Background for Motion: Background Summary: The City recently completed a solid waste rate study to determine the rate increases needed to cover increasing costs while maintaining the required fund balance. Ordinance No. 6920 amends the Auburn City Code pertaining to solid waste rates. The new rates will incorporate a King County disposal fee increase, increased Waste Management collection costs, and provide 40 days of working capital in the Solid Waste Fund by the end of 2026. Rev iewed by Council Committees: Councilmember:Baldwin Staff:Thomas Meeting Date:October 9, 2023 Item Number: Page 3 of 119 ----------------------------- Ordinance No. 6920 October 2, 2023 Page 1 of 12 ORDINANCE NO. 6920 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, AMENDING SECTION 8.08.180 OF THE AUBURN CITY CODE RELATING TO SOLID WASTE COLLECTION CHARGES WHEREAS, the City provides for refuse and garbage services for residential and commercial properties located within the City; and WHEREAS, it is the City’s policy to have its waste management operations and services reflect their true costs in terms of value and fees charged; and WHEREAS, the City has reviewed its solid waste fund balance and utility rates and has determined that there is a need to stabilize the fund balance . NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF AUBURN, WASHINGTON, DO ORDAIN as follows: Section 1. Amendment to City Code. Section 8.08.180 of the Auburn City Code is amended to read as shown in Exhibit A. Section 2. Implementation. The Mayor is hereby authorized to implement such administrative procedures as may be necessary to carry out the directions of this legislation. Section 3. Severability. The provisions of this ordinance are declared to be separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section or portion of this ordinance, or the invalidity of the application thereof to any person or circumstance shall not affect the validity of the remainder of this ordinance, or the validity of its application to other persons or circumstances. Sections one through four of this Ordinance shall take effect and be in force on January 1, 2024. Section five of this Ordinance shall take effect and be in force five days from and after passage, approval, and publication, as provided by law. Section 5. Codification Note. Prior to January 1, 2024, Exhibit A of this Ordinance shall be published in the Auburn City Code as a parallel section to the currently published Section 8.08.180 with a title that reflects the future January 1, 2024, effective date. The title of the currently published Section 8.08.180 shall reflect that the section expires on January 1, 2024. Services and charges herein shall become effective for each account on October 1, 2021, January 1, 2022, and January 1, 2023 January 1, 2024, January 1, 2025, and January 1, 2026, as established below. Services shall be provided at the 35-gallon cart service rate unless the finance department is notified otherwise by the tenant or property owner. Likewise, unless the finance department is otherwise notified, services will automatically revert to the 35-gallon cart service rate upon a change in property tenancy or ownership. Multi-unit residential accounts must have the same type of service for each "occupied unit" unless tenant and owner sign city tenant release form for single - family residence garbage service. Tenant then pays direct to the city’s agent for solid waste services and is provided variable solid waste service as defined in "single-family residence." Owners are responsible for payment if tenant does not pay. If no payment is received from tenant or owner within 60 days of billing, service will revert back to multi-unit residential accounts. Residences can request a tenant release form only once in a year while they are at that address. C. Property owners of property not specifically addressed elsewhere in this Chapter are responsible for tenant payments. A tenant and owner may sign a city tenant release form for garbage service. Tenant then pays direct to city ’s agent for solid waste services. Owners are responsible for payment if the tenan t does not pay. This study analyzes the current and estimated future costs required to operate the fund, and to determine the revenue necessary to maintain services. From this study, new rates are proposed. The last rate study was conducted in 2021 and new rates were established for 2021, 2022, and 2023. To smooth rate increases to customers, $3 million in existing fund balance and a multi-year rate increase approach were used to smooth the increases over time. The need for rate increases in 2021-2023 were a direct result of the new contract with Waste Management, which was effective October 1, 2021. The contract brought enhanced services, but also came with increased costs since labor and equipment expenses had increased since the City last negotiated a contract with Waste Management in 2011. In addition, the City transferred the customer service and billing for solid waste to Waste Management. RATE STUDY With the final rate increase going into effect January 1, 2023, and continued increases in providing solid waste services, it is time to conduct another 3-year rate study. The City hired Sound Resource Management to conduct a solid waste rate study using their rate model and factoring the City of Auburn’s projected costs and funding goals. There are several cost drivers that were considered when building the rate model: 1. City Utility Tax of 11.5% 2. Annual King County Tipping Fee increases: o 9.8% in 2024 (actual) o 9.3% in 2025 (estimated) o 9.5% in 2026 (estimated) Page 16 of 119 Page 2 of 2 3. Annual contract increases with Waste Management that are tied to Annual CPI: o 4.5% in 2024 (actual) o 4% in 2025 (estimated) o 3.75% in 2026 (estimated) 4. Additional $450,000 for enhanced city-wide litter and illegal dumping services RATE PROPOSAL Based on the increasing costs identified in the rate study and the City’s fund balance policies, the proposed rate increases are as follows: 1. The first rate increase of 8.9% would become effective January 1, 2024; 2. The second rate increase of 7.0% would become effective January 1, 2025; and 3. The final rate increase of 6.7% would become effective January 1, 2026. RECOMMENDATION The proposed rates are necessary to cover the increase in Waste Management service fees, the projected King County Tipping Fee increases, and the projected CPI increases. The goal beyond 2026 is to continue setting smaller, more frequent rate increases to build more predictability and stability for solid waste customers. City staff recommends the City Council adopt Ordinance 6920 so that the City can continue to maintain a healthy fund balance while providing dependable solid waste services for residents and businesses. Conditional Approval: When authorized by the City, permits that are issued with conditions due to project phasing, out of sequence issuance, pending associated approvals, or other advanced permitting requests made by the applicant, a conditional approval fee equivalent to the additional plan review fee based on a minimum of four hours will be required prior to issuance. Demolition Permit Fees: Demolition permits shall be charged a base fee of $162167.00. Fire Permit Fee: For each fire permit fee a City of Auburn administration fee of $115123.00 will be applied in addition to the fee collected for the Valley Regional Fire Authority (VRFA) as identified in the VRFA Fee Schedule. Manufactured Home: The permit fee shall be equivalent to the adopted additional plan review and reinspection fee based on a minimum of four hours. Permit Extensions: For permits that are granted an extension beyond the expiration date or date of abandonment, whether issued or not, a permit extension fee is required to be paid prior to extension. The fee shall be the lesser of $115 123 or 50% of the original application and permit fees. Plan Review Fees: When submitted documents are required by Section 106.3 of the Construction Administrative Code, a plan review fee shall be paid at the time of submitting the submittal documents for plan review. Said plan review fee shall be 65 percent of the building permit fee as shown in Table 1-A. The plan review fees specified in this section are separate fees from the permit fees and in addition to permit fees. Rack Permit Fee: The permit fee shall be equivalent to the adopted additional plan review and reinspection fee based on a minimum of three hours. Solar Permits – Over the Counter: The permit fee for solar installations that qualify for the over-the-counter permitting shall be equivalent to the inspection fee based on a minimum of two hours. Page 40 of 119 Stock Plan Site Plan Review Fee: The plan review fee for individual lot site plan that have an approved building stock plan shall be $232239.00. Temporary Certificate of Occupancy Fees: There shall be a fee equal to $1,5300.00 for issuance of a temporary certificate of occupancy and a fee of $5300.00 for each subsequent 30-day extension requested. Work Without a Permit: Building construction and grading activities requiring permits per ACC 15.74 that are determined to be in violation for work occurring without an approved permit result in additional documentation, administration, research, and inspection and require more processing time. For these cases, an additional 20100% fee will be applied to the standard application and permit fees identified in sections 3 and 4 above. It is possible a violation existed prior to property purchase by a new owner, was constructed by an individual who mislead the owner, or was constructed by an individual who was unaware of code requirements. The fact that violations may not have been created by the current owner does not relieve Code Enforcement staff from their responsibility to seek compliance from the property owner. When assessing permit fees, consideration may be given based on the circumstances, severity of the violation, and timeliness of the property owner to resolve and obtain required permits and compliance with City code. Building Permit Fee Reductions. The Director is authorized to waive building, mechanical or plumbing permit fees for homeowners that are already enrolled in another City program that is intended to benefit low incomelow-income residents (e.g. housing home repair program, utility discount program). This fee reduction may also be extended to contractors that are applying for permits on behalf of these homeowners provided that it can be documented that the discount is benefiting the homeowner and not supplementing a contractor’s profit. 5. Background for Motion: Background Summary: The Valley Regional Fire Authority (VRFA) was established in 2007 under RCW 52.26 as a Fire Authority that serves the cities of Auburn, Algona, and Pacific. As a Fire Authority VRFA operates as a separate municipal corporation, with independent taxing authority, and within an independent taxing district. While VRFA is a separate Fire Authority and is organizationally independent from the City of Auburn, VRFA continues to have a role in reviewing development proposals and conducting inspections during the construction process. Within VRFA it is the Fire Marshal’s Office that performs these functions. While VRFA has taxing authority within its jurisdictional boundary, tax payers do not fund all services offered by VRFA. In some instances there are fees charged to customers who are seeking direct service, e.g. a permit to construct a commercial building. In other words, permit customers pay a substantial portion of the direct service they are seeking, as