Lewis called the meeting to order at 7:30 p.m. and . led fhose in attendance in the Pledge of Allegiance. B. Roll Call Councilmembers present: Rich Wagner, Nancy Backus, Sue Singer; Bill Peloza, Lynn Norman; Virginia Haugen, and John Partridge. Directors and staff members present included: Assistant Police Chief Bob- Karnofski; City Attorney Daniel B. Heid, Public Works Director Dennis Dowdy, Finance Director Shelley Coleman, Planning and Dev.elopment Director Kevin Snyder, Economic Development Manager poug Lein, Parks, Arts and Recreation . Announcements and Appointments 1. Announcements a) Suburban Cities Association (SCA) Update Presentation provided by Karen Goroski, SCA Executive Director and 2011 SCA Board President/Lake Forest Park Mayor Dave Hutchinson. Karen Goroski, Executive Director for the Suburban Cities Association, presented Mayor Lewis a comrime_ morative clodc in recognition :of his service and outstanding leadership fo the Suburban Cities Page 1 Citv of Auburn Council Meetina Minutes Aaril 4. 2011 Association. Mayor Lewis has, served as chair of the SCA Public Issues Committee, member of the SCA Board, vice president, president, and imrnediate; past president of the Board. Ms.; Goroski distributed copies of the SCA Annual Report. for 2010. Ms. Goroski referred to the SCA - - long range goals through 2015, the SCA organizational chart, and the Strategic Plan for Public Transportation 2011-2021. The SCA serves as the appointing authority for 28 regional boards and committees. Ms. Goroski thanked the Mayor and City Councilmembers fortheir service on SCA committees and noted the following current membership: • Mayor Lewis Vice Chair of the Regional . policy Committee; Puget Sound Regional Council Executive Board • Deputy Mayor Singer - Puget Sound Regionat Council Economic Disfrict Board member • Councilmember Norrnan - Growth Management Policy Board for the Puget Sound Regional Council • Councilmember Partridge - Regional Law; ' Safety and Justice Committee • Councilmember Peloza - Regional Water Quality Committee Mayor Lewis reported that the City Council also , participates in many Pierce County, state and national , committees and commended their efforts on behalf of the City of Aubum. b) Proclarnation - "SignW1cant Tree Designation" Mayor Lewis and Parks, Arts and Recreation Director Faber presented a proclamation to Cemetery Supenrisor Craig Hudson declaring him the 2011 Tree Steward for preservation of the Copper Beecli free located at the Mountain View Cemetery at 2020 Mountain View Drive, and declaring the Copper Beech tree a"Significanf Tree" in the city of Auburn. Page 2 Citv ofAubum Council Meetina Minutes Aaril 4, 2011 Bruce Landrud, member of the Auburn Urban Tree Board, added that the Cooper Beech is a stunning tree and a great representation for the City. c) Proclamation - "Nationa/ Vo/unteer Week" Mayor Lewis presented a proclamation declaring the.. week of April 10-16, 2011 as National Volunteer Week in the city of Aubum to Senior Center . Supervisor Radine Lozier. Mayor Lewis urged all' • citizens to recognize volunteers for the contributions they have made to ttie community. Senior Center Supervisor Lozier reminded that the Senior Center will host a volunteer luncheon on Aprit 14th- where non-profit organizations can b(ng their volunteers to be recognized. d) Proclarnation -"YMCA Healthy Kids Day" Mayor Lewis read and presented a proclamation declaring April 16, 2011 as YMCA Healthy Kids Day in the city of Aubum to Aubum Valley YMCA Executive Director Jason Berry and Aubum Valley - YMCA Board Members Nancy Colson and Mike Newman. Aubum YMCA Community Outreach Coordinator Amy Jahn urged everyone to attend this year's event which is pirate themed. Many special guests will be in attendance including the Seafair Pirates. e) Proclamation - "We/come Home Vietnam Veterans Month" Together with Councilmember Peloza, Mayor Lewis read a proclamation declaring the month of ApriF 2011, .the. 36th anniVersary of the end of the American involvement in the Vietnam War, ~as Welcome Home Vietnam Veterans Month in the city of Aubum. Mayot Lewis, a Vietnam War veteran, and Councilmember Peloza, .Commander for the Veterans of Foreign Wars Post 1741, were joined by American Legion member Roger Olsen, Veterans of' Foreign Wars member Jack Anderson, Skip Drebs from the Association of Washington Generals, and other Vietnam War veterans from the audience including - Page 3 Citv of Aubum Council Meetina Minutes Aaril 4. 2011 City employees Dan Heid, Chuck Joiner, and Jeff Mclntyre. Mayor Lewis urged all citizens to acknowledge and - thank Vietnam Veterans for the vast sacrifices and confributions to their nation and community. . Mr. Drebs, a Board member for the Association of Washington Generals, thanked the Mayor for his recognition and support of the veterans and described Auburn as Washington's home of the - Vietnam Veteran. Mayor Lewis recognized City employee, Jeff Mclntyre, as the person responsible for getting the POWMIIA . flag flying throughout the state. 