HomeMy WebLinkAbout0740 , . : ~..,. . . . ~ ,., 7 tf---tf ORDINANCE NO. * AN ORDINANCE to provide revenue and imposing and previdin~ for the cellection of an annual license not exceeding Two Dollars($2.00) on every dog owned or harbored within the limits of the City of Auburn, providing for the killing of all dogs not duly licensed fO\l.nd at large within the limits of said city and prescribing a penalty for permittUg any female dog to run at large within the limits of said city when in heat. _ __' VlliEREAS Section 9127 of Remington's Compiled Statutes of Washington gives and grants to a city council of a city of the third class power "to impose and collect an annual license not exceeding Two Dollars on every dog owned or harbored within the limits of the city; to prohibit dogs running at large and to Pf_Qvidefor the killing of all dogs not duly licensed found at large"; NOW THEREFORE, The City Council of the City of Auburn do ordain as follows: Section 1. That there is hereby imposed and shall be collected an annual license of One Dellar ($1.00) on every male dog or:spayed female dog owned or harbored within the limits of the City of Auburn; and there is hereby imposed and shall be collected an annual license of Two Dollars ($2.00) on every unspayed female dog owned or harbored wi thin the limi ts ef said ci ty. Section 2. That it .hall be the duty of every owner of any dog or having possession of any dog or harboring any dog within the corporate limits ef said city to procure from the City Clerk the license herein provided for; and that the termination of such license shall be at the end of the calendar year in which such license shall be issued. Section 3. That on payment to the City Clerk of the amount of said license fee or tax it shall be the duty of the City Clerk\of the City of Auburn to issue a license to the person applying for the same, which license shall remain in force for one year from and after the first day of January in the year in which such license is issued and not lenger. Such license shall be denominated a "dog license". The City Clerk shall furnish and provide to each licensee a metal tag and upon such tag shall be the inscription "AUBURN" tegether with the year in which the license is issued and the number corresponding with the number of the license; and that such tag shall be appended to and at all times kept upon a; cellar which the owner of such dog or the per- son having possession of or harboring such dog shall pre vide and place and at all times keep upon the neck of the dog se licensed. Section 4. That it~shallbe the duty of the City Clerk to keep a list of the names and addresses of all persons to whom such licenses are issued with the number and character of the license issued to each person. Section 5. That all dogs owned or harbored within the limits of the City of Auburn, not having thereon a collar and license tag as here- in provided, are hereby declared to be a public nuisance, and that it shall be the duty of the Chief of Police of the City of Auburn, or some other person by him appointed for that purpose to distrain and impound all such dogs; and that the Chief of Police of the City of Auburn or any police officer of said city or any person appointed by the Police Department of said city to enforce the provisions of this ordinance may in his discretion kill forthwith all dogs not licensed as herein provided and found r\l.nning at large within the limits of said city. f ('l {. . , :1 ,~ Section 6. That the Chief of Police or any police officer of the City of Auburn or any person authorized ~y the Police Department of said city to enforce the provisions of this ordinance may in his discretion keep any dog distrained or impoundedlas herein provided for a period ef forty-eight (48)" hours, at the end of which period it shall be discretionary with the person so distraining or impounding such deg whether he will sell such dog in an effort to defray the expenses of keeping it, or to kill it. Sectien 7. That any owner or keeper of a dog so impounded and not killed as hereinbefore provided may redeem the same within 48 hours after the d1str~ining_or_~mppunging of the same as herein provided by paying to the City Clerk the prescribed license tax together with a penalty of One Dollar ($1.00) and obtaining from the City Clerk a license in the manner above prescribed, and that upon the presentation of such license, also license tag and collar as herein provided, together with a receipt for payment of such penalty of $1.00 as aforesaid to the Chief of Police or other. proper officer, the dog so ddstrained or impounded shall be released. - Section 8. That all moneys received for licenses issued as herein provided shall be paid at once into the City Treasury of the City of Auburn; and that all moneys received from the sale of dogs or on account of penalties as herein provided shall be paid into the City Treasury of said city. Section 9. That it shall be the duty of the Chief of Police or other police officer or person authorized by the Police Department to enforce the provisions of this ordinance to cause all dogs impounded under the provisions of this ordinance and not forthwith killed as herein provided to be fed and treated in a humane manner while so impounded. Section 10. That if any dog shall have been distrained or impounded under the provisions of this ordinance for a period of 48 hours, it shall be the duty of the Chief of Police or other police officer of the city of Auburn or other person duly autherized by the Police Department of the City of Auburn to at once kill such dog in case he shall deem it improbable that the same can be sold for the sum of $2.00. Section 11. That any owner or person harboring or keeping any female dog who shall permit the same to run at large when in heat within the corporate limits of the City of AUburn, notwithstanding such person may have a license for such female dog as herein provided, shall on conviction thereof, for each and every such offense be fined in any sum not exceeding Twenty Dollars ($20.00) to which may be added the costs of prosecution. Section 12. That if any owner or person harboring or keeping any dog shall permit such dog to wear a collar a license tag without the license tax herein imposed having been paid-and a license procured as herein provided, such person shall be deemed guilty of a misdemeanor and, on conviction thereof, for each and every such effense, shall be fined in any sum not exceeding Twenty Dollars ($20.00), to which may be added the costs of prosecution. Section 13. That if any provision contained in this ordinance shall be held to be invalid or unconstitutional, such holding of invalidity or unconstitutionality shall not affect or impair the remaining previsions of this ordinance. Section 14. That ordinances numbered 110, 211 and 266 of the ordinances of the City of Auburn are hereby repealed. ,.", , .~ .i. " ..j.' . ~ ~ .. .'1 Section 15.
