ORDINANCE NO. 737
AN ORDINANCE approving and confirming the assessment and the
assessment rell certified to the City Council on the 19th day of
December, 1932, by the streets and Alleys Committee and the City
Engineer for the costs of the improvement in Local Improvement District
No. 98 in the City of Auburn, in pursuance of Ordinance No. 705,
:po.ssed l]3.y 20,1930, and providing for the disposition and appro-
priation of moneys collected On said assessment.
VlHI!REAS due notice has been given that objections to the
assessment and assessment roll hereinafter mentioned would be
heard and determined by the City Council at the City Hall in the
City of Auburn, ilashington, on the 17th day of January, 1933, at
8: 00 o'clook P. U., at which time the City Council weuld meet to
hear appeals and. objections of any and a.ll persons claiming to be
aggrieved by said a.ssessment: and
WHEREAS the time for fil ing obj ect ions or taking an appeal
has passed and no objections thereto have been SO filed: and
\7HEREAS the City Counc il has carefully examined and c onsid er-
ed such assessment and assessment roll and is now fully advised in the
premises:
No.v THEREFORE, the City Council of the City of Auburn do
ordain as follows:
Section 1. That the assessment a.nd assessment roll certified
to the City Ceuncil on the 19th day of Deoember, 1932, by the streets
and Alleys Committee and the City Engineer of the City of Auburn for
the costs of the improvement of all that portion of C street N. E.,
from Uain street East to the intersection of said C street N. E. with
Auburn Avenue, all in the City of Auburn, Washington, by the grading
a.nd temporary graveling the full width thereof, exclusive of existing
sidewalks, and the doing of other work necessary to properly complete
said improvement, constituting local improvement district No. 98 in
the City of Auburn, in pursuance of Ord inance No. 705 of said city,
passed l.!ay 20, 1930, and the levy and charge of the cost of said
improvement as shown upon said e,ssessment roll and thereby apportioned
upon the adjoining, contiguous and approximate lots and parts of
land specially benefitted, in accordance with the laws of the state
of Washington and Ordinance No. 705 of the City of Auburn, are hereby
approved in all respects, and. the City Treasurer is hereby directed
to collect said assessment t which may be paid without interest, penalty
or costs within thirty (30) daye: after due notice shall have been
given to the owners of the property within said assessment district
by publication in the manner :provided by law, and if said assessments
be not paid within thirty (30) days from the date of first publioation
of said not ic e, the S!'\me shall bear intere st thereaft er at the rate of
7% per annum. .
Section 2. The moneys collected upon said assessment,
approved and confirmed by this ordinance, are hereby ordered to be
placed in Local Improvement Fund, District No. 98, the speCial fund
created by Ordinance no. 705, and all warrants drawn and bonds issued
for the payment of said improvement she.ll be issued on and payable
only out of said local improvement fund.
section 3. This ordinance shall take effect and be in force
five days from and after its passage, approval and publication as