opposed to the service being subsidized across the taxing district. Stated in yet another way, a residential tax payer who pays a portion of their property taxes to VRFA is generally not providing a significant level monetary contribution to a commercial real estate proposal or a new residential subdivision. Since the Fire Authority was established in 2007, VRFA has collected fees for reviewing development plans and conducting construction inspections. In Auburn, VRFA fees are collected by the City and distributed to VRFA. This practice was put in place in order to ensure that Auburn could achieve a one-stop permitting shop. Instead of sending customers to a VRFA office to pay fees and apply for separate fire permits, customers can submit, pay and pick up permits at the City’s Permit Center. More times than not, the customer never knows that they are interacting with, and paying, separate governmental entities. Page 78 of 119 The 2024 VRFA fee schedule includes a general increase of fees by 5%, consistent with City of Auburn development fee increases. This moderate increase remains well below the Consumer Price Index (CPI) figure for the Puget Sound area and will maintain a fee schedule that is markedly lower than comparable agencies. While VRFA is a separate agency, with a separate Governance Board that has authority to establish its own service fees, the Auburn City Council has a role in endorsing fees that are collected by the City and distributed to other agencies (similar to Council’s role in reviewing school district fees and taking action to authorize the collection of these external agency fees). Typically, City Council would provide this endorsement through action of a Resolution which then enables procedural efforts to occur that facilitate collection of the relevant fees and fee types. Metal detecting is permitted in any park during the hours when the park is open as long as the activity does not interfere with reserved sports or activities or city-organized, sports or activities or with the enjoyment of the park by other users. Metal detecting is not allowed on athletic fields, municipal golf courses, in ornamental planting areas, on the grounds of historic sites (including the Mary Olson Farm), or in critical areas or their buffers as defined in Chapter 16.10 ACC. Metal detecting in camping areas is permitted only in unoccupied campsites or in a campsite lawfully occupied by the detector. B. Persons operating metal detectors in parks must: 1. Not make a noticeable impact to park property. Metal must be removed from the ground with minimal sod disturbance. Any holes dug are limited to six inches maximum depth and must be immediately refilled and the surface restored to its earlier condition. Holes in turf must be dug in a ‘U’ shape so that one edge of turf remains connected. The turf flap must be flipped back over when the hole is refilled. 2. Not destroy or disturb park facilities, signs, equipment, natural features, or historical or archeological resources. 3. Not remove any items that appear to have historical or archaeological significance, and report such a find to a Department of Parks and Recreation employee. 4. Only use ice picks, screwdrivers, or probes under two inches in width, and digging implements that do not exceed five inches in width and eight inches in length. 5. Properly dispose of all found or recovered trash and litter. 6. Observe all federal, state, and local laws and regulations while metal detecting. C. This section does not apply to park employees who are engaged in the performance of their duties, and an individual whose use of a detectors has been approved by the Director in writing and the individual can produce the written approval during performance of the metal detecting. COMMUNITY DEVELOPMENT Page 106 of 119 Narrative Consejo: two narratives shared by agency case manager in which names have been changed for confidentiality reasons. “Lupita Torres has advanced in the domestic violence program, from being able to strategize safety methods, knowing her legal rights to filing legal motions such as filing a protection order against an abuser. The progress made by Lupita, has been handed down as a helping hand to her daughter which of whom had been suffering from domestic violence herself. Safety measures employed by Lupita, and when speaking with her in regards to the safety plan, are always changing to conform to the safety of the victim. Lupita finds the safest plan to employ and uses those methods to keep herself and her family safe. Safety is no longer a factor, I as her advocate have to employ. She is constantly striving for a safer life and employs safety strategies to achieve that. Knowing legal rights, Lupita has been able to teach her daughter to not fall victim to an abuser’s torment. Teaching her daughter the right and wrong things to accept in a relationship. Breaking traditional biases, she is breaking the tradition of continuance of abuse in the predominant Hispanic community. Domestic violence strategies employed, by implementing a protection order. Lupita, in a crisis intervention, called the police, made a report, called for assistance to filling the protection order and then proceeded to acquire the Domestic Violence protection for her daughter. Lupita started out without knowing the strategies to a domestic violence dynamic, strategies to seek safety in a domestic violence situation, as well as her legal rights in this country. Lupita now employs domestic violence crisis intervention when needed, and shares her knowledge of domestic violence and safer living by breaking cultural stereotypes. Ultimately, Lupita now is able to begin the legal process for the domestic violence process, employ a safety plan in a time of crisis, and determine safe and unsafe behavior in an intimate relationship