Lewis called the meeting to order at 7:30 p.m. and led those in attendance in the Pledge of Allegiance. Roll Call Mayor Lewis and the following Councilmembers were present: Rich Wagner, Sue Singer, Nancy Backus, Bill Peloza, Lynn Norman, Virginia Haugen, and John Partridge. Staff member present included: City Attorney Daniel B. Heid; Information Services Director Lorrie Rempher; Risk Manager Rob Roscoe; Acting Planning and Development Director Kevin Snyder; Public Works Director Dennis Dowdy; Chief of Police Jim Kelly; Police Department Secretary Kathy Emmert; Police Sergeant Brian Williams; Deputy Police Chief Bob Lee; Principal Planner Elizabeth Chamberlain; Parks, Arts and Recreation Director Daryi Faber; Finance Director Shelley Coleman; Visual and Public Arts Coordinator Maija McKnight; and Deputy City Clerk Cathy Richardson. A. Announcements and Appointments 1. Announcements a) Letter of Commendation Chief of Police Jim Kelly presented Sergeant Brian Williams a Letter of Commendation for his leadership role in fund raising efforts for Special Olympics Chief of Police Kelly read the letter of commendation for Sergeant Williams for his leadership role in fund raising efforts, conducting community events, and increasing community awareness for Special Olympics on behalf of the City of Auburn. Sergeant Williams' efforts were instrumental in raising over Page 1 Citv of Auburn Council Meetinq Minutes Februarv 1, 2010 $153,600. Since his involvement, the Auburn Police Department has twice been the top fund raising law enforcement agency in King County and was ranked number three overall for all law enforcement agencies in the State of Washington in 2007 and 2008. Chief Kelly stated that by his actions, Sergeant Williams demonstrated the core values of the Auburn Police Department; professionalism, respect, integrity, dedication and empowerment. On behalf of the Auburn Police Department, Mayor Lewis, and City Councilmembers, Chief Kelly congratulated Sergeant Williams and presented him with the Command Coin for Excellence in Service. Mayor Lewis commended Sergeant Williams' outstanding efforts on behalf of the Special Olympics of Washington and the City of Auburn Police Department. Sergeant Williams expressed his gratitude to the many volunteers involved on his team and thanked Mayor Lewis, Chief Kelly, and Councilmembers for the honor of receiving the commendation. b) Veterans Outreach Presentation Presentation by Valley Cities Counseling and Consultation Veterans Outreach Specialist Joshua Penner. Mr. Penner thanked Mayor Lewis and Councilmembers for the opportunity to share his presentation. Mr. Penner commended the City of Auburn for their outstanding support of the veteran community and spoke regarding the positive impacts the support of the City of Auburn and other cities within King County has gamered for veterans. In November 2005, voters approved a$13.3 million King County Veterans and Human Services annual levy to implement services for veterans, their families, and other low income residents throughout King Page 2 Citv of Auburn Council Meetinq Minutes Februarv 1. 2010 County through year 2011. Mayor Lewis has been a great champion for the support of veterans and the work the levy enables. The levy directly funds Valley Cities Counseling and Consultation Veterans Outreach Program which provided assistance to over 130 veterans and their families in 2009. In cooperation with other charitable and veterans services agencies, some of the assistance provided by Valley Cities Counseling and Consultation Veterans Outreach included obtaining discharge paperwork; job placement; education assistance; transitional and permanent housing; upgrading discharge types; emergency assistance funding; enrollment in Veterans Administration services; upgrading disabilities; post-traumatic disorder identification, training and treatment; and other military related traumatic brain injuries. Mr. Penner reported that efficiency in treatment has improved through greater networking among federal, state, county, and municipal governments and other local agencies. The levy has provided an opportunity for Valley Cities Counseling and Consultation to provide necessary, ground-breaking, and leading- edge services to the veterans of King County. Mayor Lewis stated that he and former Mayor John Wise worked to reinstitute the Veterans Levy to ensure that services are provided to veterans in King County. c) Proclamation - "Arts Day" Mayor Lewis read the proclamation and declared February 2, 2010 as "Arts Day" in the city of Auburn. Mayor Lewis presented the