2. Appointments a) Acts Commission City. Council to confirm the reappointment of Linda Elliott to the Arts Commission : to a ferm expiring December 31, 2011. Deputy Mayor Singer moved and Councilmember Wagner seconded to confirm the reappointment of Linda Elliott to the Arts Commission. MOTION CARRIED UNANIMOUSLY. 7-0. D. Agenda Modifications Agenda modifications included the transmittal of Councilmernber Haugen's rebuttal:statement to Resolution No. 4699 and a revision tothe agenda bill for Ordinance No. 6358. II. CITIZEN INPUT, PUBLIC HEARINGS 8 CORRESPONDENCE , A. Public Hearings. 1. Vacation Application Number V1-10 03.9 V1-10 City Council to conduct a public hearing on a petition for a proposal to vacate the right=of-way along 3Street NE between E Street NE on the west end and Auburn School Page 4 Citv of Auburn Council Meeting Minutes Apri14, 2011 District Parcel No. 1821059082 on the east end in the City of : Auburn and legally described in Resolution No. 4685. Engineering Aide Amber Mund presented an overview of the , Auburn School District's petition for vacation of approximately 19,068 square feet of right-of-way located east of E St-reet NE. The majority of tlie right-of-way was dedicated in 1`921 through plaf dedication; a small portion of right-of-way was deeded to the City by quit claim in 1927 for public street purposes at no cost to the City. The Auburn School District proposes to use,the right-of-way to facilitate redevelopment and expansion of adjacent properties and facilities owned by the District. City, staff recommends approval of the vacation with reservation of easements for utilities and public access, and provided the District take ownership of the storm drainage facilities located within the proposed vacated area. Compensation for the vacation would not be required since the City acquired the property at no cost. ` Vacation of, the property would benefit the City by reducing the City's. maintenance obligation for storm drainage and street facilities. Mayor Lewis opened the hearing at 8:21 p.m. There being no public comment, the hearing was closed. (See Item VIII.A.1, Ordinance No. 6350, for additional documentation and further action on this item.) B. Peloza reporfed the Municipal Services Committee met March 28, 2011. The Committee reviewed Ordinance No. 6354 relating to solid waste rates and discussed Resolution No. 4691 relating to a loan from the Cumulative Reserve Fund to the Golfi _ Course Fund, Ordinance No. 6352 regarding a budget amendment, Ordinance No. 6346 related to speed limits in school zones, Resolution No. 4695 accepting a grant from 4Culture, the Aubum Police Chaplains Program, and the Committee matrix. The next regular meeting of the Municipal Services Committee is scheduled, for April 11, 2011 at 3:30 p.m. B. Planning & Community Development Vice Ghair Backus reported the Planning and Community Development Committee met March 28, 2011. The Committee discussed Ordinance No. 6352 approving a budget amendment, ' tree regulations and penalties #or removal of trees,. zoning regulations related to brew pubs, site plan review process and procedures, King County Countywide Planning Policies affordable . housing targets, cottage housing. regulations, and the Kendall Ridge final plat; The Committee also held an executive session to discuss pending/potential litigation. The next regular meeting of the Planning and Community Development Committee is scheduled for April 11, 2011 at 5:00 p.m. C. PubEic Works Chair Wagner reported the Public Works Committee met this afternoon at 3:30 p.m. The Committee approved award of contracts for Project No. GP1004, the South Aubum ITS Expansion, and Project No. CP1006, the Lakeland Hills Reservoir. The Committee discussed the utility billing process and policy, a. water leak adjusfinent that was withdrawn, Ordinance No. 6346 relating to speed limits _in school zones, water wells in the area of ' - Fulmer Field, and: the Green River levee sandbag removal schedule. The next regular meeting of the Public Works Committee, is scheduled for April 18, 2011 at 3:30 p.m. D. Finance Chair Backus reported the Finance Committee met this evening at 6:00. The Committee, approved claims and payroll vouchers, Ordinance No. 6352 approving a budget amendment, and Page 6 Citv of Auburn Council Meeting Minutes Aaril 4. 