HomeMy WebLinkAboutInteragncy Comm for Outdoor Rec YAF Project Agreement Youth Athletic Facility Grant Account Project Sponsor: Project Title: Auburn Parks & Rec Dept Lea Hill Ballfield #2 Improvements Project Number: 03-1334D Approval Date: 4/2/2004 PARTIES OF THE AGREEMENT This Project Grant Agreement (Agreement) is entered into between the Interagency Committee for Outdoor Recreation (lAC), P.O. Box 40917, Olympia, Washington 98504-0917 and Auburn Parks & Rec Dept, 910 9th Street SE, Auburn, WA 98002 (Sponsor) and shall be binding upon the agents and all persons acting by or through the parties. PURPOSE OF AGREEMENT This Agreement sets out the terms and conditions by which a grant is made from the Youth Athletic Facility Grant Account of the State of Washington's General Fund. The grant is administered by the lAC to the Sponsor for the project named above. C. DESCRIPTION OF PROJECT The subject Project is described on the attached Project Summary. D. TERM OF AGREEMENT The Project Sponsor must insure that the facility developed, improved, and/or maintained through the Youth Athletic Facilities Account funding identified in the Project Agreement is made available for public youth and/or community athletics for a minimum of twenty (20) years from the date of project completion. E. PERIOD OF PERFORMANCE The Project reimbursement period shall begin on May 1, 2004 and end on March 31, 2005. No expenditure made before or after this period is eligible for reimbursement unless incorporated by written amendment into this Agreement. PROJECT FUNDING The total grant award provided by the lAC for this project shall not exceed $20,000.00. The lAC shall not pay any amount beyond that approved for funding of the project. The Sponsor shall be responsible for all total project costs that exceed this amount. The contribution by the Sponsor toward work on this proiect at a minimum shall be as indicated below; lAC - YAF - Maintaining Project Sponsor Total Project Cost G. RIGHTS AND OBLIGATIONS Percentage Dollar Amount 47.62% $20,000.00 52.38% $22,000.00 100.00% $42,000.00 All rights and obligations of the parties to this Agreement are subject to this Agreement and its attachments, including the Sponsor's Application, Project Summary, Eligible Reimbursement Activities Report, Project Milestones, and the General Provisions, all of which are attached hereto and incorporated herein. Except as provided herein, no alteration of any of the terms or conditions of this Agreement will be effective unless provided in writing. All such alterations, except those concerning the pedod of performance, must be signed by both parties. Period of performance extensions need only be signed by IAC's Director. The Sponsor has read, fully understands and agrees to be bound by all terms and conditions as set forth in these documents. ADDITIONAL PROVISIONS OR MODIFICATIONS OF THE GENERAL PROVISIO.~..; The Project Sponsor must ensure that the facility acquired, developed, improved, and/or maintained through the Youth Athletic Facilities Account funding identified in this Project Agreement is made available for public youth and/or community athletics for a minimum of twenty (20) years from the date of project completion. Project Completion begins at lACs issuance of final reimbursement. Should the facility become unavailable for public youth and/or community athletic use during this 20 year period, except as provided for in Section 25 (b), lAC requires the project sponsor to replace all entirely or partially funded project elements within this agreement. Lo ENTIRE AGREEMENT This agreement, along with all affachments, constitutes the entire agreement of the parties. No other understandings, oral or othe~vise, regarding this Agreement shall exist or bind any of the parties. M. EFFECTIVE DATE This agreement, for project #03-1334D, shall be effective upon signing by all par'ties. The purpose of these improvements is to extend the playing season and number of available days in which the field can be used. Improvements to the field will include installation of a drainage system. Current drainage is not adequate. In most years the field is not playable until late May or June due to wet conditions. Additional improvements will include new dugouts, bleachers, infield material, repairs to the irrigation system, and a portable mound. Green River Community College will be a partner with the City of Auburn in this effort. They have agreed to commit $5,000 in cash and $2,500 of in-kind services. The college is one of the users of the field with their fastpitch program and with increased field availability due to the maintenance improvements, the City of Auburn Parks and Recreation, Auburn Little League, and other youth serving organizations would increase their availability by two months. There were thirty-three applications submitted for consideration in the Youth Athletic Facilities Program, YAF Maintaining category. Each project went through an evaluation process prior to being recommended for funding. The lAC Board approved funding for thirty-three projects on Friday, April 2, 2004. Funding for the Youth Athletic Facilities Program, YAF Maintaining category comes from a $10 million donation made in 1998 by the Seattle Seahawks "team affiliate" and interest derived from that donation. Referendum 48 (the Stadium Act) authorized creation of the YAF program, which provides funding for community athletic facilities. Auburn Parks & Rec Dept will leverage local contributions totaling $22,000 with grant monies to implement the project. Total estimated project cost is $42,000. lAC is the state's administrator of the grant program.