proclamation to City of Auburn Arts Commissioners Nancy Colson and Leslie Moore. Mayor Lewis stressed the importance of arts in a community, especially during distressed times, as they reflect the soul and creative spirit of every community. Page 3 Citv of Aubum Council Meeting Minutes Februarv 1, 2010 Ms. Moore stated that she is the current chair of the Auburn Arts Commission. Ms. Moore reported that that those involved in the arts from various communities and schools will be visiting legislators in Olympia on "Arts Day" in order to convey the importance of arts. Ms. Moore thanked Mayor Lewis and Councilmembers for their strong support of the Auburn Arts Commission. Ms. Colson, former chair of the Auburn Arts Commission, spoke regarding the Auburn Symphony Orchestra which has been in Auburn since 1996. Ms. Colson reported that the Symphony perFormance on February 21, 2010 will be broadcast live on the classical radio station KING FM. This is a real coup for Auburn as they only broadcast orchestras of exceptional quality such as the Seattle Symphony, Pacific Northwest Ballet, and Northwest Symphonieta. Ms. Colson urged citizens of the Auburn community to attend the performance as a show of support for the arts. Mayor Lewis pointed out that the Auburn Symphony Orchestra is the largest symphony orchestra, outside of Seattle, in the State of Washington. d) Government Finance Officers Association- Certi£cate of Achievement for Excellence in Reporting Mayor Lewis reported that the Auburn Finance Department once again received a Certificate of Achievement for Excellence in Reporting for the City of Auburn Comprehensive Annual Financial Report (CAFR) from the Government Finance Officer Association. Mayor Lewis thanked Director Coleman and Finance Department staff for a job well done. e) Holy Family Catholic School - Student Body Officers Holy Family Catholic School Principal Dan Hill introduced the school's eighth grade student body officers: Page 4 CiN of Auburn Council Meetinq Minutes Februarv 1, 2010 Elisa Messina, Secretary Mitchell Schelling, Vice President Sophie Nelson, President Sarah Santos, Treasurer Principal Hill reported that the students are studying local government functions and hope to also visit legislators in Olympia to learn more on the processes for adopting, interpreting, and enforcing laws. f) Boy Scout Troop 448 from Renton Mayor Lewis reported that members of Boy Scout Troop 448 were in attendance this evening as a requirement to meet with a civic leader in an effort to earn a First Class Scout ranking. Sue Hearron, niece of Councilmember Peloza, stated that she served as committee chair for five years for Troop 448. Ms. Hearron introduced parents and - troop members in attendance: Julie Blue, Troop Treasurer Jim Andrews, Troop Leader Dillon Howard, Member Mason Andrews, Member Brennan Whiting, Member Scotty Hearron, Member Jordan Blue, Member Ms. Hearron also reported on a troop event called "Cold FeeY" which is a camp-out in tents near Mount Rainier. The troop members build a snow-cave and are given a challenge that any two members spending the entire night in the snow-cave would be given a special award. The challenge was accepted and met by Scotty Hearron and Brennan Whiting. 2. Appointments There were no appointments for Council consideration. B. CITIZEN INPUT, PUBLIC HEARINGS 8 CORRESPONDENCE A. Public Hearings No public hearing was scheduled for this evening. B. Audience Participation This is the place on the agenda where the public is invited to speak to the City Council on any issue. Those wishing to speak are reminded to sign in on the form provided. • No one in the audience requested to speak. C. Correspondence There was no correspondence for Council review. III. COUNCIL COMMITTEE REPORTS A3.7.6 A. Municipal Services Chair Peloza reported that the Municipal Services committee met January 25, 2010 at 4:00 p.m. The Committee discussed and recommends approval of Resolution No. 4560 for a COPS grant. The Committee also discussed an Interlocal Agreement for grant funds from the Department of Ecology. Discussion of vehicle towing was postponed. The next regular meeting of the Municipal Services Committee is scheduled for February 8, 2010 at 4:00 p.m. B. Planning 8 Community Development Chair Norman reported that the Planning and Community Development Committee met on January 25, 2010 at 5:30 p.m. In attendance at the meeting were students from a Green River Community College environmental class in an effort to fulfill class requirements. The Committee discussed and recommends approval of Resolution No. 4558. The