CALL TO ORDER Chair Roland called the special work session to orderat 6:30 p:m. in the Council Chambers located on the first floor of Auburn City Hail, 25 West Main Street, Aubum, WA. Planning Commission Members present were: Chair Judi Roland, Vice-Chair Ron Copple, Commissioner Couture, Commissioner Mason, Commissioner Baggett, Commissioner Smith, and Commissioner Trout. Chair Roland noted that Commissioner Ramey has resigned from the Commission due to time constraints. Staff present included: Planning and Development Director Nancy Welch, Planning Manager Elizabeth Chamberlain, Principal Planner Jeff Dixon, and Planning Secretary Tina Kriss. Members of the audience preserrt:Russ Campbell, Jean Lix, Susie Hauck, Dwight Hauck, Coni S. Orvis, Del Goad, Herbert M. Levin, Sophie M. Levin, Nicole Petrino-Salter, Rudy Terry, Joyce Terry, Roger Lee, Diane Mayer, Dino Mayer, and Lorenna Tippins. A. StudenUReMaI Housing Code Amendments Planning Services Manager Elizabeth Ghamberlain provided a brief review of proposed code amendments related to StudenURental Housing. The Planning Commission and staff reviewed 4he Title 18, Zoning and Title 5, Business and Licenses Regulation amendments. Staffreviewed the proposed amortization schedule and code enforcement action regarding StudenURental Housing. A Communal Residence would permit four (4) or less unrelated individuals to rent from an owner. Renting to more than four(4) unrelated individuals would require the owner to submit a Conditional Use Permit that would require specific criteria and approval. The business license acquired for the student rental would require an annual inspection. The new approach requires the landlord to ensure that tenants are following Aubum City Code, putting more responsibility on the tenant/owner. The Planning Commission asked if staff could add "an individual" within the definition of Communal Residence and staff confirmed the additional language would be added. TFie Commission also recommended staff reference City code regarding noise and other public nuisances. Since the proposed code amentlmerit wilF be forcity-wide rentalsthe Pfanning Commission recommended staff remove the reference "studerits" on page 10, 1.C., Ms. Chamberlain confirmed she would make that change. PLANNING COMMISSION MEETING MINUTES August 20, 2012 The Commission and staff discussed the total number of unrelated individuals allowed to live in a Communal Residence and the amortization period used for compliance to the new proposed amended code. B. C-1, Light Commercial Zone,Amendments Planning Services Manager Elizabeth Chamberlain provided the staffreport for the C-1, Light Commercial Zone, Mixed Use Code Amendments and reviewed the proposed amendments using a tiered approach and sliding scale. The Commission and staff discussed and reviewed elements of the appraach. The Planning Commission had no questions. II. ADJOURNMENT There being no further business to come before the Planning Commission for this Special Work Session, Chair Roland adjourned the special work session at 6:54 p.m. I. ROLL CALLIESTABLISHMENT OF QUORUM Planning Commission Members present were: Chair Judi Roland, Vice-Chair Copple, Commissioner Coutwre, Commissioner Mason, Commissioner Baggett, Commissioner Smith, and Commissioner Trout. Staff present included: Planning and Development Director Nancy Welch, City Attomey Dan Heid, Planning Manager Elizabeth Chamberlain, Principal PlannerJeff Dixon, and Planning Secretary Tina Kriss. May 7, 2013 Cammissioner Copple moved and Commissioner Trout seconded to approve the minutes from the May 7, 2013 meeting'as written: MOTION CARRIED UNANIMOUSLY.7-0 B. June 18, 2013 Staff noted a scriveners error corcecting the spelling of Administrative on page one, paragraph II. Roll Call. Commissioner Copple moved and Commissioner Smith seconded to approve the minutes from the June 18, 2013 meeting as amended. PUBUCCOMMENT There were no public comments on any item not listed on the agenda for discussion or public hearing. V. PLANNING DEPARTMENT REPORT Planning Services Manager Elizabeth Chamberlain provided the following updates. The City's new Planner, David Jones, will be starting September 3, 2013. A Request for Qualifications was.sent out August 13, 2013 for the City's Comprehensive Plan update for the visioning process. The proposal to review is due September 3, 2013; staff will then be reviewing the submittals and making a consultant selection to begin the visioning process that will assistthe City in formulating the new comprehensive plan updates. VL PUBLIC HEARING A. ZOA13-0003 Student-Rental Housing Code Amendments* (Chamberlain) Chair Roland opened the public hearing at Z:05 p.m. for ZOA13-0003, StudenURental Housing proposed code amendmerrts to Tdle 5 and Title 1 B. Planning Services Manager Elizabeth Chamberlain provided the staff report on ZOA13- 0003. A brief review was provided regarding the code amendmer�ts. Ms. Chamberlain stated that staff has met with Green River Community College (GRCC) and they are supportive of the City's proposed code amendments regarding StudenVRental Housing. Ms. Chamberlain reported that the term "minors" previousty requested by the Planning Commission was removed since GRCC addresses children under the age of 18 within their program and they also regulate the program. A reference the City's code regarding the "curfew of minors" was added to the proposed amendments along with the City's coile enforcement Title 5 requirements. Amoritization sohedule language was added requiring existing Communal Residences 6 months to 6ecome compliant with 4he regulations outlined in Title 18 and Title 5. Language was added to the City's business license forms so thaY more responsibility will be taken by the landlord to inform the tenant of