2011 Resolution. The . next regular meeting of . the Finance Committee is scheduled for April 18, 2011 at 6:00 p.m. - E. Les Gove Communify Campus Committee Chair Wagner reported that the Les Gove Community Campus Committee has not met since the last Council meeting. F. Downtown Ftedevelopment Chair Norman reported that the Downtown Redevelopment Committee will meet April 12, 2011 at 4:00 p.m. G. Council Operations Committee Chair Wagner reported the Council Operations Committee met March 29, 2011. The Committee discussed planning for the Council retreat, which will be held May 12-13, 2011. The Committee also reviewed .Council Committee responsibilities and Resolution No. 4699 relating to the conduct of. Councilmember Haugen. The next meeting of the Council Operations Committee has not been scheduled. IV. REPORTS At this time. the Mayor and City Council may report on significant items associated with their appointed positions on state, regiona/ and /ocal organizations. - A. From the Council Deputy Mayor Singer attended a regional emergency management planning meeting on behalf of Mayor Lewis and participated in discussions with a'private developer who wants to bring a clean technology employment and commercialization center to Auburn. Councilmember Partridge reported on his attendance at the Suburban Cities Association meeting where Congressman Inslee spoke on energy and the environment. Councilmember Partridge also attended a neighborhood addressing meeting, a Regional Law, Safety and Justice Committee meeting, the Lions Club annual dinner auction, and several meetings of the Aubum -Valley Humane Society. Councilmember Backus reported that she and Councilmember Norman attended the Cascade Middle School leadership class, Page 7 Citv of Auburn Council Meetinst Minutes Aaril 4. 2011 where they spoke to a group of seventh grade students regarding leadership. Councilmember Backus also reported on her attendance at the Aubum Noon Lions Club benefit auction. Councilmember Peloza reported on his attendance at the King County Water Pollution Abatement Advisory Committee where discussion included. the Metro sewer. rates. Councilmember Peloza also reported on his attendance at a meeting of the Lower Green River Subcommittee meeting where discussion focused on a drainage problem on West Valley Highway in the vicinity ofi 277tn . Street. The drainage problem may be due to a plugged or collapsed culvert. , King County, and the City are working cooperatively on the issue. Councilmember Peloza also reported that he met with representatives of Sound Transit and Metro on a proposal to vacate buses from Sound Transit plaza during the Auburn Intemational Farmers Market days. The Market's season begins June 12, 2011. Councilmember Haugen thanked_ staff and Directors Dowdy and Coleman for their presentations today at the Public Works Committee. B. From the Mayor Mayor Lewis reported on his meetings with a number of non-profit organizations in the city regarding reduced human services funding and the need fo form new partnerships to ensure that essential programs continue. Mayor Lewis reporfed that it is anticipated that the state and King and Pierce Counties will be drastically reducing their human services funding. Mayor Lewis also commented on the City's altematives to incarceration program and the veterans " 1evy designed to assist returning veterans. V. CONSENT AGENDA All matters listed on the Consent Agenda are considered by the City Council to be routine and will be enacted by one motion in the form listed. A. Minutes . 1. Ordinance No. 6350 03.9 V1-10 ' An Ordinance of the City Council of the City of Aubum, - Washington, vacatin~g right-of way of :3'd Street NE between 2"d Street NE and 4t Street NE, "east of E Street 'NE, within the City of Auburn, Washington Councilmember Wagner moved and Councilmember Peloza seconded to introduce and adopt Ordinance No. 6350. Councilmember Wagner stated that the proposal vacates a dead-end city street bordered by Auburn School District property. . . Councitmembec Haugen indicated she would vote against the ordinance. MOTION CARRIED. 6-1. Councilmember Haugen voted no. 2. Ordinance No. 6352 F3.23 An Ordinance of the City Council of the City of Aubum, Washington, amending Ordinance No. 6339, the 2011-2012 Biennial Budget Ordinance as amended by Ordinance No. 6351 authorizing amendment to the City of Auburn 2011- 2012 Budget as set forth in Schedule "A" Councilmember Backus moved and Councilmember Norman seconded to adopt Ordinance No. 6352. Councilmember Backus explained that the arnendment cames fonivard project encumbrances from the prior year, . reduces- salaries and beneflfs for certain employee groups continuing furlough days in 2011, and accounts for payroll donations made by Councilmembers back to the City. In response to comments from Councilmember Haugen, Mayor Lewis stated that Council may not reduce oc increase Page 10 Citv of Aubum Council Meetinsi Minutes Aaril 4. 2011 , their salary for their existing term. The Council may reduce or increase the salaries for future Councilmembers. City Attorney Heid. added that state law prohibits the increase or decrease of elected officials salaries during their term. Salaries could be changed for subsequent terms. MOTION CARRIED. 6-1. Councilmember Haugen voted no. 3. Ordinance No. 6358 _ 03.5 PLT08-0008 An Ordinance of the City Council of the City of Aubum, Washington, approving the fnal plat of Kendall Ridge , 9 Councilmember Norman moved and Councilmember Backus seconded to introduce and adopt Ordinance No. 6358 as revised by the agenda.modification. Councilmember Norman advised that the applicant made application to King County for the final plat of Kendall Ridge prior to the annexation of the area to the City of Aubum. The plat already received its preliminary plat approval from King County. MOTION CARRIED UNANIMOUSLY. 