NO. 681
AN ORDINANCE: Providing for the improvement of Pike
Street N. E. in the City of Auburn between Main Street
East and Fourth Street N. E. by the conatruotion therein
of ooncrete and oement sidewalks on both sides of said
Street and by the grading and gravelling said Street and
by the doing of all suoh other work as may be necessary
in oonneotion therewith) all aocording to plans and speo-
ifioations on file with the City Clerk and in aooordanoe
with the resolution providing for Local Improvement Dis-
trict No. 97; approving and adopting said plans and speo-
ifioations; oreating Local Improvement Distriot No. 97
and LOcal Improvement Fund) District No. 97; providing
for the assessment of the oosts and expense of suoh im-
provement upon the property in said District; and prov-
iding for the payment thereof by bonds of said Distriot.
THE CITY COUNCIL OF THE CrTY OF AUBURN DO ORDAIN AS
FOLLOWS:

Seotion l. That all that portion of Pike Street
N. E. in the City of Auburn between Main Street East and
Fourth Street N. E. be improved by the oonstruction there-
in of oonorete and cement sidewalks on both sides of said
portion of Pike Street N. E. and by the grading and gravel-
ling of all that portion of Pike Street N. E. situate be-
tween Main Street East and Fourth Street N. E.) and by do-
ing such other work as may be necessary to properly comp-
lete said in~rovement) all according to plans and speoifi-
cations for such improvements prepared by the City Engineer
under the direotion of the Street Committee of the City
Council of the City of Auburn, and now on file in the office
of the City Clerk) which plans and speoifioations for suoh
improvement are in aooordance with the Resolution providing
for Local Improvement Distriot No. 97.
Section 2. That the plans ans speoifications for suoh
improvement, prepared by the City Engineer .and now on file
in the offioe of the City Clerk be and the same hereby are
approved and adopted.
Seotion 3. That the oosts and expense of said improve-
ment inoluding all neoessary and inoidental expenses shall
be borne by and assesse~ against the property inoluded in
the asseesment diet_iot hereinafter oreated acoording to
law. The City of Auburn shall not be liable in any manner
for any portion of the costs and expense of said improve-
ment except as herein provided.

Section 4. That there is hereby established a Looal
Improvement Distriot to be called Looal Improvement District
No. 97, which said District is described as follows:
"All of the property between the termini of that
portion of said Street proposed to be improved
as aforesaid and on eaoh side thereof, abutting
upon, adjacent, vioinal or proximate to suoh por-
tion of said Street to a distance back of the
marginal lines thereof as provided by law."
Section 5. That said improvement shall be made by
the City of Auburn under the direction of the City Counoil
thereof or suoh oommittee or persons as the City Council
may designate.
Seotion 6. That there is hereby established in the
Treasury of the City of Auburn a fund to be known as "Lo-
cal Improvement Fund) District No. 97". That all moneys
paid into the City Treasury of the City of Auburn on ao-
oount of the oosts and expense of improvements in said
District shall be paid into and credited to said fund, and
that all warrants drawn or issued by the City of Auburn in
payment for improvements in or expenses against said Dis-
trict shall be drawn upon and payable from said fund.
Section 7. Payment for said Improvement shall be made
in the first instance by warrants drawn upon said Looal Im-
provement Fund, which warrants shall bear interest at the
rate of seven per cent per annum. Bonds bearing interest
at the rate of seven per oent per annum payable on or before
twelve years from the date of said issuance shall be issued
in payment of the costs and expenses of said improvement,
whioh bonds shall be redeemed by the oollection of special
assessments to be levied and assessed upon the property with-
in said District, payable in ten equal annual installments
with interest at the rate of seven per oent per annum, under
the mode of "Payment by Bonds" as defined by law. Such bonds
shall be sold and redemption of warrants made in cash.
Section 8. The City Treasurer shall, upon reoeipt of
an assessment roll therefor, publish a notioe in the offioial
newspaper of the City of Auburn for two oonseoutive weekly is~
sues that such roll is in his hands for collection and that
any assessment thereon or any portion of any assessment may
be paid at any time within tbirty days from the date of the first
publication of said notioe, without interest, penalty or cost)
and that unless payment be made within such time the sum remain-
ing unpaid the~eafter may be paid in equal annual installments
the number of whioh annual installments Shall be two less than
the number of years which said bonds are to run, with interest
on the whole unpaid sum so charged at the rate of seven per
oent per annum, payable annually, and eaoh year thereafter,
one of such installments, together with the interest thereon
due and on all install..nts thereafter to beoome due shall be
oollected in the manner provided by law, and unless payment
be made at the time, suoh installment or instamments shall
bear interest at the rate of

seven per oent per annum and shall be collected and the
lien thereof enforced in the manner provided by law.
Seotion 9. Further provision shall be made by the
City 6~ncil for the levy and oollection of the assess-
ments herein provided for and for the issuance of said
bonds in payment of the oost and expense of said improve-
ment, such provision to be made from time to time by Or-
dinanoe.
Section 10. That this Ordinance shall take effect
and be in foroe five days from and after its passage, ap-
proval and publication as required by law.
