, staff will be notified and follow proper protocol, as directed by the Court of Jurisdiction.
2. Referral Process The Court of Jurisdiction will email the Court Order to ghm@moonsecuriW.com or fax
the order to the appropriate office listed on this document. Please note on the referral if the participant is
designated a "City Pay" participant or a "Self Pay" participant.
3. Reporting Process Moon Security will report any and all information to the Court of Jurisdiction in regards
to Compliance or Non -Compliance issues and will provide detailed violation reports that include the type
of violation and system generated reports specific to that individual being monitored. Moon Security will
send a notice of enrollment and completion to the Court via fax or email.
4. "st/Stolen/Absconded Equipment Moon Security will be responsible for ensuring that each program
participant executes the participant agreement form where they accept financial responsibility for all lost,
stolen, damaged or absconded equipment while on the specified program. If the participant does not
comply with the participant agreement and executes one of the aforementioned acts, Moon Security asks
the Court of Jurisdiction to assist in the filing of criminal theft of services charges as defined in RCW
9A.56.040 or 9A.56.050.
5. Pricing The pricing below is the current prices for the participants under this Court of Jurisdiction.
Scram $8.00 per day with wireless / Ethernet device $10.00 per day
Scramx $12.00 per day with wireless / Ethernet device $12.00 per day
GPS $10.00 per day with Exclusion Zones $12.00 per day
Remote Breath $ 8.00 per day
Set Up Fee $50.00 plus tax
6. Payment The City of Auburn agrees to pay the Contractor for services provided as set forth on the attached
fee and cost schedule. Payment can be in the form of check or by credit card. All credit card payments
will include a 3% convenience fee.
An invoice to the City of Auburn will be submitted by email on the Igo business day of every month, for
the month previous, with the number of monitored days used in that month and the rate charged. Invoices
shall be paid within thirty (30) days of the receipt of invoice. A 1.5% late fee will be added after 45 days.

8. IDEMNIFICATION/NO WARRANTIES
Each party shall indemnify and hold the. other, it's officers, employees, agents and volunteers harmless
from and against any and all claims, demands, orders, decrees or judgments for injuries, death or damage
to any person or property arising or resulting from any act or omission on the part of said party or its
officers, agents, employees or volunteers in the performance of this agreement.
It is further specifically and expressly understood that the indemnification provided herein constitutes the
parties waiver of immunity under Industrial Insurance, Title 51 RCW, solely for the purpose of this
indemnification. This waiver has been mutually negotiated by the parties.
The provisions of this section will continue to be enforced even after the term of this service agreement has
expired.
9. ATTORNEY FEES In the event that either of the parties default on the performance of any terms of this
agreement or either party places the enforcement of this agreement in the hands of an attorney, or files a
lawsuit, the non-prevai ling party shall pay all attorney fees, costs, and expenses. The venue for any dispute
related to this agreement shall be held in Franklin County, Washington.
10. Term of Contract This Contract shall be in full force and effect upon execution of this agreement and
shall terminate by either party immediately upon request.
In witness whereof, the parties hereto have caused this agreement to be executed effective the day and year set forth
below.