7-0. B. Resolutions 1. Resolution No. 4691 F4.7 . A Resolution of the City Council of the City of Aubum, Washington, authorizing the transfer of funds for the purpose of making a loan or loans from the Cumulative Reserve Fund to the Golf Course Fund for up to a finro-year period of time Councilmember Backus moved and Councilmember - . Norman seconded to adopt Resolution No. 4691. Councilmember Backus noted that the loan. to the Golf Course Fund is for up to a finro year period of time for a maximum of $350,000, which will be.paid back with interest. Councilmember Partridge moved and Deputy Mayor Singer seconded to amend the resolution to reflect up to a one year term with a one year renewal term option. Councilmember Partridge spoke in favor of the amendment - explaining that he wants to review the status of the fund after one year and retain the ability to either renew the term of the loan or not. Finance Director Coleman stated that the Golf Course Fund is suffering from the economy and the weather. She estimafed that it may take a season, two seasons or even three seasons for the Golf Course to recover sufficiently. Therefore, the staff recommendation was for a loan for up to two years. Motion to amend the resolution failed 2-5. Councilmembers Wagner, Norman, Backus, Singer and Peloza voted na MOTION TO ADOPT RESOLUTION NO. 4691 PASSED. 5- 2. Councilmembers Partridge and Haugen voted no. 2. Resolutiori No. 4699 A3.6 A Resolution of the City Council of the City of Aubum, Washington, censuring Councilmember Virginia Haugen for failure to comply with the requirements of the City Council Rules of Procedure Councilmember Wagner moved and Deputy Mayor Singer seconded to adopt Resolution No. 4699. Councilmember Wagner explained that censure is an official statement of disapproval or a reprimand. The Council Operations Committee is charged with a number responsibilities including the evaluation and recornmendation to the whole Council on any actions, responses or sanctions for violations of the Council Rules of Procedure. For the past year, the Council Opetations Committee has been evaluating the conduct of Councilmember Virginia Haugen. The Committee provided an opportunity for _ Page 12 Citv of Auburn Council Meeting Minutes Aaril 4. 2011 Councilmember Haugen to respond to the allegations in a meeting of the Committee. Subsequently, the Committee ~ unanimously voted to forward the resolution to the Council for action. Councilmember Haugen requested an opportunity to rebut the resolution this evening. Chair Wagner stated that the allegations have been discussed at a number of Council Operations Committee meetings. Councilmember Wagner stated that Councilmember Haugen was given an opportunity to respond to the allegations at the March 8"' Council Operations Committee meeting. Councilmember Haugen received prior notice and was provided with a copy of the proposed resolution and the supporting documentation relating to the allegations to be discussed at #he March 29"' Council Operations Committee meeting. Ms. Haugen attended the March 29"' Committee meeting and began to rebut each allegation, but became angry and left the meeting after responding to approximately three of the . allegations. The Committee read into the record Councilmember Haugen's printed rebuttal statement for each. allegation. After consideration of the rebuttal statements; one allegation was removed and the remaining were forwarded to the Council for consideration. Mayor Lewis requested that the City Attorney read each allegation contained in Resolution No: 4699, allowing Councilmember Haugen to respond to each allegations as it is read. Allegation 1. Councilmember Haugen testified without City authorization at a March 3, .2010, City of Kent Hearing Examiner hearing on the Verdana development, where the City of Aubum was involved in a lawsuit with the developers, saying, according to the Kent Reporter newspaper: "This development will have a sign ificant'im pact environmentally," potentially weakening the City's position in the lawsuit. This issue had been discussed by Council in executive session several times, as early as November 2, 2009, so she should have been aware of the sensitive legal nature of the Verdana project. While she did not purport to be stating a position of the City Council, but rather her own personal Page 13 Citv of Auburn Council Meetina Minutes Aaril 4. 