AN ORDINANCE relating to a certain franchise granted to

J. L. Veach, his successors and assigns, for the construction,

City of Auburn granted to J. L. Veach, his successors and as-
signs, the right, privilege and franchise to construct, maintain
and operate a gas works and gas distribution system in the
streets, alleys and public place~~of the City of Aubuxnfor a
period of fifty years; and
WHEREAS, all the rights of said J. L. Veach, under said
franchise, have duly passed by assignment to Chas. R. Collins,

who is now the owner of said franchise; and
WHEREAS, no gas service has been furnished under said
franchise for a period of more than ten years last past; and
WHEREAS, Chas. R. Collins. is now proposing to construct
a gas dist~ibution system in the streets, alleys and public
places of the City of Auburn, under said franchise, but is
unwilling to do so unless an ordinance be duly enacted by the
City of Auburn, confirming his rights under said franchise and
amending said franchise as herein provided; and
WHEREAS, since the passage of said Ordinance No. 221 the
jurisdiction to control the~matter of~ates and service under ~~
said franchise has been exolusively vested in the Department
of Public Works of the State of Washington, thereby rendering
Section 4 of said Ordi~ance 221 void;

do ordain as follows:
Sec. 1. That the franchise granted to J. L. Veaoh, 'hts ~
successors and assigns, by Ordinance 221 of the City of Auburn,
entitled:
"AN ORDINANCE granting to J. L.. Veaoh, of Auburn, Washington,
his s~ccessors and assigns, the right, privilege, authority and
f:r:anchise to construct, erec~, install, maintain and operate suoh
buildings and'" equipment as are necessary and 'Convenient for the
manufacture of illuminating and fuel gas and its by-products, and
to lay, to maintain and to operate under ground, pipes and mains
in the streets, alleys and public places in the City of Auburn,
Washington, for the transmission, supply, distribution and sale
of fuel and illuminating gas, and to charge rates and to oollect
tolls and oompensation for such gas."

Sec. 2. That the map filed by said Chas. R. Collins, sh9wing

Sec. 3. That Seotion 4 of said Ordinance. No. 221 be and the

AN ORDINANCE relating to a certain franchise granted to
J. L. Veach, his successors and assigns, for the construction,
maintenance and operation of a gas works and distribution system
City of Auburn granted to J. L. Veach, his successors and as-
signs, the right, privilege and franchise to construct, maintain
and operate a gas works and gas distribution system in the
streets, alleys and public places of the City of Auburn for a
period of fifty years; and
WHEREAS, all the rights of said J. L. Veach, under said
franchise, have duly passed by assignment to Chas. R. Collins,
who is now the o?mer of said franchise; and
WHEREAS, no gas service has been furnished under said

WHEREAS, Chas. R. Collins is now proposing to construct
a gas distribution system in the streets, alleys and public
places of the City of Auburn, under said franchise, but is

the streets, alleys and other public places or parts thereof in
which he proposes to lay and maintain gas pipes or mains, and the
particular part thereof he proposes to occupy for such purposes,
which map was filed with the City Clerk on February ____, 1929,
be, and the same is hereby, in all respects approved and the City
Clerk is hereby directed to issue to Chas. R. Collins a written
permit for the construction thereof.
Sec. 3. That Section 4 of said Ordinance No. 221 be and the
same is hereby repealed.
Sec. 4. This ordinance shall take effect and be in force
five days from and after its publication as provided by law.