without the assistance of a domestic violence advocate.” “VM came to Consejo with a DV case very disturbing for her and kids. She was so afraid of husband that she would be shaking if he was close to her. She was referred to mental treatment and start attending support groups. She was so overwhelm with the whole situation that she couldn’t even think on her own. She was also assisted to file an order of protection and eventually got divorced and now she is so much easier to work with. She is self-sufficient to the point that she can actually help her kids and guide them better. She still taking mental health therapy and is very content with her progress.” COMMUNITY DEVELOPMENT Page 107 of 119 Narrative DAWN: A response shared from an anonymous client of DAWN services and support. “Dawn Rising provides peace, comfort, and safety to women and children rebuilding their lives after experiencing domestic violence. There is a great deal of stigma around domestic violence and a certain shame for those relying on programs like Dawn to provide temporary housing for victims who choose to leave their partners. Dawn is a safe haven filled with an abundance of support, safety, and supplies. My children are well loved, well nourished, and protected at all times. The mothers residing at Dawn are not criminals, troublemakers, or agitators. We are victims of domestic violence and single mothers temporarily housed while navigating a complex system of benefits and resources… Mothers and their children at Dawn are survivors; we are not here to endure blame, guilt, or shame for how we ended up here. Life at Dawn is empowering. My children have built strong relationships with the other children at Dawn because they see each other everyday, they share many similarities, and they help each other. My children are experiencing a cohesive love and support system every single day they are with me. They trust and respect every mother and staff member at Dawn. They look forward to seeing their friends and playing with them. There are times where we have gathered and shared meals with other families, there are times where my children and I spend quality alone time during meals, and many combinations in between. My support system at Dawn is the strongest its ever been. There is no shame or judgment if we pose a question or need help accessing resources for our families. Each mother here is guided by social workers and dedicated staff to navigate the complicated system of state benefits and federal programs that support domestic violence survivors and single mothers. We are a 100% sober community where no alcohol, marijuana, or recreational drugs of any kind are permitted on site. There are absolutely no weapons of any kind allowed on site. We have 24/7 access to staff members for emergencies and maintenance issues… Dawn does not accept just anybody off of the streets onto the property. There is an intake and referral process carried out by social workers to determine the level of need and the compatibility with what the program offers. There is a structure to their program and safety protocols in place at all times to provide ease and comfort during times of transition. I wish to break the stigma of shelter-living and address victim blaming and the heartbreaking effects it has on survivors of all ages. If it weren’t for Dawn, I would be struggling to find steady footing to access basic necessities still to this day. Yet, I am now 6 weeks into my career training and excelling academically, my children are thriving in their school and being awarded for their outstanding behavior, and I still have the capacity and strength to fight for my rights as a Dee and Aris mother. My children are my world, every single minute of my life for the past 8 years has been dedicated to making them happy and comfortable. Dawn is not a barrier in my parenting, it is the opposite. Living at Dawn is temporary, my rights as a mother are not. I love my children with every last inch of my soul and I will dedicate my life to advocate for victim’s rights and equal opportunity parenting. The only threat to my children is removing them from their mother due to classism, victim blaming, and abusive use of conflict.” COMMUNITY DEVELOPMENT Page 108 of 119 Narrative YWCA-Gender Based Violence Specialized Services: “The Parenting and Life-Skills collaboration project has been a highly requested class by the mothers at our confidential housing. With economic distress, financial hardships, and intimate partner violence, being a parent can often feel like another stressor for our mothers. During the first weeks of the program, we have prioritized getting the mothers “back connected with self”. With the actualization that being a parent is such a core part of their identities, we want to grasp who our mothers perceive themselves to be aside from that. What were their goals, what do they wish to achieve, etc. We believe that, in understanding how our mothers view themselves, we will begin to slowly unpack how they view their parenting in the weeks that follow. Advocates have continued to focus on next steps to improve protective factors that will aid survivors in their safety plans and address additional barriers with safe relocation plans, rental assistance, and other essential needs. Our next steps hotel program has been a safe placement for survivors to rest, regroup and strategies with an advocate for immediate next steps to transition into safe low-income housing. Survivors are standing in resilience as they bounce back from the adversity with Violence. We have stayed committed in keeping our focus population a priority. As African American survivors of GBV has been greatly impacted and unserved in our community. Many in need of safe housing, legal, advocacy, rental assistance or relocation support.