the City code requirements. If the landlord is not adheringto the regulations the rental license can be defaulted. Chair Roland invited members of the audience forward for publiacomment on ZOA13- 0003, Title 5 and Title 18 related to StudenURental Housing: Russ Campbell, 31606 126`"AVE SE, Auburn. Mr. Campbell expressed his concem should the City decide to link the number of unrelated individuals tothe square footage of the home. In one case, a Lea HiU home was converted by several owners. The home was just a few bedrooms and is now a 1600 square foot home with seven (7) bedrooms. Mr. Campbell believes four(4) unrelated individuals living in a Communal Residence would be sufficient. Mr. Campbell stated he is not supportive of the 6 month amortization period and believes it would allow noncompliant owners additional time to violate code without a license. He stated it is reasonable for owners to be compliant by the end of 2013 and that the Page 3 PLANNING COMMISSION MEETING MINUTES August 20, 2012. business licenses should run from January to December. Mr. Campbell is concemed that if inspections are perfortned during Summner or Christmas breaks fewer students. will be residing in the home. Performing the inspecition during the first term of school will show a realistic numberof students liying in the home. Staff addressed Mr. Campbell's comments regarding licensing, inspections, and the amortization period. Staff will be sending out post cards and a mailing, in addition to using the City's website, to inform property owne►s and tenants of the new code. With no other comments from the public Chair Roland closed the public hearing on ZOA13-0003, Title 5 and Title 18 related to StudenURental Housing at 7:23 p.m. Commissioner Couture stated he is supportive of four(4) nonrelated individuals in.a Communal Residence but would prefer five (5) nonrelated individuals. The Commission discussed the total number of nonrelated individuals in a Communal Residence. Vice-Chair Copple moved and Commissioner Smith seconded to recommend approval of ZOA13-0003, Title 5 and Title 18 related to StudenURental Housing as amended. MOTION CARRIED UNANIMOUSLY 7-0 B. ZOA13-0005 Amendments to C-1, LighYCommercial Zone* (Chamberlain) Chair Roland opened the public hearing on ZOA13-0005, amendments to the C-1, Light Commercial Zone at 7:30 p.m. Planning Services Manager Elizabeth Chamberlain provided the staff report on ZOA13-0005, amendments to the G1, Light Gommercial Zone. Staff provided a review of the proposed code amendments. Staff distributed a comment letter received by staff to be included with Exhibit 7. A City of Aubum Comprehensive Zoning map was also provided. Chair Roland opened the public hearing at 7:05 p.m. for ZOA13-0005, amendments to C-1, Light Commercial Zone. Nicole PetrinoSalter, 32021 132nd Ave. SE, Aubum. Ms. PetrinoSafter statetl she represenits six housefioliis within her neighborhood. As the represerdative of�the neightiorhood, she thanked Development Services Manager Jeff Tate for his effo�ts to assist them in correc4'ing zoning they believe is unjust. They feel he listened and intervened on their 6ehalf to work out a solution noted in the C-1 proposed amendments. � She also thanked Deputy Mayor Nancy Backus, PCDC Committee Vice-Chair John Holman, Member Largo Wales, and PlanningServices ManagerElizabeth C.hamberlain for listening to the concems of the residents and working hard to provide a solution to a critical situation for their families.. Page 4 PLANNING COMMISSION MEETING MINUTES August 20, 2012 Ms. Petrino-Salter stated the residents are in favor of the C-1 Code revisions described in Chapter 18.57, spec�cally those listed in Exhibit 1 ZOA13-0005, ACC Section 18.57.030 Residential A.1.g.(3) She stated they believe the designation is reasonable and would allow thefiamilies to sell theirproperties. She stated Me families depend on the favor of the Planning Commission to approve the amendments and thanked the Planning Commission for their time. With no further public commeMs, Chair Roland closed the public hearing on ZOA13- 0005, amendments to C-1, Light Commercial Zone, at 7:37 p.m. Commissioner Baggett moved and Commissioner Couture seconded to recommend City Council approve ZOA13-0005, Light Commercial Zone amendments as amended. MOTION CARRIED UNANIMOUSLY 7-0 C. ZOA13-0004, Amendments to the ACC 16.10.110, C�itical Areas Regulations Chair Roland opened the public openeiJ the public hearing on ZOA13-0004, amendments to the ACC 16.10.110, at 7:41 p.m. Principal Planner Jeff Dixon reviewed ZOA13-0004, amendments to ACC 16.10.110., amendments to the critical areas regulations. Staff reviewed the definition of mitigation and provided a brief history of the City's critical area regulations. ACC 16.10.110.6 states that"Mitigation Sites shall be located in the City.° Staffs recommendation is that the language be modified so that the Iocation of mitigation sites can be more flexible and can be located outside of the City, including through a mitigation bank or fee in-lieu. Chair Roland closed the public hearing on ZOA13-0004, Amendments to the ACC 16.10.110, Critical Areas Regulations at 7:59 p.m. CommissionerCopple moved and Commissioner Trout seconded to recommend City Council approve ZOA13-0005, C-1 mixed use amendments as recommended by staff. MOTION CARRIED 6-1 VII. OTHER BUSINESS A. 2013 Comprehensive Plan Amendments Principal Planner Jeff Dixon distributed the 2013 Comprehensive Plan Amendments docket. The Planning Commission and staff reyiewed the docket and the six, Gity- Initiated Text Amendments. Next, staff reviewed the City-Initiated Map amendments. Last, staff reviewed the City-Inkiated Map Amendments and Privately-Initiated Map Amendments. The next meeting wiil be held September 4, 2013. VIII.
