NO._..~~~.~__..___.__. 629 vRDnLIJ.~UE NO. b z C;" ~AN ORDINANCE relating to the operation and driving of vehicles upon the public highways within the corporate limits of the City of Auburn, and the rate of speed of vehicles within said corporate limit's, fixing the maximum speed at which any vehicle may be driven, operated or moved, within the said cor- porate limitas, providing penalties for .violations hereof, and repealing Ordinance ~o. 414 of the ordinances of the City of iJ,:uburn. ~ THE CIT:l CVUJ.,vIL OF Tl1E CITY OF AUBURN DO ORDAIl~ AS FOLLuWS: SECTlu~ I: ~he words and phrases herein used shall, for the purpose of this ordinance, have the meanings respectively ascribed to them in this section exoept in those instances where the context clearly indicates a different meaning. (a) IfVehicle~". Every device in, upon or by which any person or property is or may be transported or drawn upon a public highway excepting devices moved by human power or used exclusively upon stationary rails or tracks. (b) "Public Highway~". J:Avery street, way or plaoe of whatever nature open as a matter of right to the use of the public for the purposes of vehicular travel. \c) "Motor .ruck". Every motor vehicle designed or used (1) for the transportation of commodities, merchandise, productS', freight or animals; (2) for drawing or pulling one or more independent vehicles or trailers in the transportation of commodities, merchandise, produc~~, freight or animals upon a public highway. ~ECTION II: Every person operating or driving a vehicle of any character upon a public highway within the cor- porate limits of the City of Auburn shall drive the same in a careful and prudent manner and at a rate of speed no greater than is reasonable or proper under the conditions existing at the point of operation, taking into account the amount and charaoter of the traffic, condition of brakes, weight of vehicle, grade and width of highway, condition of surface and freedom of obstruction to view ahead, and so as not to unduly or unreason- ably endanger the life, limb, property or otb er rights of any person entitled to the use of the street or highway and in no event at a speed greater than twenty-five (25) miles an hour. ~ECTION III: It shall be unlawful for the driver of any vehicle to drive the same within the corporate limits of the City of Auburn at a speed exceeding the following: 1. Fifteen miles an hour in traversing a grade crossing of any steam, electric or street railway when the driver's view is obstructed. A driver's view shall be deemed to be obstruoted when at any time during the last one hundred feet of his or her approach to such crossing he or she does not have a clear and uninterrupted view of such railway crossing and of any traffio on sllch railway for a distance of four hundred feet in both direct- ions from such crossing: xrovided, That all vehicles transporting passengers for hire or transporting school children over a public highway shall stop before traversing such grade crossing. vThenever any person driving a vehicle approaches ,all interurban or steam railway grade crossing and a clearly visible and positive signal gives warning of the immediate approach of a railway train or oar, it shall be unlawful for the driver of the vehicle to fail to bring the vehicle to a complete stop before traversing such grade crossing; 1 -' ~ .' , 2. Fifteen miles an hour in traversing an intersection of highways when the driver's view is obstructed. A driver's view shall be deemed to be obstructed when at any time during the last one hllndred feet of his approach to such intersection he does not have a clear and uninterrupted view of such intersection and of the traffio upon all of the highways entering such inter- section for a distance of three hundred feet from such intersection; 3. It shall be unlawful to operate or drive any vehicle or combination of vehicles equipped with metal tires over or upon any public highway within the corporate limits of the City of Auburn at a greater rate of speed than the following: 2,500 pounds gross weight, including load, or less - - - - - - - - - - - - - - - - - - - 10 miles per hour uver 2,500 pounds gross weight, including load, and not over 7,000 pounds gross weight, including load - - - - - - - - - - 6 miles per hour ~ECTION V: That any person who shall violate or disregard the provisions of this ordinance shall be deemed guilty of a mis- demeanor, and upon a conviction thereof, shall be punished by a fine of not less than five dollars or more than ~hdrJ. dollars and shall be i:aprisoned in the city jail until sue ine is paid or until discharged by due process of law fte!ets. SECTION VI: ihat ordinance Do. 414 of the ordinances of the City of Auburn be and the same hereby is repealed. SECTION VII: That this ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as required by law.
