ORDINANCE NO. 767 AN ORDINANCE: Relating to oerta.in requirements to be complied with by, and the bOnd to be given by, a garbage con- traotor: and amending Seotion 12 of Ordinance No. 465 as amended by Ordinance No. 668 01' the ordinanoes of the City of Auburn. . THE CITY COUNCIL OF THE CITY OF AUBURN DO ORDAIN AS FOLLOWS: Seotion 1. That seotion 12 of Ordinance No. 465 of the ordinanoes of the City of Auburn entitled "An Ordinance defining garbage and waste natter, deolaring the acoumulation thereof within the City 01' Auburn to be a publio nui_noe and detrimental to the public health and offensive to the senses, providing the nanner of disposal thereof, providing for the letting of an exolusive oontract for the removal and destruction of garbage and waste na tter and dead an1ma.ls and fowls, prov id ing penal t 18s for violations hereof, and repealing Ordinance No. 268 and Ordin- anoe No. 297 of the ordinances of the City of Auburn", be amended sO that as amended, said Section 12 shall rea.d as fOllows: "section 12. That the garbage contractor shall wholly at his OWn expense acquire by lease, purchase or otherwise and prOVide and maintain a place and grounds as a garbage dump to which all garbage and waste matter and dead animals and fowls accumula.ted or accumulating within the limits of the City of Auburn and remOVed by the garbage contraotor shall be removed and there destroyed: that such plaoe and grounds c.to be sO used as a garbage dump shall be wholly outside 01' the oorporate limits of the City of Auburn and not less than eighty (80) rods, measured in a straight line, from the neareet part of such corporate limite; that the Garbage Contraotor shall at all times save the City of Auburn harmless from any and all claims arising or to arise from the use of suoh place and grounds as a garbage dump and will, wholly t at his expense, defend any suit, aotion or claim (if any) brought or claimed on aocount of such use: that thegarbage oontractor shall, immediately after emptying any garbage can provided with a oover as in this Ordinance reQ.uired, properly repla.oe such cover u,pon stICh garbage can: that all of the provis ions of thi s ord in- anCe insofar as the same relate tQ or effeot suoh garbage contractor, shall be deemed a oontraot between the City of Auburn and suoh garbage contraotor as fully and to the same extent as though the same were fully included in a separate written contraot between the City of Auburn and such garbage contraotor: and that before any oontraot shall be finally let and a1'lll.rded by the City 01' Auburn to a garbage oontraotor for the removal and destruction of garbage and waste mtter and before'suoh oontract 'shall be signed and executed on behalf of the City of Auburn; the person, firm or oorporation to whom such oontraot is being let and awarded shall furnish a bond to the City of Auburn with ~ gOod and suffioient surety or sureties to be approved by the City CouncU in the sum of One Thousand Dollars ($1,000.00) oOnditioned for. the faithful performnoe of his, their or its contraot and~ for the faithful c omplianoe by said garbage 0 ontraotor ~I\all of the ordinanoes of the City of Auburn relating to the removal and deetruction of garbage and waste natter".
