HomeMy WebLinkAboutFiring Range - City of LakewoodHOLD HARMLESS AGREEMENT BETWEEN THE CITY OF LAKEWOOD AND CITY OF AUBURN FOR USE OF THE AUBURN RANGE FACILITY e > , 2007, by and This Agreement made and entered into this day of ~~~ between the CITY OF AUBURN, a municipal corporation of the State of Washington, hereafter referred to as "City" and The City of Lakewood, a municipal corporation of the State of Washington, hereafter referred to as Lakewood. WITNESSETH: Whereas, the City owns and operates a firearms range facility within the city limits of Auburn, King County, Washington; and Whereas, Lakewood `s police department conducts firearms operability tests for court purposes and has a need for a facility to serve, periodically, as a secondary (back- up) facility where its forensics services section may conduct the tests; and Whereas, it is mutually beneficial to both parties hereto that this agreement be executed for use by Lakewood, NOW, THEREFORE, in consideration for authorization to use the Auburn range facility located in and belonging to the City of Auburn, THE PARTIES, HERETO, DO HEREBY AGREE as follows: 1. Scope of Use. Lakewood shall use the range facility for firearm operability testing on a periodic basis as a secondary option only. Lakewood shall use the range when it is being staffed by Auburn Police Officers and agrees to comply with range rules and regulations as set out by the City. 2. Hold Harmless and Indemnification. Lakewood shall hold the City, its officials, officers, employees and agents harmless from and against any action of any kind including, but not limited to, all claims of Lakewood personnel, employees or agents for personal injury, death or damage to their person or property suffered while using the range facility, except those losses arising out of the City's sole negligence. 3. Term of Agreement. This agreement shall be in effect for a period of two years from the execution of this agreement and automatically renew unless the City receives written notice from Lakewood of its intent to terminate at least sixty (60) days prior to the end of the two year term. Either party may terminate this Agreement by providing the other party not less than sixty (60) days written notice of its intention to terminate.