Committee also discussed Ordinance Nos. 6287 and 6218, Resolution Nos. 4559 and 4567, fee schedule revisions for storm water permits related to the National Pollutant Discharge Elimination System (NPDES), and the Auburn Environmental Park amendments. The next meeting of the Planning and Community Development Committee is scheduled for February 8, 2010 at 5:00 p.m. C. Public Works . Chair Wagner reported that the Public Works Committee met this afternoon at 3:30. The Committee approved a right-of-way use permit, Engineering Design Standards revisions, and a contract Page 6 Citv of Auburn Council Meetinq Minutes Februarv 1, 2010 administration item to approve a consultant agreement for engineering services on the West Valley Highway Improvements project. The Committee also discussed and recommends approval of Ordinance No. 6218 and Resolution Nos. 4559 and 4566. The Committee also discussed and approved a water leak adjustment for a single family residence, postponement of a gateway sign in the Lake Tapps area due to budget constraints, and capital project status. The next regular meeting of the Public Works Committee is scheduled for February 16, 2010 at 3:30 p.m. D. Finance Chair Backus reported that the Finance Committee met this evening at 6:30. The Committee discussed and recommends approval of claims and payroll vouchers and Ordinance No. 6287. The Committee also discussed Resolution Nos. 4560, 4561, 4564, and the seventh amendment to a purchase and sale agreement with the Auburn Regional Medical Center related to parking. The next regular meeting of the Finance Committee is scheduled for February 16, 2010 at 6:30 p.m. E. Community Center The Community Center Committee has not met since the last City Council meeting. F. Downtown Redevelopment Chair Norman reported that the Downtown Redevelopment Committee met on January 26, 2010 at 4:00 p.m. to discuss Downtown Urban Center Design Standards. The Committee used two major projects constructed in the downtown core to measure the effectiveness of current standards. The next meeting of the Downtown Redevelopment Committee is scheduled for February 9, 2010 at 4:00 p.m. IV. REPORTS At this time the Mayor and City Council may report on significant items associated with their appointed positions on state, regional and local organizations. A. From the Council Deputy Mayor Singer reported that she attended a Suburban Cities Association meeting which provided an opportunity to network with other elected officials and also to meet, King County Executive Dow Constantine. Page 7 Citv of Auburn Council Meetinq Minutes Februarv 1, 2010 Councilmember Wagner reported that he testified at the House of Representatives Transportation Committee on behalf of the Association of Washington Cities regarding street maintenance utility legislation. He also attended the Public Arts Committee meeting, which is a sub-committee of the Arts Commission, to discuss design of a climbing wall security gate to be installed at the new Community Center. He also attended the Association of Washington Cities Legislative Day in Olympia to hear from Governor Gregoire regarding budget cuts. Councilmember Partridge reported that he attended the Miss America Pageant in Las Vegas, Nevada, at which his daughter, Devanni, was one of fifty-three contestants. Although she was not selected by the judges as one of the top fifteen contestants, she was honored to be nominated by her peers as one of the top twelve contestants. She will continue her education and also her community service efforts in the Auburn community. Councilmember Backus and over one-hundred supporters from Auburn attended the event. Councilmember Partridge also attended the Suburban Cities Association meeting to attend a program called "Jurassic ParliamenY" for a review of parliamentary procedure. He also attended, via teleconference, a Regional Law, Safety, and Justice Committee meeting. Councilmember Norman reported that she attended "Uniquely Auburn" at which she accepted a check presented by the Auburn School District elementary and middle school students for the Barrier Free Playground in the amount of approximately $1,500. The students began collecting donations in October 2009. Councilmember Norman commended students for their generosity and hard work. Mayor Lewis stated that Councilmember Norman has been a proponent for the Barrier Free Playground since its conception in 2009. Mayor Lewis commended the efforts of Councilmember Norman and thanked her for her outstanding work and representation. The Barrier Free Playground is slated to open in late Spring 2010. Councilmember Backus reported on the Miss Auburn Scholarship Program of which there are twenty-two contestants. The Miss Auburn Scholarship Program is the largest local scholarship program in the nation affiliated with the Miss America organization. Councilmember Backus invited the community to attend the Miss Page 8 CiN of Auburn Council Meeting Minutes Februarv 1. 