HomeMy WebLinkAbout659 i~':".'i::':;.~};--::'C-"'""" :"m~f',,",<,' '~ , . ~ ~L~~ -~ - t ~ ORDINAlJCE NO. ~oJf Al~ ORDINANCE: Providing for the improvement of all lands and property situated and included within the boundary lines of the local ioprovement district hereinafter established, by the construct- ion therein and therefor of a sanitary sewer and storn sewer drainage district, to be known as local improvement district No. 93 and local improvement fund district Do. 93; proyiding for the assessment of the costs and expenses of such improvement upon the property in said district; providing for the payment of the costs and expenses of such improvements by the issuance of bonds of said district; and adopting maps, plans and specifications for such improveir,ent. THE CITY COUNCIL OF THE CITY OF AUBURN DO ORDAIN AS FOLLOWS: Section 1. That all that portion of the City of Auburn in~ eluded in the local improvement district hereinafter established~ by~econstructlng and enlarging of the present sanitary and storm sewer drainage pipe outlet lines, and re-locating the same, so that as re-located the routes of such reconstructed and enlarged sanitary sewer and storm sewer drainage pipe outlet lines shall be as follows: Beginning at the present sa.nitary sewer and storm sewer man- holes in ~hird Street N.W. in the City of Auburn, near the east line of the right-of-way of the l;:)eattle-Tacoma branch of the Northern Pacific Railway; running thence westerly across said right-of-way and along said ~hird ljtreet N.W. to D Street D.W. in the City of Auburn; thence northerly al~ng said D Street N.W. to connections respectively with the existing 18-inch sanitary sewer pipe line and the exist- ing 12-inch by 18-inch wooden box storm sewer drainage line; and of doing such other work as may be necessary to properly complete such improvement all in accordance with plans and specifications pre- pared by the City ~ngineer of the City of Auburn, and by doing such other work as may be necessary in connection therewith, and in accord- ance vii th the resolution providing for local improvement district No. 93. Section 2. ~hat there is hereby established in the City of Auburn a local improvement district to be known as local improvement district No. 93, which said district shall includE: all the lands and property situate within the following boundary lines: Beginning at the point of intersection of the center line of the right-of-way of the l;:)eattle-j,'acoma branch of the llorthern Pacific Railway with the south line of the north 1/2 of the southeast quarter of .;)ection 13, :.L'o'vvnship 21 north of ~~a.nge 4 east W.M.; running thence easterly along said south l,ine of the north 1/2 of the southeast 1/4 of said ljection 13 to point of intersection with the northeasterly and northerly boundary line of the right-of-way of the qPalmer Gut-Offll branch of the Northern Pacific hailway; thence southeasterly and easterly along said northeasterly and northerly line to a point 140 feet east of said Section 13; thence northerly and on a line parallel with the east line of said jection 13 to the north line of the south- west 1/4 of .;)ection 18, Township 21 north of Range 5 east W.~.; thence westerly to the northwest corner of said ~.W. ~/4 ot said , " , / -1- / / . iJ .. ! . .. ...~ '<II J.. ..,~ ~ Section 18; thence northeasterly along thJ center line of Auburn Avenue in the City of Auburn to the north line of the S.W. 1/4 of the N.W. 1/4 of said ~ection 18; thence westerly along said north line to the west line of said ,~ection 18; thence westerly along the north line of tpe southeast 1/4 of the northeast 1/4 of ~ection 13, Township 21 north of Aange 4 east W.M. to point of intersection with the center line of the right-of-way of the .;)eattle-Tacoma branch of the Northern Pacific Railway; thence southerly along said center line to the point and place of beginning; Section 3. That said improvement shall be made by the City of Auburn under the supervision of the City Council of said City or such sub-committees or person or persons as the City ~ouncil may designate. Section 4. :J.'hat the cost and expense of said improvement, including all necessary and incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created according to law. The vity of Auburn shall not be liable in any manner for any part of the costs and expenses of said improvement. Section 5. That there is hereby established in the treasury of the City of Auburn a fund to be known as local improvement district fund District Do. 93; that all moneys paid into the City ~reasury of the City of Auburn on account of the costs and expenses of improve- ments in said district shall be paid into and credited to said fund, and that all warrants drawn or issued by the City of Auburn for pay- ment of improvements in or expenses against said district shall be drawn upon and payable from said fund. Section 6. PaY;;lent for said improvements shall be made in the fi rst instance by warrants dravV'n upon said local improvement furm, which warrants shall bear interest at the rate of 8 per cent per annum. Bonds bearing interest at the rate of 7 per cent per annum, payable on or before 12 years from the date of issuance shall be issued in payment of the costs and expenses of said improvement, under the mode of "payment by bonds", as defined by law, which bonds shall be redeemed by the collection of special assessments to be levied and assessed upon the property 1;vi thin said district payable in ten equal annual installments with interest at the rate of 7 per cent per annum. Such bonds shall be delivered to the contractor in redemption of warrants on said 1,Jcal improve:;lent fund issued on estimates of the City ~ngineer, or the ~ity of Auburn may, at its option, sell said bonds and make such redemption in cash. Section 7. ~he City treasurer shall, upon receipt of an assess- ment roll therefor, publish a notice in the official neWSpaper of the Oity of Auburn for two consecutive weekly issues that such roll is in his hands for collection and that any assessment thereon or any portion of any assessment may be paid at any time within thirty days from the date of the first publication of said notice without interest, penalty or cost, and that unless payment be made within such time, the sum remaining unpaid thereafter may be paid in equal armual installments, the number of which annual installments shall be two less than the number of years which said bonds are to run, with interest on the whole unpaid sum so charged at the rate of 7 per cent per annum, payable annually, and each year thereafter one of such installments, -2- , f . . .-J- ....: ,\;. I together with interest due thereon, and on all installments thereafter to become due, shall be collected in the manner provided by law, and unless payment be made at the time such installment or installments shall bear interest at the rate of 7 per cent per annum and may be collected and the lien thereof enforced in the manner provided by law. Section 8. ~urther prov~s~on shall be made by the City COUI1Cil for the levy and collection of the assessments herein provided for and for the issuance of said bonds in the payment of the costs and expenses of such improvement, such provision to be made from time to time by ordinance. Section 9. :1:hat the maps, plans and specifications for such sanitary sewer and storm sewer and all other work necessary or inci- dental thereto, prepared by the ~ity ~ngineer pursuant to the pro- visions of resolution Ho. 93 of the resolutions of intention to make improvements in the City of Auburn and now on file in the office of the City Clerk of said ~ity be and the same hereby are approved and adopted. Section 10. ~hi8 ordinance shall take effect and be in force five (5) days from and after its passage, approval and publication as required by law.