2011 opinion, her statements might be viewed~ by the others as reflecting her role as a Councilmember. As noted above, this is a re-occucring theme of her conduct. Councilmember Haugen responded that she spoke three times in Kent at hearings. Each time she was with a couple . of different groups in opposition to the project. She stated that at no time did she indicate she was speaking as a .Councilmember; she indicated at the hearing that she was speaking only to-fier own personal views. She stated that she was speaking only to environmental issues. ~ • Allegation 2. In 2010, according to Jeff Tate, City Development Services Manager, he received a call from Satpal Sohal, who had applied foc permits to build a hotel in Aubum. Sohal said that he had received calls from several local hotel operators who told Sohal that Councilmember - Haugen had called one of the local hotel operators to encourage that local hotel operator to oppose Sohal's project. Councilmember Haugen responded that she spoke to one motel owner in Aubum and told. her of some information Counc'ilmember Haugen had regarding the consfruction of a new motel in Aubum. She stated that she did not encourage - - anyone to oppose anything. Allegation 3. In 2010, Councilmember , Haugen communicated with a citizen who had complained to the City _ that the 8th & `R' Street NE project would reduce the safety of her travel, implying that this citizen might file a lawsuit, and Councilmember Haugen was encouraging of the citizen's complaint. Councilmember Haugen responded that she received an email from a woman, which she responded to stating that she- had, the same concems about the project. Councilmember Haugen stated that she did not discuss safety matters with anyone. Her only position on the project _ was about the inconvenience for people who live in the. area and who would not be able to make left hand turns. Allegation 4. In-2010, Councilmember Haugen violated City Council executive session privileged communications with Page 14 Citv of Auburn Council Meetina IlAinutes Aari14. 2011 regard to waste collection contract negotiations in ways that were likely #o interFere with or have potential litigation implications. . Councilmember Haugen stated that someone called her about contract issues. She stated fo the person thaf these types of contcacts should go to bid: She: believes that her ' actions did not affect the outcome of negotiations:` Allegation 5, Councilmember Haugen has largely ignored ~ mentoring by Deputy Mayor Singer with regard fo improving her Councilmember skills through training opportunities and has refused to be certifed in required emergency management training. Councilmember Haugen responded that she was employed by fhe Boeing Company :for sixteen years where she spent time on various safety committees and obtained many safety certificafions including first aid, CPR, small fire control, and evacuation procedures. Councilmember Haugen also stated that when she was required to take the City's emergency management training and failed, she was not given her score. Councilmember Haugen questioned whether she is mandated to take the subject emergency management ~ training. Mayor Lewis stated that the :emergency management training is a series of training and exams that all elected officials and staff are required to complete. Additionally, , according to others who worked at Boeing, certificates usually expire within finrelve to eighteen months. . Deputy Mayor Singer stated that the Council Procedures pcovide that 'Councilmembers take the necessary training. The training is intended to 'instruct participanfs ; on how .to coordinate emergency efforts within the City and within the. region. Allegat'ion 6. In 2009, Councilmember Haugen discussed, with a property owner, the City's plans for use of his property for street 'improvements in the right-of-way at the comer of 8th Street NE and Harvey Road (M Street) undermining the City's real estate negotiations; ' Page 15 , Citv of Auburn Council Meetina Minutes April 4, 2011 Councilmember Haugen stated that at least six people approached her about the. 8"' Street Pr.oject and some expressed concem that a property owner was going to lose some parking spaces. Councilmember Haugen stated she spoke to the property owner, and the property owner showed her the parking spaces" he would lose due to the project. Councilmember Haugen stated that she never spoke fo the property owner about the worth of his property.. Councilmember Haugen stafed that she does not tielieve that she was ever involved in any kind of discussion with anyone that would have changed the outcome of the negotiations. Councilmember Haugen stated the property owner was a very angry property owner. Councilmember Partcidge inquired whether the City was ever directly impacted by any of the allegations. Deputy Mayor Singer stated thaf she believes the City has ' avoided impacts thus far; however, fhere is concern that this type of behavior can lead to very expensive litigation. MOTION CARRIED. 6-1. Councilmember Haugen voted no. IX. EXECUTIVE SESSION At 9:50 p.m. Mayor.. Lewis recessed the meeting for a five minute intermission and fhen to executive session for approximately 20 minutes in order to discuss pending/potential litigation pursuant to RCW 42.30.110(1)(i). City Attomey Heid, Finance Director Coleman, Public Works Director powdy and Planning and Development Director Snyder were requested #o attended the executive session. No action was anticipated as a result of the executive session. Mayor Lewis extended the executive session three separate times for ten minutes each time. At 10:44 p.m. the meeting was reconvened.