2010 Auburn Pageant on February 4-5, 2010 at 7:30 p.m. at the Auburn Performing Arts Center. Councilmember Peloza reported that he attended the King County Water Pollution Abatement meeting to discuss the King County Waste Water Treatment Division 2009 annual report and 2010 sewer rates, which will remain the same. He also attended a Water Resource Inventory Area meeting (WRIA 9) to discuss Green and Duwamish rivers, aquatic restoration projects in unincorporated King County agricultural areas, and changes in the watershed eco- system forum. B. From the Mayor Mayor Lewis reported that he attended the United States Conference of Mayors in Washington DC at which he met with Senator Patty Murray and Congressmen Reichert and Smith to discuss ongoing projects in Auburn such as the M Street Underpass project and Valley Cities Fiber Optic project. The mayors were also presented an opportunity to meet with President Obama to speak one-on-one regarding aging infrastructures across the United States and jobs programs. They discussed means to fund monies directly to cities in an effort to maintain infrastructures and reduce unemployment. Mayor Lewis was also presented an opportunity to speak with other cabinet officials on a variety of issues. Mayor Lewis reported that he participated in the interview process with Miss Auburn contestants. He also attended a meeting with Auburn Superintendant of Schools, Kip Herren, to discuss forthcoming innovative programs being developed by school principals. He also attended meetings of the Association of Washington Cities, Puget Sound Regional Council, South Correctional Entity (SCORE), and Valley Cities Association. He also met with Pierce County Executive Pat McCarthy in an effort to organize a joint meeting with King County Executive Dow Constantine to discuss repair of the freight corridors in the Puget Sound Region. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Ordinance No. 6287 03.0 An Ordinance of the City Council of the City of Auburn, Washington, amending Chapter 2.25 of the Auburn City Code relating to the Planning and Community Development Department Councilmember Backus moved and Councilmember Norman seconded to introduce and adopt Ordinance No. 6287. MOTION CARRIED. 6-1. Councilmember Haugen voted no. 3. Ordinance No. 6292 03.8 REZ09-0004 An Ordinance of the City Council of the City of Auburn, Washington approving the request of Jacob Amy for a rezone from R-20 Residential 20 DU/Acre to C-3 Heavy Commercial to implement the Comprehensive Plan and amending the City's Zoning Maps accordingly Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6292. Resolution No. 4558 04.11 A Resolution of the City Council of the City of Auburn, Washington, authorizing the Mayor and City Clerk to execute an Interlocal Agreement between the City of Auburn and the Department of Army for design of the Mill Creek Wetland 5K Restoration Project Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 4558. MOTION CARRIED UNANIMOUSLY. 7-0. 3. Resolution No. 4560 F5.2.10 A Resolution of the City Council of the City of Auburn, Washington, approving and authorizing the Mayor to accept a grant from the United States Department of Justice, Office of Community Oriented Policing Services (COPS) Councilmember Peloza moved and Councilmember Singer seconded to adopt Resolution No. 4560. Resolution No. 4565 03.5 PLT06-0008 A Resolution of the City Council of the City of Auburn, Washington, approving a preliminary plat application to subdivide 10 acres into 30 lots and three tracts for wetlands and buffers, open space, and utilities with three deviation requests and one plat modification within the City of Auburn, Washington Councilmember Norman moved and Councilmember Backus seconded to adopt Resolution No. 4565. MOTION CARRIED UNANIMOUSLY. 7-0. IX. EXECUTIVE SESSION At 8:40 p.m., Mayor Lewis recessed the meeting for a five minute intermission and then to executive session for approximately ten minutes to discuss pending/potential litigation pursuant to RCW 42.30.110(1)(i). Staff members required for the executive session were: City Attorney Heid, Public Works Director powdy, Acting Planning Director Snyder, Finance Director Coleman, and Risk Manager Roscoe.
